Adjourn Columbus Public Works Department Report April 2021 The month of April for the Department of Public Works really kicked us into the mood for spring with warmer temperatures in the beginning of the month but the end of the month left us felling more like fall than spring! Chief Kluetzman ITEMS OF NOTE FOR APRIL Firefighter Alexander Secord resigned on April 19. He had been with the department for 19 months. I I informed the Police and Fire Commission of my pending retirement date of July 30, 2021. Randy Koehn Columbus Public Library April 20, 2021 DIRECTOR’S REPORT LIBRARY NEWS The Columbus Public Library no longer requires appointments to enter the building as of April 12. Patrons may still schedule a time to pick up items in the entryway and we have had a few patrons continue to utilize this service. The self-check machine has arrived to the Columbus Public Library and we are now working with the South Central Library System and Bibliotheca to get the machine set to go for patron use. PROGRAMS “Spirits of Earth: Ancient Native American Effigy Mounds in Wisconsin” is on April 22 at 6:30 pm and has a total of 130 people signed up. “The Birdman of Koshkonong” is on May 6 at 6:00 pm and a cook-along program with Huma Siddiqui on May 17 at 6:30 pm. We continue to provide an adult craft video per month and weekly videos for children and teens including story time, STEM activities, craft projects, and a board game spotlight. Our take-and- make kits for all ages continue to remain popular. Book clubs for adults continue to be held virtually. BUILDINGS The Department of Public Works has helped us to set up our outdoor furniture and have and delivered mulch for us to use. We noticed there was water leaking inside underneath the bookshelf in the front entryway. DPW took a look and adjusted the gutters to see if that would help. We still had water coming in that area so they are now going to regrade the dirt and mulch to see if that will take care of the issue. MEETING/CONTINUING EDUCATION MEETINGS Lindsey Ganz attended the All Directors meeting in March. We looked at reimbursement comparison from adjacent county libraries, received updates on the building needs assessment workgroup, and received updates on a delivery sorter. Lindsey also attended the Columbia County Library Board meeting and gave an update on the virtual project. The personnel committee met and continued their work to update job descriptions. The Library programming team continues to meet virtually on a weekly basis. We are currently planning for the Summer Library Program and for the virtual project. We have approval to bring our Words on Wheels and outdoor storytime program to Fall River and Columbus for the summer. Columbia County Directors are meeting virtually once per month to plan events for the Virtual 1 Project. The city department heads continue to meet virtually twice per month. TRAINING/ EDUCATION Lindsey presented a continuing education training for library staff in the South Central Library System and for libraries outside of our system with Melissa Roelli from the Mount Horeb Public Library. DIRECTOR GOALS UPDATE One of my director goals is to collaborate with others and to establish local relationships. I presented library updates at the city council orientation on Friday, April 16. This presentation covered information about board meetings, current hours and services, online resources, statistics, programs for all ages, summer library program, and the library annex. STRATEGIC PLAN UPDATE 1. Physical Space c. If we don’t strive for more space, how do we prioritize what we have? Deb Haeffner, design consultant for the South Central Library System and Columbus Library board member, met with staff to look at the current layout of the upstairs library and give suggestions for addressing space needs for collections and patrons. Deb created an updated layout to present to the Library Board for consideration. Ludington St. Columbus, WI. 53925 920-623-5919 (Main) 920-623-5930 (Fax) PERSONNEL: I will be issuing Officer Kelly Towne a department Lifesaving Award for her efforts in early March. Officer Towne was dispatched to a location with EMS for a person who had collapsed. CPR was started by co-workers as Officer Towne arrived and continued until arrival at the hospital. The patient was transported to a Madison hospital and was released several weeks later. She is home and doing well. A true team effort between Lifestar EMS, co-workers and Officer Towne that resulted in the saving of a life. The employer has also recommended to the Red Cross a similar award for those involved. Resignation: On April 13 Sergeant Creighton submitted his resignation. He is getting out of law enforcement. After the updated job description is approved, I will be posting the position. Officer vacancy: There were 2 remaining candidates on our police office eligibility list. Both spent time riding along with officers to acquaint themselves with our operation and to interact with staff. I subsequently contacted one on the list to offer him a job. He declined as he was offered a job by another department. I contacted the 3rd applicant and will