City Council Meeting Minutes ___________________________________________________________________________________________ THURSDAY, AUGUST 1, 2013 CITY HALL COUNCIL CHAMBERS CITY OF COLUMBIA CITY, COLUMBIA COUNTY, OREGON AGENDA ITEM 1 CALL TO ORDER/ROLL CALL: CONVENED: Council President Marson called the regular meeting to order at 6:01 p.m. and led the flag salute. COUNCIL MEMBERS PRESENT: Mayor Cheryl A. Young (arrived 6:02 p.m.) Councilor Shannon Fitzgibbons Councilor Sally Ann Marson Councilor Casey Wheeler COUNCIL MEMBERS ABSENT: Councilor Josh Fromm ALSO PRESENT: Michael McGlothlin, Chief of Police Micah Rogers, Public Works Superintendent Leahnette Rivers, City Administrator/Recorder ATTORNEY PRESENT: Harold Olsen, City Attorney A quorum was present and due notice had been published. AGENDA ITEM 2 PUBLIC HEARINGS: None. AGENDA ITEM 3 CITIZEN INPUT: AGENDA ITEM 4 COUNCIL REPORTS: 4.1 Parks Committee: Chair Fitzgibbons reported that the Parks Committee had a th productive meeting on July 30 . 4.2 Water and Sewer Committee: Micah reported that the City’s groundwater well produced over 7 million gallons of water during the month of July 2013. Leahnette said we have re-bid the Water Meter Installation project, and bids are due by 2:00 p.m. on August 7, 2013. Micah reported that an air relief valve in the RCE lift station malfunctioned and got stuck in the open position. As a result, our chemical feed pumps were submerged in sewer and now they need to be replaced, which will cost about $2,000. Leahnette said she has reported the incident to our insurance carrier. Micah said the new pumps should be here in 2 - Regular City Council Meeting August 1, 2013 3 or 4 days. He said the air relief valve has been repaired, and they have piped it out of the vault and back into the lift station to prevent similar damage in the future 4.3 Street Committee: Councilor Marson said several citizens have expressed concern about children playing on Eighth Street between “I” and “K” Streets. The Council discussed the matter at length with staff. It was the consensus that additional signage and patrols may not be the best solution because vehicles don’t seem to be traveling in excess of 20 mph. Chief McGlothlin will stop by and speak with the parents of the children in an effort to resolve the problem. 4.4 Sewer Committee: No report. 4.5 Audit Committee: No report. 4.6 Hazard Mitigation Planning Group: Team Member Wheeler said the Hazard th Mitigation Team will meet on Monday, August 5 . 4.7 Other Reports: Mayor Young said she recently attended part of the Mayor’s Conference in Corvallis. She said next year the Mayor’s Conference will be held in Pendleton. AGENDA ITEM 5 CONSENT AGENDA: 5.1 Activities report from the City Administrator/Recorder. MOVED (WHEELER), SECONDED (FITZGIBBONS), AND CARRIED UNANIMOUSLY BY ROLL CALL VOTE TO APPROVE THE CONSENT AGENDA. AGENDA ITEM 6 UNFINISHED BUSINESS: AGENDA ITEM 7 NEW BUSINESS: 7.1 Council Bill No. 13-687; Resolution No. 13-1091-R: A Resolution establishing the time and place for all Columbia City Municipal Court sessions. MOVED (WHEELER), SECONDED (FITZGIBBONS) AND CARRIED UNANIMOUSLY TO ADOPT COUNCIL BILL NO. 13-687. 7.2 License and Liability Waiver: License and Liability Waiver associated with the use of a parcel of land owned by the Port of St. Helens for an off-leash dog park. MOVED (MARSON), SECONDED (FITZGIBBONS) AND CARRIED UNANIMOUSLY TO APPROVE THE LICENSE AND LIABILITY WAIVER. 7.3 City Administrator Performance Evaluation: Further discussion about the City Administrator Performance Evaluation process. Councilor Wheeler said he has received input from everyone for the performance evaluation process. He said he will compile the information and give the results to the Mayor. AGENDA ITEM 8 OTHER BUSINESS: City Attorney report: Harold mentioned that the City has received a letter from the Second Amendment Foundation that says one of our City Ordinances is unlawful or unconstitutional. He said the ordinance provides that in case of an emergency, the Mayor can prohibit the carrying of weapons in public places. He said to date, the City has never exercised that part of the ordinance. He said the Second Amendment Foundation may be correct, but it is somewhat unclear. He said there is a case before the Oregon Supreme Court that permits the City to prohibit the carrying or possession of loaded weapons in a 3 - Regular City Council Meeting August 1, 2013 public place. He said the term “loaded” is not in our ordinance, and we could modify it to include the term. Harold suggested for now we wait and see what happens with the court case. He said it seems that every City in the state received a similar letter. Reschedule City Council Meeting: Leahnette asked the Council for permission to nd th schedule the second meeting in August on the 22 instead of the 15 because she will be out of town. No objections were heard from the Council.
