MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING AUGUST 9, 2018 CALL TO ORDER CLOSED SESSION: 5:30 P.M. Roll Call. CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:04 P.M. Roll Call. Present: Bruno Sabatier, Mayor Phil Harris, Vice Mayor Nick Bennett, Councilmember Joyce Overton, Councilmember Russ Cremer, Councilmember Staff: Greg Folsom, City Manager Ryan Jones, City Attorney Russ Hildebrandt, Deputy City Attorney Andrew White, Chief of Police Melissa Swanson, City Clerk Alan Flora, Finance Director INVOCATION Todd Hinkle gave the invocation. PUBLIC COMMENT David Sutherland spoke regarding the need for fire prevention in the Avenues. He stated there is thick underbrush and garbage. He suggested the City get a State grant for abatement. The motion passed with a unanimous voice vote. PUBLIC HEARING: 4. Consideration of Development Agreement with Chris Jennings for Commercial Cannabis Operations City Manager Folsom gave the staff report. City Attorney Jones announced minor numbering corrections to the Agreement which were non- substantive. Mayor Sabatier opened the Public Hearing at 6:20 p.m. Chris Jennings, applicant, answered questions from the Council. There was no further public comment. Mayor Sabatier closed the Public Hearing at 6:22 p.m. ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Cremer to hold the first reading of Ordinance No. 207-2018, read by title only, An Uncodified Ordinance of the City Council of the City of Clearlake Approving a Development Agreement with Chris Jennings for the Property Located at 16520 Dam Road, waive further reading and set second reading and adoption for August 23, 2018. The motion passed with a unanimous roll call vote. 5. Consideration of Development Agreement with Clearlake Hydrogarden for a Commercial Cannabis Nursery City Manager Folsom gave the staff report. Mayor Sabatier opened the Public Hearing at 6:28 p.m. The applicant was present to answer questions by the Council. CCM 08-09-18 Page 2 of 4 There was no other public comment. Mayor Sabatier closed the Public Hearing at 6:32 p.m. ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Bennett to hold the first reading of Ordinance No. 208-2018, read by title only, An Uncodified Ordinance of the City Council of the City of Clearlake Approving a Development Agreement with Clearlake Hydrogarden for the Property Located at 2395 Ogulin Canyon Road, waive further reading and set second reading and adoption for August 23, 2018. The motion passed with a unanimous roll call vote. 6. Consideration of Development Agreement with Gold Country Growers Clearlake for Distribution and a Delivery Only Dispensary Councilmember Overton recused herself from this item due to a business conflict. The owner of the property provides free storage for the Highlands Senior Service Center, of which Overton is the Executive Director. Mayor Sabatier opened the Public Hearing at 6:35 p.m. There was no public comment on this item. Mayor Sabatier closed the Public Hearing at 6:36 p.m. ACTION: It was moved by Vice Mayor Harris and seconded by Councilmember Cremer to hold the first reading of Ordinance No. 209-2018, read by title only, An Uncodified Ordinance of the City Council of the City of Clearlake Approving a Development Agreement with Gold Country Growers Clearlake for the Property Located at 14935 Olympic Drive, waive further reading and set second reading and adoption for August 23, 2018. The motion passed with a unanimous roll call vote, with Councilmember Overton abstaining. Councilmember Overton returned to the dais at 6:38 p.m. BUSINESS: 7. Consideration of Appointment of a Planning Commissioner to Fill an Unexpired Term Ending in March 2021 City Clerk Swanson gave the staff report. There was one applicant present, Robert Coker. The Council interviewed Mr. Coker. ACTION: It was moved by Councilmember Overton and seconded by Vice Mayor Harris to appoint Robert Coker as Planning Commissioner to fill an unexpired term ending in March 2021. The motion passed with a unanimous voice vote. 8. Discussion of the 2018 League of California Cities (LOCC) Annual Conference Resolutions CCM 08-09-18 Page 3 of 4 City Clerk Swanson gave the staff report. ACTION: It was the consensus of the Council to provide direction to the LOCC’s delegates to vote in favor of LOCC Resolution No. 1, A Resolution of the League of California Cities Calling Upon the League to Respond to the Increasing Vulnerabilities to Local Municipal Authority, Control and Revenue and Explore the Preparation of a Ballot Measure and/or Constitutional Amendment that Would Further Strengthen Local Democracy and Authority, and against LOCC Resolution No. 2, A Resolution of the League of California Cities Declaring Its Commitment to Support the Repeal of Preemption in California Food and Agriculture Code Section 11501.1 that Prevents Local Governments From Regulating Pesticides. CITY MANAGER AND COUNCILMEMBER REPORTS FUTURE AGENDA ITEMS: Vice Mayor Harris asked for and received a consensus of the Council to bring forward a discussion on fire prevention, weed abatement fines and assessments, and controlled burns to a future agenda.