be deciding very soon how I am proceeding. If I don't hire him I will be re-posting the position. Lieutenant vacancy: I have offered the vacant Lieutenant position to Bradley Konkel of Beaver Dam. He accepted the position and has successfully completed all the required testing. Bradley has been a police officer in Beaver Dam for 7 1/2 years and brings a great deal of experience and training with him. He will begin in June. TRAINING: All officers attended 4 hours firearms training at the range in Juneau. TRAFFIC ENFORCEMENT: During April 2021, officers issued 74 traffic citations, 24 municipal ordinance citations and 68 warnings. The speed trailer has been deployed with the warmer weather. Anyone with location requests for it should contact the department directly with the request. MISCELLANEOUS INCIDENTS: This has been a very busy month for us. While our call volume hasn't going up substantially, the depth of some of the calls require a substantial amount of investigation and officer time. Being down 3 people is also impacting our operation, resulting in extended shifts, call ins and more overtime being paid. I am also assisting more than usual with calls, covering patrol during transports or when the officers are busy on other incidents. We had 15 calls of 911 disconnects. That is when a call is received at the 911 center in Portage and nothing is heard or said. These are frequently bumped emergency buttons on phones or smart watches. By policy we respond and investigate all 911 disconnects, even if the dispatcher reaches them on a callback and says everything is fine. We have had incidents where a 911 disconnect is a medical emergency or a criminal act in progress, such as a domestic incident. During the month we also had 2 mental health commitments. These calls can average 6-9 hours of officer time from time of call to completion. We have investigate, contact mental health for an assessment they do of the patient, either on the phone or face to face, have a medical clearance done, and then a determination if we will transport them and to where. www.cityofcolumbuswi.com Dennis R. Ludington St. Columbus, WI. 53925 920-623-5919 (Main) 920-623-5930 (Fax) Winnebago Mental Health in Oshkosh, which is the closest secure mental health facility for us and the one most commonly used by Columbia County. Transport time each way is over an hour. These types of calls go hand in hand for our elevated Check Welfare calls (16) this month. Often a check welfare call is a mental health related call that do not meet the criteria for a commitment, but still involve considerable time. We also responded to 7 domestic abuse incidents during the month of April 2021. While that isn't a record, it is notably higher than the previous 6 months. Officers arrested 7 people for Operating While Intoxicated/Operating with Restricted Controlled substance in their blood during the month. Of these 6 arrests, there were 3--first offenses, 3-- second offenses, and 1 was a fourth offense. Two Frauds were reported during the month. One involved a fraudulent unemployment claim being filed in a resident's name. The other involved a business who was defrauded of approximately $6,000 through a check scam. Officers responding to a complaint found 1 adult and 6 juveniles in a vacant building that is currently being used to store high end and expensive electronics. It was discovered the subjects had used golf clubs found within the building to do $15,600 worth of damage to the electronics. The adult was subsequently arrested and jailed on felony and misdemeanor charges. The others, due to their ages, are being referred to the Columbia County Juvenile Court for identical charges through the juvenile court system. April 21, 2020 at the Regular meeting, a motion was made by Reid, second by Gray to approve the donation. Enclosed for your review, you will find the COW agenda and the Regular meeting minutes from 2020. Installation was delayed in 2020 due to COVID. The project will be complete late summer of 2021. DPW will play a small role in helping with installation through prepping the site by removing grass and soil to level the area. Enerpac is working with Lee Recreation to drill holes and to install the play structures themselves. Once installation of the structures are complete, DPW will place pea gravel and mulch in the play area (purchased by Enerpac). We are excited for this new addition to our community and are thankful to Enerpac for their generous donation. Mo�n to adjourn to closed session pursuant to 19.85 (1) (e) deliberating or negotiating the purchase of public properties, the investment of public funds, or conducting other public business, whenever competitive or bargaining reasons require a closed session, specifically to discuss potential developments in the City of Columbus Adjourn 2021 AGENDA ITEM Committee of the Whole Meeting date: ____May 18, 2021_______ Council Meeting date: _June 8, 2021______ ITEM:_ Highway 89 Encroachment Agreement_ DETAILED DESCRIPTION OF SUBJECT MATTER: With the upcoming State Highway 89 project, the Department of Transportation has conducted a survey of the project/parcel boundaries and