SPECIAL MEETING OF THE TOWN BOARD 6/19/2023 Attendance: Angie Volkman (Town of Dane Clerk), Jana Nolden (Town of Dane Treasurer), Paul Johnson (Attorney with Broadman & Clark), Pat Cadigan (Tri County Paving), Terry Wenger (Tri County Paving), Dustin Gradel (Tri County Paving), Mary Jane Clemens (Lee Rd), Nancy & Paul Roth (Bonetti Rd), Kevin & Barb Taylor (Bonetti), Jaff Galle (Viaduct Rd), Debra Dolphin (Viaduct Rd), Tim & Nicolle Herbsleb (Viaduct Rd), Earl Dohm (Dunroven Rd), Tom Grundel (W Main St), Chris & Connie Statz (Martinsville Rd), Vince & Kim Niesen (Clemens Rd), Mark Niesen (Clemens Rd), Kuly & Jamie Pierce (Bonetti Rd), Paul & Diane Karls (Bensen Rd) and Jon Wilson (Cty Hwy DM). 1. Call meeting to order. Meeting was called to order by Town of Dane Chair Dave Koenig at 6:30pm. 2. Proof of posting. Meeting was properly posted Friday 6/16/2023 at the Town of Dane, Town of Dane Website (www.townofdane.gov), Post Office and Dane Lumber. 3. Roll call. Dave Koenig (Chair), George Dorn (Supervisor), and Rich Haag (Supervisor II). 4. Addition or Corrections/Approval of Agenda. No Additions or Corrections made to the agenda. 5. Old Business. (The following items will be discussed and may have action taken on them.) 1. Joe Ripp Quarry. No Public Input. Paul Johnson spoke to the board and let them know that he was present to answer any question they may have regarding the CUP. Tri County filed a CUP permit in Dec and filed an amended CUP to address the Towns concerns. 4/10/2023 the Town of Dane held its Public Hearing and some of the town residences are opposed to the Quarry and some residences are in favor of the Quarry. He let us know the Town has 2 choices – approval or denial. The Town needs to make a recommendation to Dane County but at the end of day, the County enforces, and the Town doesn’t have the final say. The law changed back in 2017 of which made it harder to deny CUPs, as long as the applicant meets and agrees to all the terms in the CUP, it will be granted. Paul Johnson did express his concerns and did recommend an Erosion Control Plan (Ch. 14 of the Dane Cty Code) and a Non-Metallic Reclamation Plan (Ch. 74 Dane Cty Code) to be done and given to the Town of Dane by 7/17/2023. Paul also recommended that Tri County sign a developers Agreement of which they agree to pay all fees associated with the CUP. Motion by Dave, second by George to have Tri County sign an agreement to pay for fees incurred for the CUP – Quarry. Motion carried unanimously. Paul read through all 8 Standards for Conditional Use Permits. Paul recommends that we meet again and go through each of the 8 standards and make sure all the 8 conditions of the standards are met. It is impossible to decide without going through the “list”. Paul will attend that meeting and put it all into writing for the Town of Dane. 7/24/2023 at 6:30pn, Town of Dane will hold its next meeting to discuss the 8 standards for a CUP. 6. New Business. (The following items will be discussed and may have action taken on them.) 1. Discussion on moving July 3rd meeting to July 10th. Motion by Rich, second by George to move the regular Town of Dane board meeting from 7/3/23 to 7/10/2023. Motion carried unanimously. 7. Adjourn.
