City Council Meeting Minutes ___________________________________________________________________________________________ THURSDAY, OCTOBER 1, 2015 CITY HALL COUNCIL CHAMBERS CITY OF COLUMBIA CITY, COLUMBIA COUNTY, OREGON AGENDA ITEM 1 CALL TO ORDER/ROLL CALL: CONVENED: Mayor Young called the regular meeting to order at 6:00 p.m. Mayor Young delivered the invocation and led the audience in the flag salute. COUNCIL MEMBERS PRESENT: Mayor Cheryl A. Young Councilor Sally Ann Marson Councilor Nell Harrison Councilor Gordon Thistle COUNCIL MEMBERS ABSENT: Councilor Josh Fromm ALSO PRESENT: Lisa Smith, City Planning Micah Rogers, Public Works Superintendent Leahnette Rivers, City Administrator/Recorder ATTORNEY PRESENT: Stephen D. Petersen, City Attorney (arrived 7:12 p.m.) A quorum was present and due notice had been published. AGENDA ITEM 2 PUBLIC HEARINGS: None. AGENDA ITEM 3 CITIZEN INPUT: 3.1 Janet Wright re: proposed CC Rider Transportation District: Janet Wright presented the City Council with a request that the City support the initiation of the formation of a CC Rider Transportation District and establish a permanent tax rate for the district by placing a measure on the May 2016 ballot. Janet said the proposed tax rate is $0.23 per $1,000 of assess property value, which would fully support the service. She distributed information about the current transit routes and ridership history for the Council to review. AGENDA ITEM 7 NEW BUSINESS: 7.1 Council Bill No. 15-770; Resolution No 15-1155-R: A Resolution approving a County Order to form a Transportation District with a permanent tax rate. MOVED (THISTLE) AND SECONDED (HARRISON) TO ADOPT COUNCIL BILL NO. 15- 1155-R. 2 - Regular City Council Meeting October 1, 2015 Joseph Turner of 2920 Sixth Street asked if the permanent tax rate could ever be raised. He said he wants to make sure it will never increase. Janet Wright said a permanent tax rate is just that - a permanent rate. MOTION CARRIED. Councilor Marson abstained from voting. AGENDA ITEM 3 CITIZEN INPUT (continued): Agnes Petersen of 33625 Tide Creek Road, Deer Island, announced that Kannikar Petersen was recently chosen as a Woman of Vision for the State of Oregon by the Oregon Daily Journal of Commerce. Agnes said in recent months she has pushed to get the State of Oregon to treat people over 75 years of age equally with other people. She said a measure will placed on the ballot that would allow someone to continue to serve as a judge within the State of Oregon after they reach 75 years of age, and she encouraged support for this measure. AGENDA ITEM 4 COUNCIL REPORTS: 4.1 Parks Committee: Chair Marson said the crew recently planted several hundred daffodil bulbs within the Veterans Park. Micah said the Eagle Scout project involving the installation of a new see-saw in Harvard Park is set to kick off October 17. 4.2 Water and Sewer Committee: Micah said the manhole work associated with the Sewer Improvement Project may start as early as next Monday. 4.3 Street Committee: Chair Marson said the residents are very appreciative of the new fire hydrant that was installed at the corner of Seventh and “K” Streets. 4.4 Audit Committee: Secretary Harrison said the Audit Committee will meet on October 20. 4.5 Hazard Mitigation Planning Group: No report. 4.6 Other Reports: None. AGENDA ITEM 5 CONSENT AGENDA: 5.1 Application for a permit to place a portable basketball hoop in the right-of- way as applied for by Tom Kirkpatrick of 510 Skookum Court, Columbia City. MOVED (THISTLE), SECONDED (MARSON) AND CARRIED UNANIMOUSLY TO APPROVE THE CONSENT AGENDA. AGENDA ITEM 6 UNFINISHED BUISNESS: 6.1 Findings of Fact: Findings of Fact related to an application for a Comprehensive Plan Text and Map Amendment and Rezoning of property described as Tax Lots 5128-0DA-5100, 5128-0DA- 5102, and 5128-0DA-5103 from R-2, Moderate Density Residential, to R-3, High Density Residential as applied for by Columbia Harbour LLC. The property consists of approximately 1.33 acres and is adjacent to the west side of Second Street and the north side of the River Club Estates Subdivision. MOVED (MARSON), SECONDED (THISTLE) AND CARRIED TO ACCEPT THE FINDINGS OF FACT. Councilor Harrison abstained from voting. 3 - Regular City Council Meeting October 1, 2015 6.2 First reading of Council Bill No. 15-769: An Ordinance amending the Columbia City Comprehensive Plan as adopted by Ordinance No. 03-585-O, and amending the Columbia City Comprehensive Plan and Zoning Map. The Council completed the first reading of Council Bill No. 15-769. AGENDA ITEM 8 OTHER BUSINESS: Community Hall Rental Agreement Addendum: Council reviewed a proposed addendum to the Community Hall Rental Agreement submitted by Lilia Teninty, Director of Developmental Disabilities for the Department of Human Services (DHS). Steve said he has no concerns with their proposal to add language adopting the Oregon Tort Claims statute, but he does object to their proposed removal of the hold harmless language. MOVED (MARSON), SECONDED (THISTLE) AND CARRIED UNANIMOUSLY TO AUTHORIZE SIGNATURE TO AN ADDENEDUM THAT ADDS PROPOSED TORT CLAIMS LANGUAGE TO THE CITY’S CURRENT RENTAL AGREEMENT FOR THE DHS. City Planner Report: Lisa Smith said she has enjoyed working for the City and thanked the Mayor, City Council and staff for the opportunity.