identified several easements that were required for the project. During this survey process, the Department of Transportation identified a building on parcel 11-211-1046.02, located at 130 Farnham Street, which was encroaching into the right of way by several inches. The Department of Transportation does not need the area this building occupies to complete the project, but they would like to see the building’s presence formalized through an encroachment agreement or right of way permit. The State presented their standard agreement to the property owner, but the property owner refused to sign. After negotiations between the property owner’s Attorney and the City Attorney, the property owner has indicated they are willing to sign the attached encroachment agreement. The primary change was removing language obligating the building owner to pay costs related to removing the building from the right of way or costs to repair or restore the right of way if the building was destroyed. The Plan Commission has oversaw plan development and have reviewed draft chapters of the comprehensive plan. Staff updated the city website with the draft chapters after the plan commission had reviewed and commented on the chapter. After the city submitted the grant application the DNR contacted staff to inform the city that they RTP program is not funding acquisition projects this year. However, they encouraged staff to update the application and submit the project to Stewardship Grant or Land and Water Conservation Grant. The DNR is willing the give an extension for the grant submittal to allow the city the time to update the Outdoor Recreation Plan for the City. Staff has a word version of the previous outdoor recreation plan that was completed by the city. The outdoor recreation plan would take 60 to 90 days to update. The flowering baskets will be installed by Columbus DPW and/or Columbus Water and Light Staff at the end of May or Beginning of June. Last year both DPW and Water and Light helped with the installation. This year we expect the installation to go much quicker because we will not have to install the banners or the brackets for the flowering baskets. Kevin White from Contree Sprayer and Equipment has generously borrowed a sprayer for staff to use for the season. Staff has talked with the DPW director and he indicated they would have time to handle the watering for the season. How the project sponsor is capable of completing the proposed project? GENERAL Contractor shall provide pricing to include all necessary equipment and labor to remove ash trees, stump grinding and stump hole filling, primarily on City streets or City-owned property including City park lands and Hillside Cemetery. ASH TREE REMOVAL SCHEDULE Trees scheduled for removal can be found in Exhibit B, please include prices in column G. COMPLETION OF WORK The contractor shall commence work on a Tree Work Order within 15 calendar days after issuance and complete same within 30 calendar days thereafter. Failure by the Contractor to do so may result in forfeiture of this contract. STUMP REMOVAL Stump removal is defined for the purpose of these specifications as the grinding of stumps and surface roots, to no less than 6 inches below ground level, removal of grindings, filling of stump hole with topsoil free of lumps and clods, seeding said topsoil, and fine raking. a. Measurement: Stump removal payment shall be based on diameter measured 3 inches above ground when stump removal only is issued as part of a Tree Work Order. In all other cases where stumps are removed as part of a complete tree removal, the cost of stump is included in the bid price for removal of the combined tree and stump. b. Topsoil: The topsoil shall be placed free of lumps and clods as so to provide a reasonably level surface. c. Seed: The Contractor shall utilize a grass seed mixture approved by the Public Works Director. Seed shall be evenly distributed and hand raked lightly into the topsoil. d. Fine Raking: The Contractor shall fine rake the filled seeded area so as to result in a smooth level surface. e. Mulch: The Contractor shall mulch seeded area. f. Timing: Stump hole filling shall be completely performed by the Contractor, as specified here, within 24 hours following stump grinding. DISPOSAL OF TREE CUTTINGS, TRIMMINGS, AND CHIPPINGS When a tree is removed under this contract and is located in the street border, the burnable wood from said tree can be given to the adjacent property owner, excluding brush, only if the owner requests the same. The Contractor shall place the wood on private land and shall not dispose of said burnable wood at another location. The property owner may thereafter dispose of said wood at his/her option. Should the adjacent private property owner not want the wood, the Contractor shall dispose of all cuttings, trimmings, and chippings also to include grindings from stumps. No payment beyond the unit price bid shall be paid the Contractor by the City for disposal of tree cuttings/ trimmings/ chippings. INSURANCE The successful bidder must submit a certificate of insurance showing $1,000,000 General Liability Insurance, proof of auto insurance