MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING MAY 26, 2016 CALL TO ORDER BUDGET WORKSHOP: 4:35 P.M. Roll Call. Present: Russell Perdock, Mayor Gina Fortino Dickson, Vice Mayor Nick Bennett, Councilmember Absent: Joyce Overton, Councilmember Bruno Sabatier, Councilmember Staff: Greg Folsom, City Manager Chris Becnel, Director of Finance Ryan R. Jones, City Attorney Adeline Brown, Deputy City Clerk 1. Study Session on the Draft City of Clearlake Budget for Fiscal Year 2016-2017 Director of Finance Becnel gave the presentation. The Council took no action on this item. CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:03 P.M. Roll Call. Present: Russell Perdock, Mayor Gina Fortino Dickson, Vice Mayor Nick Bennett, Councilmember Absent: Joyce Overton, Councilmember Bruno Sabatier, Councilmember Staff: Greg Folsom, City Manager Ryan Jones, City Attorney Tim Celli, Police Lieutenant Melissa Swanson, City Clerk Chris Becnel, Director of Finance CCM 05-26-16 Page 1 of 4 INVOCATION/MOMENT OF SILENCE Pastor Ken Savin gave the invocation. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS City Manager Folsom asked to delete Item #5, Consideration of a Letter of Support for the Rides to Wellness Grant Proposal by Lake County/City Area Planning Council, from the agenda. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Bennett to approve the agenda as amended. The motion passed with a unanimous voice vote, with Councilmembers Overton and Sabatier absent. PRESENTATION 1. Police Department Update Councilmember Overton arrived at 6:30 p.m. 2. Presentation from Konocti Regional Trails Councilmember Sabatier arrived at 7:45 p.m. PUBLIC COMMENT There was no public comment. Consent Items Recommended Action 3. Warrant Registers Receive and file 4. Receipt of Notice of Annual Rate Modification Receive and file from Clearlake Waste Solutions 5. Consideration of a Letter of Support for the Authorize the Mayor to send a letter of Rides to Wellness Grant Proposal by Lake support County/City Area Planning Council Item #5 was deleted from the agenda. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Sabatier to approve the remaining items of the Consent Calendar as presented. The motion passed with a unanimous voice vote. CCM 05-26-16 Page 2 of 4 PUBLIC HEARING 6. Public Hearing to Consider Introduction and First Reading of Ordinance No. 189-2016, An Ordinance of the City Council of the City of Clearlake Adding Chapter 3-7 to the Clearlake Municipal Code Related to a Transactions and Use Tax to Be Administered by the State Board of Equalization City Manager Folsom gave the staff report. Mayor Perdock opened the Public Hearing at 8:06 p.m. Henry Bornstein spoke against the ordinance and suggested changes. Sheryl Almon spoke in favor. Marie Weathers suggested having a Town Hall meeting. Denise Loustalot spoke in favor. Chuck Leonard spoke in favor. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Fortino Dickson to close the Public Hearing. The motion passed with a unanimous roll call vote at 8:24 p.m. Mayor Perdock reopened the Public Hearing at 8:55 p.m. Henry Bornstein asked questions of staff regarding the ordinance. Beth Kaiman asked questions of staff regarding the ordinance. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Sabatier to close the Public Hearing. The motion passed with a unanimous voice vote at 9:05 p.m. ACTION: It was the consensus of the Council to correct wording in the ordinance for clarification in section 3-7.3(b) to state “road maintenance and improvement” instead of “clean up and improvement;” and to modify the Expenditure Plan to: 1) move “Graveling and associated grading on existing unpaved roads” under “Road Maintenance & Improvements” from the sixth bullet point to the top bullet point and to put the words in bold font; 2) to remove the text box labeled “Maintenance Equipment and Personnel,” remove the bullet point “personnel”; and 3) move the bullet points “Road construction equipment rental, lease, purchase” and “Road construction equipment repair” and the corresponding ten percent (10%) to the “Road Maintenance & Improvements” activity heading. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Overton to hold the introduction and first reading of Ordinance No. 189-2016, An Ordinance of the City Council of the City of Clearlake Adding Chapter 3-7 to the Clearlake Municipal Code Related to a CCM 05-26-16 Page 3 of 4 Transactions and Use Tax to Be Administered by the State Board of Equalization as modified, read by title only, and set second public hearing and reading for the June 9th regular meeting. The motion passed with a 5-0 roll call vote. BUSINESS 7. Modifications to the Mayor’s Appointments for 2016 ACTION: Mayor Perdock appointed Councilmember Bennett as Member to the PEG Board and Traffic Safety Committee, and Alternate to the Lake County Clean Water Program Advisory Council. It was moved by Councilmember Sabatier and seconded by Vice Mayor Fortino Dickson to confirm the modifications to the 2016 Mayor’s Appointments. The motion passed with a unanimous roll call vote. Councilmember Overton left at 9:14 p.m. due to illness. CITY MANAGER AND COUNCILMEMBER REPORTS FUTURE AGENDA ITEMS ACTION: Councilmember Sabatier asked for and received consensus to ask the valedictorian of each high school in the Konocti Unified School District to come to a future Council meeting for a Certificate of Appreciation. CLOSED SESSION: (1) CONFERENCE WITH LABOR NEGOTIATORS: Agency designated representatives: City Manager Greg Folsom; Employee organization: Clearlake Municipal Employees Association, Clearlake Police Officers Association, Clearlake Middle Management Association and Clearlake Management Employees ANNOUNCEMENT OF ACTION(S) FROM CLOSED SESSION There was no action taken by Council in closed session.
