MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING JUNE 11, 2015 CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. Roll Call. Present: Denise Loustalot, Mayor Gina Fortino Dickson, Vice Mayor Russell Perdock, Councilmember Joyce Overton, Councilmember Bruno Sabatier, Councilmember Staff: Joan Phillipe, City Manager Tim Celli, Police Lieutenant Melissa Swanson, City Clerk Chris Becnel, Director of Finance Ryan R. Jones, City Attorney INVOCATION/MOMENT OF SILENCE Vice Mayor Fortino Dickson led a moment of silence. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS ACTION: It was moved by Councilmember Perdock and seconded by Councilmember Overton to approve the agenda as amended. The motion passed with a unanimous roll call vote. PRESENTATIONS Presentation by Lt. Tim Celli of a Clearlake Police Department Commendation and Introduction of New Officers PUBLIC COMMENT – Linda Richardson spoke regarding a property near her home owned by the city that has squatters and vandals. Kelly Reed spoke regarding the same property and stated there has been no change in the property since the last meeting where she came to speak. Bill Shields spoke regarding the city’s bond money and how it is spent. Estella Creel spoke regarding the fence ordinance and variance process. She also spoke of a conversation regarding the medical marijuana ordinance she had with Councilmember Sabatier. Consent Items Recommended Action CCM 06-11-15 Page 1 of 3 1. Consideration of Second Reading of Ordinance Waive further reading, and adopt Ordinance No. No. 174-2015, An Ordinance of the City Council of 174-2015 the City of Clearlake Repealing Ordinance No. 173-2015, Which Amended Chapter X of the Clearlake Municipal Code Adding Section 10-8 (Abatement of Public Nuisances) and 10-9 (Administrative Penalties) and Repealed and Replaced Section 10-7 (Medical Marijuana Cultivation), to Ban the Cultivation of Medical Marijuana 5. City Council Granting Authorization to City Authorize City Manager to sign consent letters Manager to Sign Letters of Consent to Cache Creek Partners, L.P., a California Limited Partnership for the Transfer of Limited Partnership Interests to a To-Be-Formed Limited Partner Cache Creek Ventures, LLC 6. Consideration of Resolution No 2015-14, A Adopt resolution RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLEARLAKE APPROVING A TEMPORARY STREET CLOSURE, for the 58th July 4th BBQ and Parade on July 4th, 2015 7. Consideration of Adoption of Resolution No. Adopt Resolution No. 2015-15 2015-15 Approving Amendments to the Memorandum of Understanding Between City of Clearlake and Middle Management Association ACTION: It was moved by Councilmember Perdock and seconded by Vice Mayor Fortino Dickson to accept the Consent Calendar items as presented. The motion passed with a unanimous roll call vote. BUSINESS 8. Consideration of Second Reading of Ordinance No. 175-2015, Amending Ordinance No. 2013-161A, An Ordinance of the City Council of the City of Clearlake Amending Chapter X of the Clearlake Municipal Code Adding Section 10-7 Prohibiting Commercial Medical Marijuana Cultivation and Cultivation on Vacant Properties and Limiting Cultivation Amounts in the City of Clearlake CCM 06-11-15 Page 2 of 3 City Manager Phillipe and City Attorney Jones gave the staff report. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Perdock to hold the second reading of the ordinance, read it by title only, and adopt Ordinance No. 175- 2015. The motion passed with a unanimous roll call vote.