and Workman’s Compensation and listing the City of Columbus as additional insured. SAFETY The Contractor shall obey all Federal and State laws. The Contractor shall employ proper signage, barricades, and safety practices under this contract, to assure the safety of his/her employees, the public and private or public property. Safety facilities may be dictated by the Public Works Director, and, if so dictated, the Contractor shall immediately comply with same. DAMAGES Any physical damages incurred by the Contractor to private or public property shall be corrected by the Contractor in a manner and within a time period dictated by the Public Works Director. Failure by the Contractor to make such corrections, such as to private sidewalks, etc., may result in the City causing said corrections to be made and deducting the cost for same from payments due the contractor for work performed. A 20% penalty charge shall be added as compensation to the City of overhead costs incurred in causing said corrections to be made. PAYMENT The contractor shall be paid based on the unit prices bid. Contractor required to submit an itemized invoice in the amount equal to the pertinent Tree Work Order or as may be otherwise issued by the City. Tree Removal Orders shall be prepared based on tree’s measured diameter at breast height (DBH). Payment will be made twice per month following Council approval. DISCLAIMER The City reserves the right to accept or reject any bid and to waive irregularities in the bidding process. SUBLETTING The contractor shall not sublet any portion of the work under this contract unless written approval is first received from the Public Works Director. Should the Contractor, in submitting his/her bid, propose to sublet any portion of the work, then said bidder shall so this state on the Proposal form who said subcontractor will be and for what item of work he/she will be utilized. The City will not recognize said Contractor, as the contract will be between the City and the bidding Contractor. Violations of contract requirements, by any subcontractor, shall be deemed violations as if performed by the bidding contractor. RECITALS 1. City desires to contract for the removal of ash trees from city streets, parks, and the Hillside Cemetery for the City of Columbus. 2. Contractor desires to provide said services on the terms and conditions set forth herein. 3. City enters into this agreement pursuant to motion of the Common Council adopted on June 1, 2021. AGREEMENT NOW, THEREFORE, for good and valuable consideration, the receipt of which is hereby acknowledged, City and Contractor agree as follows: 1. TERM: The term of this agreement begins on date of signing and terminates on October 31, 2021, unless sooner terminated as set forth below. 2. SERVICES: Contractor shall provide all services as specified in the Bid Specifications for 2021, including the following: a. Stump removal to include the grinding of stumps and surface roots to no less than six (6) inches below ground level, removal of grindings, filling of stump hole with topsoil free of lumps and clods, seeding said topsoil, and fine raking. b. Tree and stump removal in city parks, streets, and Hillside Cemetery as provide Exhibit B attached hereto not to exceed $40,000. c. The Contractor shall dispose of all cuttings, trimmings, and chippings. Burnable wood can be given to the adjacent property owner, excluding brush, only if the owner requests the same. d. Contractor shall commence work on a Tree Order within fifteen (15) calendar days after issuance and complete same within thirty (30) calendar days thereafter. e. On-call emergency services to be provided within three (3) hour of receiving phone call. 3. INDEPENDENT CONTRACTOR STATUS: Contractor acknowledges that it is not an agent or employee of the City and is responsible for all costs and taxes related to the provision of services under this agreement, including without limitation, furnishing all required labor, tools and equipment to perform said services. 4. COMPENSATION: After each service performed, Contractor shall provide to the Department head requesting the service an invoice. City shall pay contractor based on rates set forth on Exhibit B attached hereto. Payment shall be made within 45 days of receipt of invoice. 5. PROOF OF INSURANCE: Contractor shall provide to City a certificate of insurance of all required insurance coverage and naming the City of Columbus as additional or co-insured for services for performed. 6. TERMINATION PRIOR TO END OF TERM: Notwithstanding what is provided in Sec. 1 above, either party may terminate this agreement without cause upon delivery of 30 days written notice to the other. Alternatively, either party may terminate the agreement effective October 31, 2021 by delivering written notice to the other at least 90 days prior to the effective date. 7. HOLD HARMLESS AND INDEMNIFICATION: Contractor shall hold harmless and indemnify City against all claims for personal injury or property damage arising out of Contractor’s performance of this contract if any such injury or damage is caused by the negligence of Contractor, its agents or employees. 8.
