Call To Order/Roll Call Hearing Officer Ablao called the meeting to order at 1:00 p.m. 2. Consent Agenda Hearing Officer Ablao approved the consent agenda as presented. Min 17-26 Minutes of the Marijuana Licensing Meeting of December 2, 2016 Min 17-27 Minutes of the Marijuana Licensing Authority Meeting of January 20, 2017 3. Public Hearings Pres 17-306 Renewal Hearing for the Retail Products Manufacturer License of Mile High Xtractions, LLC, located at 9690 Dallas St. Unit C, Henderson, CO 80640 Hearing Officer Ablao vacated the renewal hearing for Mile High Extractions because all conditions of renewal have been met prior to today's hearing. Pres 17-307 Renewal Hearing for the Retail Cultivation and Retail Marijuana Products Manufacturer Licenses of Maclone Operations, LLC, 9690 Dallas St. Unit 2 Hearing Officer Ablao opened the public hearing. Entering their appearance: Kelly Rosenberg, #35685, on behalf of the applicant. Kevin Vlack, on behalf of the applicant. Christopher Stefan, on behalf of the applicant Senior Assistant City Attorney Rachel Allen, on behalf of the city. Attorney Rosenberg stated that the applicants have not met the conditions of licensure because buildout of the premises has gone slower than expected. The matter should be resolved rather quickly. The buildout delay is not the result of the applicant making modifications to the premises. Mr. Vlack stated that mechanical, roughing and final inspections are all that remain; Commerce City Page 1 Marijuana Licensing Authority Meeting Minutes - Final July 7, 2017 however, the inspections have not been scheduled. Mr. Vlack felt they could meet the conditions for licensure within the next 60 days. Hearing Officer Albao continued the matter to September 8, 2017, at 1:00 pm. If the conditions for licensure are met prior to that date this hearing will be vacated and the licensing secretary may admisitratively issue the license. Pres 17-303 Retail Marijuana Store License Application for C3D, CO, to be located at 5846 Dahlia St Hearing Officer Ablao opened the public hearing. Entering their appearance: Attorney Nadav Aschner, on behalf of the applicant David Soucie, on behalf of the applicant Max Scott, Oedipus, Inc, on behalf of the petition company Vince Oliver, on behalf of the applicant Nick Sutcliffe, on behalf of the general contractor and party of interest as a neighboring business Attorney Nadav stated that a petition has been submitted and demonstrates the neighborhood desires for the issuance of this license. He provided David Soucie's work that includes involvement in the marijuana industry for three years. The applicant does not have any violation history with prior marijuana businesses. David Soucie was sworn in and testified to the proposed business operation. The building is not completed; however, he anticipates construction to be completed within the next five months. He hopes to have the building permit issued within the next two weeks. The applicant submitted a copy of the site layout that the hearing officer marked as Applicant Exhibit 1. In response to questions from the hearing officer, Mr. Soucie explained the distraint warrants not disclosed on his background investigation application. He submitted copies of the satisfaction documents that the hearing officer marked as Applicant Exhibit 2 and 3. Max Scott was sworn in and testified to the petition survey process and results. The findings were 66% in favor of issuing the license. In response to questions from Attorney Allen, Mr. Soucie stated that his experience in the marijuana industry is in wholesale and not retail. Vince Oliver was sworn in and testified that he will be the general manager and has three years experience in the retail sales of marijuana. He will be responsible for the day-to-day operations. Mr. Oliver's resume was entered into evidence as Applicant Exhibit 4. Mr. Sutcliffe was sworn in and testified in support of the application. Commerce City Page 2 Marijuana Licensing Authority Meeting Minutes - Final July 7, 2017 Hearing Officer Ablao stated that two letters of support were submitted to the licensing secretary and that only one would be considered as a party of interest. There was no further testimony and the public hearing was closed. Hearing Officer Ablao made the following findings: 1. Proper notice of the hearing had been given. 2. The evidence presented at the hearing, together with submissions in the secretary's official file regarding the application, do support that the statutory and ordinance requirements have been met. 3. The petitions results, letter and testimony given, do support issuance of the license. 4. The number and type of licenses in the neighborhood do no preclude the issuance of this license. 5. The explanations given for the oversight in disclosures on the background investigation applications, were in fact an oversight. A few non-disclosures were for incidents over 10 years old and not related to the marijuana industry or felonies. The applicant is qualified to conduct the type of business proposed The license is granted with the following conditions: 1. Satisfactory inspection by building and fire within seven months. 2. Satisfactory inspection by the police department with 30 days of receiving a Certificate of Occupancy to determine compliance with the diagram submitted with the application. 3. Compliance with state marijuana code, rules, regulations and all municipal ordinances governing the operation of marijuana businesses. 4. New Business None. 5.
