MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING AUGUST 24, 2017 CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. Roll Call. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS City Manager Folsom requested Item #10, Consideration of Resolution approving the Form of Preliminary Official Statement and Bond Purchase Contract in connection with the Refunding of the Successor Agency’s Long-Term Bonded Indebtedness, and Approving Certain Other Matters and Official Actions Related Thereto, be heard after the Consent Calendar. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Bennett to approve the agenda as amended. The motion passed with a unanimous voice vote. PRESENTATION 1. ACTION: It was moved by Member Bennett and seconded by Member Harris to approve Resolution No. SA-2017-06 approving the Form of Preliminary Official Statement and Bond Purchase contract in Connection with the Refunding of the Successor Agency’s Long-Term Bonded Indebtedness, and Approving Certain Matters and Official Actions Related Thereto. PUBLIC HEARING 5. Public Hearing to Confirm Assessment(s) in the Total Amount of $30,000.00 for Administrative Penalties for Failure to Abate Public Nuisance(s) in Accordance with C.M.C. Section(s) 1-5, 1-9, 10- 1.6, 10-1.7, 10-1.9, 10-1.12, 10-2.2(b), 10-2.4, 10-2.5, 10-2.6, 10-2.7, 10-2.8, 10-3.1, 10-3.3, 10-5 and 10-5.6; Resolution No. 2017-52 Code Enforcement Officers Viramontes and Felder gave the staff reports. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Sabatier to close the Public Hearing at 7:03 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to adopt Resolution No. 2017-52 confirming assessments, with the removal of #2 and #3 as stated above. Public Hearing to hear and act upon an Abatement Order Appeal Hearing referencing real property located at 16640 6th Avenue Clearlake, CA 95422 in accordance with C.M.C. section(s) 18- 9.110, 18-9.120, 18-9.130 and 18-10 in its entirety Code Enforcement Officer Felder gave the staff report. Mayor Perdock opened the Public Hearing at 7:08 p.m. Dwayne Yiggins, property owner, spoke against the abatement order. Smiley James Harris, appellant, spoke against the abatement order. ACTION: It was moved by Councilmember Harris and seconded by Councilmember Overton to close the Public Hearing at 7:18 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Overton to adopt Resolution No. 2017-53, denying the appeal. The motion passed with a unanimous roll call vote. 7. Public Hearing to hear and act upon an Abatement Order Appeal Hearing referencing real property located at 3912 Fir Avenue Clearlake, CA 95422 in accordance with C.M.C. section(s) 18- 9.110, 18-9.120, 18-9.130 and 18-10 in its entirety Code Enforcement Officer Felder gave the staff report. Mayor Perdock opened the Public Hearing at 7:26 p.m. There was no public comment on this item. ACTION: It was moved by Councilmember Harris and seconded by Vice Mayor Sabatier to close the Public Hearing at 7:26 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Harris to approve Resolution No. 2017-54, denying the appeal and to read it by title only. The motion passed with a unanimous roll call vote. 8. The motion passed with a unanimous roll call vote. 9. Public Hearing to hear and act upon an Abatement Order Appeal Hearing referencing real property located at 15901 21st Avenue Clearlake, CA 95422 in accordance with C.M.C. section(s) 18- 9.110, 18-9.120, 18-9.130 and 18-10 in its entirety Code Enforcement Officer Felder gave the staff report. Mayor Perdock opened the Public Hearing at 7:31 p.m. There was no public comment on this item. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Harris to close the Public Hearing at 7:31 p.m. The motion passed with a unanimous voice vote. ACTION: It was moved by Councilmember Bennett and seconded by Vice Mayor Sabatier to approve Resolution No. 2017-56, denying the appeal and to read it by title only. The motion passed with a unanimous roll call vote. BUSINESS 11. Consideration of Future Commercial Cannabis Ordinances City Manager Folsom gave the staff report. ACTION: It was the consensus of the Council to direct staff to work with the Commercial Cannabis ad hoc committee and the Planning Commission to bring forward an ordinance for the Council’s consideration. 12. Consideration of Second Amendment to Employment Services Agreement for City Manager, Greg Folsom City Attorney Jones gave the staff report. ACTION: It was moved by Vice Mayor Sabatier and seconded by Councilmember Harris to approve Second Amendment to Employment Services Agreement for City Manager, Greg Folsom. The motion passed with a unanimous roll call vote. 13. Discussion of the 2017 League of California Cities (LOCC) Annual Conference Resolutions City Clerk Swanson gave the staff report. CCM 08-24-17 Page 5 of 6 ACTION: It was the consensus of the Council to support the Resolutions proposed by the LOCC and to direct Mayor Perdock to vote in favor at the Annual Conference. Councilmember Overton left the dais at 8:32 p.m. due to an emergency.
