Call To Order/Roll Call Hearing Officer Ablao called the meeting to order at 1:00 p.m. 2. Approval of Minutes Min 18-14 Meeting Minutes of January 19, 2018 Hearing Officer Ablao approved the minutes of January 19, 2018. 3. Public Hearings Pres 18-129 Retail Marijuana Cultivation License and Retail Marijuana Products Manufacturer License Applications of Ty Webb Enterprises, LLC, located at 9792 Hanover Ct., Henderson, CO 80640 Hearing Officer Ablao opened the public hearing. Appearances Entered: Jannifer Douglas,Registration #39032, applicant's attorney Eva Garretson, LiquorPros Mark Prescott, applicant Senior Assistant City Attorney Rachel Allen Eva Garretson was sworn in and testified to the process and results of the neighborhood survey. Mark Prescott, applicant, was sworn in and testified that the site will be developed as an urban greenhouse for marijuana. He stated that his team comes from an agricultural and business background and they are six months out on construction. He will be hiring experienced employees. In response to questions from the Authority, Mr. Prescott testified to the use of a mist fog system to mitigate odor. The following parties in Interest were sworn in and spoke in opposition to the issuance of the license: Scott White, Denver Machine Shop Owner Jim White, owns neighboring property Eric White, Denver Machine Shop Owner The public hearing was closed. Commerce City Page 1 Marijuana Licensing Authority Meeting Minutes - Final March 16, 2018 Hearing Officer Ablao made the following findings, based on the application, submissions from the applicant together with the testimony at the hearing: (1) though there was testimony presented at the hearing from a neighboring business owner, employee and property owner, the petition results do show the majority of adult inhabitants that signed the petition are in favor of the issuance of the license, (2) the number and type of licenses in the neighborhood do not preclude the issuance of this license, (3) all statutory and ordinance requirements have been met, and (4) the applicant is, at this time, qualified to conduct the type of license proposed. The application is approved with the following conditions: (1) satisfactory inspection by building and fire departments to determine compliance with their respective codes, (2) obtain Certificate of Occupancy within 180 days, (3) satisfactory inspection by the police department within 180 days to determine compliance with the diagram as submitted with the as-built premises, (4) comply with all marijuana codes and regulations. 4.
