Pres 19-38 Application for New Fermented Malt Beverage License for U Save Mart Inc dba U Save Mart, located at 6590 Monaco St Appearing: Kevin Coates #25995, on behalf of the applicant Nirmala Rani, on behalf of the applicant Mr. Nayyar, on behalf of the applicant Nathan Berger, on behalf of opposer Teferi Berhane, on behalf of opposer, owner of Monaco Plaza Liquors Jose Reta, resident, 5445 Monaco St Eva Garretson, petition circulator Mr. Kumar, on behalf of the applicant Happy Rani, on behalf of the applicant Mark Terry, on behalf of the opposer, neighborhood resident Michelle Gonzalez, on behalf of the opposer Hilda Ochoa, a resident within the boundary, testified to the needs of the neighborhood for the license. Michelle Montour, a resident within the boundary, testified to the neighborhood needs for the license. Attorney Berger questioned Montour about her employment. Cruz Flores, a resident within the boundary, testified to the needs of the neighborhood for the license. Attorney Berger questioned Flores about his purchasing of alcohol. Attorney Coates questioned Flores about his purchasing of alcohol. Joe Jaramillo, a resident within the boudary, testified to the needs of the neighborhood for the license and the character of the applicant Attorney Berger questioned Jaramillo about his purchasing of alcohol. Attorney Berger questioned Gonzalez about her purchasing of alcohol and familiarity with the neighborhood. Garretson shared petition procedure and results reflecting the needs and desires of the neighborhood for the license. She also shared training procedures for this license type. Attorney Berger questioned Garretson about her liquor knowledge and training procedure. Attorney Coates questioned Garretson about the opposers signature on the petition. Attorney Berger asked Garretson about distribution methods Mr Kumar testified to his relationship with the applicant and former ownership of the business. Attorney Berger asked Kumar about his former ownership of and intent with the business. Happy Rani testified to her relationship with the applicant, plan to sell alcohol and the extent to which she helped prepare documents. Nirmala Rani testified to her business plan to sell alcohol and her role. Attorney Berger asked Nirmala about her role in the business operations. Nishan Nayyar testified to his management role in the business, background, and experience, store selection, operation procedure, storage and sale of alcohol, etc. Attorney Berger questioned Nayyar about his management role ad experience Hearing Officer Ablao quesitoned Nayyar about his general liquor code knowledge. Mark Terry testified his position at Monaco Liquors and his opposition to the issuance of the license. Hearing Officer chose to admit the opposing signatures into the record. Michelle Gonzalez testified to her position at Monaco Liquors and her role in recording signatures on the opposition petition. Teferi Berhane testified to his opposition of the issuance of the license. Garretson confirmed the amount of signatures obtained on the opposition petition within the boundary. Attorney Berger questioned Garretson about FMB laws and statute. Attorney Coates made closing statements. Attorney Berger made closing statements.
