Pastor Don Nieto led the invocation. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS There were no changes to the agenda. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Sabatier to approve the agenda. The motion passed with a unanimous voice vote. PRESENTATION 1. Presentation of a Certificate of Appreciation – Lions Club PUBLIC COMMENT Sheryl Almon spoke regarding public nuisances and the process for cleanups. Rick Mayo spoke regarding the need for community’s to love and respect one another and the need for racial discrimination to end. Bill Shields spoke regarding the poverty level of the seniors in the community. Consent Items Recommended Action 2. Warrant Registers Receive and file ACTION: It was moved by Councilmember Sabatier and seconded by Vice Mayor Fortino Dickson to approve the Consent Calendar as presented. The motion passed with a unanimous roll call vote. PUBLIC HEARING 3. Public Hearing to Confirm Assessments for Administrative Penalties for Failure to Abate Public Nuisance(s) in Accordance with C.M.C. Sections 1-5, 1-9, 10-1.6, 10-1.7, 10-1.9, 10-1.12, 10-2.2(b), 10-2.4, 10-2.5, 10-2.6, 10-2.7, 10-2.8, 10-3.1, 10-3.3, 10-5 and 10-5.6; Resolution No. 2016-27 CCM 07-14-16 Page 2 of 4 City Manager Folsom and Code Enforcement Supervisor Lambert gave the staff report. Mayor Perdock opened the Public Hearing at 6:43. Patricia Lowellfield, 14415 Alvita Avenue, spoke against the assessment. Sheryl Almon spoke against the assessment. Angie Luiz, 3529 Madrone Street and 3519 Madrone Street, spoke against the assessment. Stephanie Darr, 3780 Manchester Avenue, spoke against the assessment. John Jackson, 3825 Old Highway 53, spoke against the assessment. An unnamed gentleman spoke against the assessment at 3825 Old Highway 53. Rick Mayo asked for clarification on the assessments in future reports. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Bennett to close the Public Hearing at 7:40 p.m. The motion passed with a unanimous roll call vote. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Sabatier to adopt Resolution No. 2016-27, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLEARLAKE CONFIRMING SPECIAL ASSESSMENTS CONSISTING OF ADMINISTRATIVE PENALTIES FOR FAILURE TO ABATE PUBLIC NUISANCE AND APPROVING LIEN AGAINST REAL PROPERTY IN ACCORDANCE WITH SECTIONS 1-5, 1-9, 10-1.6, 10-1.7, 10-1.9, 10-1.12, 10-2.2(b), 10-2.4, 10-2.5, 10-2.6, 10-2.7, 10-2.8, 10-3.1, 10-3.3, 10-5 AND 10-5.6 OF THE CLEARLAKE MUNICIPAL CODE, excluding properties 040-354-090, 040-182-320, 039-560-620, and 039-472-590. The motion passed with a unanimous roll call vote. BUSINESS 4. Senior Center Annual Update City Manager Folsom gave the staff report. No action was taken by Council on this item. 5. Consideration of Resolution 2016-28 of the City Council of the City of Clearlake Approving the Purchase of Real Property Located at 14335 Pearl Avenue (APN: 040-091-24) and the Adjacent Property Located at Pearl Avenue (APN: 040-091-37) City Manager Folsom gave the staff report. ACTION: It was moved by Councilmember Sabatier and seconded by Vice Mayor Fortino Dickson authorizing funding from the Series A bond proceeds in the amount of $90,500 to cover the acquisition and related costs to purchase the properties identified as APN 040-091-24 and 040- 091-37; authorizing the City Manager to take all actions necessary to finalize the purchase of said properties; and authorizing the City Manager to take all actions necessary to record an easement on APN 040-091-18 and adopt Resolution 2016-28 and read it by title only, approving the purchase of real property located at 14335 Pearl Avenue (APN: 040-091-24) and the adjacent property located at Pearl Avenue (APN: 040-091-37). The motion passed with a unanimous roll call vote. 7. Rebuttal Argument for Measure V City Manager Folsom gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Sabatier to approve Rebuttal Argument for Measure V and Authorize Deputy City Clerk to submit to Registrar. The motion passed with a unanimous roll call vote.
