City Council Meeting Minutes ___________________________________________________________________________________________ THURSDAY, JULY 20, 2017 CITY HALL COUNCIL CHAMBERS CITY OF COLUMBIA CITY, COLUMBIA COUNTY, OREGON AGENDA ITEM 1 CALL TO ORDER/ROLL CALL: CONVENED: Mayor Young called the regular meeting to order at 6:00 p.m. Mayor Young delivered the invocation and led the flag salute. COUNCIL MEMBERS PRESENT: Mayor Cheryl A. Young Councilor Nell Harrison Councilor Sally Ann Marson Councilor Gordon Thistle COUNCIL MEMBERS ABSENT: Councilor Karli Ebert ALSO PRESENT: Leahnette Rivers, City Administrator/Recorder ATTORNEY PRESENT: None A quorum was present and due notice had been published. AGENDA ITEM 2 PUBLIC HEARINGS: None. AGENDA ITEM 3 CITIZEN INPUT: None. AGENDA ITEM 4 COUNCIL REPORTS: 4.1 Parks Committee: Chair Marson said the minutes from the last meeting were included in the meeting packet, and the next meeting will be held next Tuesday. 4.2 Water and Sewer Committee: Leahnette reported that the funding applications for the water and sewer improvements projects are progressing. She said recently there was a sewer backup incident at the Columbia City Mini Market. She said the problem was a grease blockage, and during the repair we discovered that the store/deli does not have a grease trap. She said the City will be sending them a warning letter for putting grease into the sewer system, along with some education materials for them to share with their employees. We will also require they install a grease trap. Leahnette reported that the crew recently repaired a water leak at City Hall. She said the leak was discovered when the tree in the front yard started to lean over and the basement started to take on water. 2 - Regular City Council Meeting July 20, 2017 4.3 Street Committee: Chair Marson said the Sixth Street paving work is expected to occur sometime next week. Leahnette said we recently switched to a different street sweeping company in an effort to improve service. 4.4 Audit Committee: No report. 4.5 Hazard Mitigation Planning Group: Leahnette said the Hazard Mitigation Planning Group will meet next Monday. 4.6 Other Reports: Mayor Young said she will be attending the Oregon Mayors Conference next week. AGENDA ITEM 5 CONSENT AGENDA: 5.1 Bills paid with check numbers 20317 through 20386 during the month of June 2017. 5.2 Minutes of the Regular City Council Meeting on June 15, 2017. 5.3 Minutes of the Regular City Council Meeting on June 28, 2017. 5.4 Activities report from the Chief of Police. 5.5 Activities report from the Public Works Superintendent. 5.6 Activities report from the City Administration. Leahnette suggested Item 5.5 be removed from the Consent Agenda. MOVED (THISTLE), SECONDED (MARSON) AND CARRIED UNANIMOUSLY BY ROLL CALL VOTE TO APPROVE THE CONSENT AGENDA AS AMENDED. AGENDA ITEM 6 UNFINISHED BUSINESS: 6.1 Discussion of the local regulation of marijuana. The Council continued to discuss this topic with staff. Leahnette said the first tax distribution is supposed to be released sometime after July 1st and before December 1st, and at time there is no estimate of the amount of the distribution. She said League staff members estimate that the amount will be less than the alcohol tax distribution amount, which is about $30,000 annually for the City. Leahnette said if the City wants to establish its own local tax, the matter would need to be referred to the voters during a General Election. She said if the City wants to impost a ban on growing, processing, sale or transfer of marijuana, that matter would need to be referred to the voters during a General Election. Under the City's current business license ordinance, we would revoke any business license issued for a marijuana facility because they do not comply with Federal regulations. Leahnette noted that she believes that the zoning for only a handful of properties within the City would permit marijuana facilities - those properties include the Columbia City Mini Mart, the vacant commercial property to the north of the Mini Mart, the Port of St. Helens industrial site, and perhaps the Pacific Athletic Club property. It was the consensus of the Council that an amendment to the City's business license ordinance be drafted that would eliminate the requirement of Federal compliance for the Council's consideration at the next meeting, and the City Planner and City Attorney be consulted to review the current development code and discuss any amendment recommendations they may have. AGENDA ITEM 7 NEW BUSINESS: 7.1 Council Bill No. 17-821; Resolution No. 17-1995-R: A Resolution authorizing application under the Special City Allotment Program. 3 - Regular City Council Meeting July 20, 2017 MOVED (MARSON), SECONDED (THISTLE) AND CARRIED UNANIMOUSLY TO ADOPT COUNCIL BILL NO. 17-821. 7.2 Council Bill No. 17-823; Resolution No. 17-1196-R: A Resolution amending the fee schedule adopted by Resolution No. 03-796-R; establishing fees for various permits, land use applications and planning reviews. MOVED (THISTLE), SECONDED (HARRISON) AND CARRIED UNANIMOUSLY TO ADOPT COUNCIL BILL NO. 17-823. 7.3 Weed abatement request: Request for weed abatement on property located at 1515 Sixth Street, Columbia City, currently under the ownership of Jesse Vanderwall. MOVED (THISTLE), SECONDED (EBERT) AND CARRIED UNANIMOUSLY TO APPROVE THE REQUEST TO ABATE PROPERTY LOCATED AT 1515 SIXTH STREET. AGENDA ITEM 8 OTHER BUSINESS: Sewer Connection Fee Lien: Staff and Council discussed an unpaid sewer connection fee lien in on the duplex/property located at 2100 and 2110 Sixth Street. The lien was originally entered into the City's lien docket in 1993, and the total principal and interest due as of June 30, 2017 is $18,367.55. Council suggested staff send a letter to the owner requesting payment in order to avoid further action by the City.
