COOKEVILLE PLANNING COMMISSION MINUTES AUGUST 27, 2018 The Cookeville Planning Commission met on Monday, August 27, 2018 at 5:30 p.m., in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. MEMBERS PRESENT: Jim Stafne, Judy Jennings, Chris Wakefield, David Webb, Kay Starkweather, Leslie Sullins Draper, Tracy Cody, and Jim Cobb. STAFF MEMBERS PRESENT: James Mills, Jayne Barns, Ken Young, Jon Ward and Mike Davidson. OTHERS PRESENT: Susan Vandergriff, Adam Vandergriff, Barry Helm, Randy Chaffin and Ben Wheeler. WELCOME NEW MEMBER – ERIC WALKER CONSIDER FOR APPROVAL THE AGENDA AS SUBMITTED. Kay Starkweather made the motion to approve the agenda as submitted. Chris Wakefield seconded the motion and the motion carried unanimously. APPROVED. CONSIDER FOR APPROVAL THE MINUTES OF JULY 23, 2018. Leslie Sullins Draper made the motion to approve the minutes of July 23, 2018. Kay Starkweather seconded the motion and the motion carried unanimously. APPROVED. CONSIDER FOR ACTION REQUEST FOR CLOSURE AND ABANDONMENT OF A PORTION OF THE ALLEY LOCATED ON THE NORTHEAST CORNER OF WEST 4TH STREET AND NORTH WILLOW AVENUE AND ADJACENT TO NORTH WHITNEY AVENUE. REQUEST SUBMITTED BY RANDY CHAFFIN OF GREENVILLE PROPERTIES, LLC. James Mills stated that Mr. Randy Chaffin on behalf of Greenville Properties, LLC has submitted a request that a southern portion of an alley located north of West 4th Street be closed and abandoned. Specifically the request is for the closure and abandonment of approximately 100 feet of the southern portion of the alley located north of West 4th Street. The alley is approximately 20 feet in width. In 2003 the City of Cookeville approved closing and abandoning 100 feet of the alley from West 4th Street north to where Mr. Chaffin is now requesting closure and abandonment. Greenville Properties and Mr. Chaffin own the four (4) parcels contiguous with the portion of the alley proposed for closure and abandonment. Parcel 43.00 on Tax Map 53B, Group B located on North Willow Avenue and owned by Randy Chaffin and Parcel 44.00 on said map and group located on North Willow Avenue and owned by Greenville Properties are contiguous on the western boundary of the alley. Parcel 24.00 of said group and map located at the corner of West 4th Street and North Whitney Avenue and owned by Greenville Properties and Parcel 25.00 on said group and map located on Whitney Avenue and owned by Greenville Properties are contiguous on the eastern boundary of the alley. COOKEVILLE PLANNING COMMISSION 2 AUGUST 27, 2018 The applicable city departments have reviewed the closure and abandonment request. A sewer line is located within the alley right-of-way and the Water Quality Control Department requests that a utility easement be provided for the entire width and length of the proposed closure. Staff recommended approval of closure and abandonment with the land conveyed to the adjoining property owner upon compliance with the requirements of the Municipal Code and subject to the provision of a utility easement for the entire width and length of the closed alley right-of-way. Leslie Sullins Draper asked if there were any drainage facilities in the right-of way. James Mills replied that he notified Greg Brown of the Public Works Department and that Mr. Brown said that there was not any in this area. Leslie Sullins Draper made the motion to approve the closure and abandonment with the land conveyed to the adjoining property owner upon compliance with the requirements of the Municipal Code and subject to the provision of a utility easement for the entire width and length of the closed alley right-of-way. Jim Cobb seconded the motion and the motion carried unanimously. CONDITIONAL APPROVAL. CONSIDER FOR ACTION EXTENSION OF FINANCIAL GUARANTEES FOR SIDEWALKS, RAIN GARDENS, AND WATER & SEWER FOR ONE (1) YEAR FOR THE RESERVE AT THE COUNTRY CLUB PHASE I. REQUEST SUBMITTED BY TOM SERGIO. Ken Young stated that Mr. Tom Sergio, on behalf of Design Development LLC, has submitted a request for a one (1) year extension of the three (3) Letters of Credit submitted initially in September 2008 to financially guarantee the infrastructure improvements at The Reserve at the Country Club Phase I. The development was first financially guaranteed in September 2008 and in September 2009, the Planning Commission granted a two (2) year extension of the guarantees. In August 2011 the Planning Commission approved the extension of the guarantees in the reduced amounts as approved by the appropriate departments for a period of one (1) year. In August 2012 the Planning Commission approved another one (1) year extension as per the amounts approved in 2011. In August of 2013 the Planning Commission approved Mr. Sergio’s requested renewal of the letters of credit and approval of granting an additional five (5) years to complete the sidewalks. In August of 2014 the Planning Commission approved Mr. Sergio’s request for a one (1) year renewal of the guarantees. In August of 2015 the Planning Commission approved his request for a one (1) year extension and a reduction in the amount for sidewalk construction. In August 2016 the Planning Commission approved his request for a one (1) year extension and a further reduction in the amount for sidewalk construction. In August 2017 the Planning Commission approved his request for another one (1) year extension of the guarantees with reductions in the amount required for sidewalks, drainage facilities and water and sewer. Approximately 68% of the lots in the subdivision have been developed to date. The Letters of Credit submitted on August 31, 2017 are all drawn on Citizens Bank. A $30,700.00 Letter of Credit was submitted for the remaining sidewalk construction and a COOKEVILLE PLANNING COMMISSION 3 AUGUST 27, 2018 $46,250 Letter of Credit was submitted for the remaining drainage facilities, including the rain gardens. Lastly, a Letter of Credit in the amount of $3,700 was submitted for the maintenance of water and sewer improvements. Planning staff has been advised by the Water Quality Control that the amount for the maintenance of water and sewer improvements will remain as $3,700 for one (1) year. Public Works Director, Greg Brown, has advised that the amount of the guarantee for the drainage improvements can be reduced to $40,000 for one (1) year. He further advised that the amount for the sidewalks can be reduced to $26,560 for one (1) year. Staff recommended conditional approval of the request for one (1) year extension of the financial guarantees, subject to the submission of Letters of Credit in the amount of $26,560 for sidewalks, $40,000 for drainage facilities and $3,700 for water and sewer infrastructure. All extended financial guarantees shall be submitted to Planning Staff no later than Noon on Wednesday August 29th. Kay Starkweather made the motion to grant conditional approval of the extension of Financial Guarantees for sidewalks, rain gardens, and water & sewer for one (1) year for the Reserve at the Country Club Phase I.
