Ms. Hanauer noted that several record plans will be heard in the coming months from GDPM/DMHA as they are updating their deed restrictions to meet the requirements of a new funding source from HUD. This is a record plan to consolidate two (2) City lots into one (1) City lot at 40 and 42 E. Helena St. The lot meets the minimum requirements of the MR-5 Mature Single-family Residential zoning district. There are two existing multi-family buildings that will remain. Public Comments None. Board Discussion Mr. Sauer asked if having two buildings on the property is out of line with the City’s Zoning Code that says there may only be one primary structure per lot. Ms. Hanauer responded that the lot would be compliant with the Zoning Code, and Mr. Kroeger added that it would essentially become an apartment complex. Board Action A motion was made by Ms. Schenking, seconded by Mr. Allen, and carried to approve Case PLN2024- 00154 subject to the following conditions: 1. Marsh Priority Land Use Board: North Central Planning District: Riverdale Decision: Approved with conditions Staff Comments Jen Hanauer presented the case. This is a record plan to reconfigure three (3) City lots into three (3) City lots at 19 Five Oaks Ave. Per the request, the two existing single-family dwellings would remain, the vacant middle lot would be split and become side yard for the single-family dwellings, and the rear of the three existing parcels would become one parcel, the future use of which would be off-street vehicular parking for the existing building at 620 Geyer St. The existing four-story building at 620 Geyer St. is currently vacant and is planned to be repurposed as a multi-family dwelling. A condition of approval would need to be a variance for rear yard setback for the two single-family homes as the MR-5 zoning district requires a 30-foot rear yard setback, and the proposed lot reconfiguration would only provide for an 8-foot rear yard setback. Public Comments None. Board Discussion Ms. Pegues asked for clarification on which building would be served by the proposed parking area. Ms. Hanauer replied that the parking would be for the four-story building to the north, northwest of the existing single-family dwellings. Board Action A motion was made by Ms. Schenking, seconded by Ms. Miller, and carried to approve Case PLN2024- 00158 subject to the following conditions: 1. Revise the Record Plan and any Construction Drawings per the City of Dayton Subdivision Regulations and comments from the Division of Civil Engineering. 2. As the approval of this record plan would create two non-conforming lots in that the two residential properties would no longer have the minimum required setback of 30 feet, a variance shall be granted to allow for a rear setback as proposed. A final subdivision record plan to split one (1) City lots into forty (40) City lots 188 feet west of the intersection at the corner of Ring Neck Dr and Pheasant Ridge Rd. The proposal would create 38 single-family homes. The subject property is located in the SR-2 Suburban Single-Family zoning district. Mr. Green noted the proposal meets the minimum zoning requirements for the SR-2 Zoning District/PD-42 and is requesting no variances. He further stated the conditions outlined in Plan Board’s May 14, 2024 preliminary record plan meeting were met. Public Comments None. Board Discussion None. PLN2024-00150 – A work session for Plan Board to review and provide input regarding a proposed public safety facility (police) at the southeast corner of W. Third St. and Abbey Ave. in a Mixed-Use (MX) zoning district with a Planned Development (PD-180) overlay. Public safety facilities are a permitted use in the MX and PD-180 districts but will require Final Plan approval from the Plan Board. Applicant: App Architecture c/o Rick Willis Priority Land Use Board: West Planning District: Arlington Heights Decision: No decision (work session only) Staff Comments Tony Kroeger presented the case information, which is a work session seeking City Plan Board input on a prospective Final Plan submittal for a new police facility at the southeast corner of West Third Street and Abbey Avenue. The zoning for the property is Mixed Used (MX) with a Planned Development (PD-180) overlay. Both the PD and the MX district allow public safety facilities. However, there are also many design considerations included with both. Therefore, this work session seeks Plan Board input on the proposed building and site plans. After the work session, the plans will be brought back to the Plan Board for decision. Prior to that meeting, it will also go to West Land Use Board. Mr. Kroeger presented information regarding the proposed development. The southeast corner of West Third Street and Abbey Avenue has been selected by the City of Dayton for a new West Police Facility. This site was chosen because it is centrally located to the West patrol geography, is at the nexus of several large neighborhoods, and can be part of a larger redevelopment effort. The plan was presented at public meetings on May 15, 2024, and May 16, 2024. It will be an approximately 10,000 sq. ft. one-story building, housing the West patrol operations, including command and officers. There are approximately 116 parking spaces included on the site plan. This includes spaces to accommodate police cruisers, personal automobiles, and spaces for the public, as there is a public meeting room included. The primary means of vehicular access will be from Abbey Avenue. The building has been situated so that it is built near the Abbey Avenue and West Third Street rights-of- way. The parking lot is situated to the south of the building, with the primary entrance at the southwest corner of the building facing Abbey Avenue. Street trees are shown in the site plan, which would be in conformance with typical zoning code requirements. City of Dayton Page 2 City Plan Board Summary Minute Record June 11, 2024 Most of the parking lot will be surrounded by ornamental fence. The building is to contain offices, conference and training rooms, locker areas, a storm shelter, a fitness area, and a vehicle bay specialized vehicles. The target completion for the project is November 2025. While public safety facilities are a permitted use at this location, the Planned Development requirements, which were attached to the staff report, offer additional guidance. Mr. Kroeger briefly described the themes of those regulations. Mr. Kroeger presented the site plan and renderings for the proposed project. He also talked about previous planning work for the site, and engagement that has occurred. He stressed that the Board may wish to consider the appearance of the north face of the building, as well as circulation as it pertains to future development of the site. Mr. Sauer asked about the railroad rights of way that traverse the site, as well as other rights-of-way. There was discussion regarding property lines, as well as the use of the former Inland Avenue as a primary north- south corridor through the site. Major Paul Saunders spoke about the proposal. He leads the Support Services for the Dayton Police Department. He spoke about the process that led to this site being preferred for the West Police facility. Overall, this site satisfies various locational needs for Dayton police and can contribute to the redevelopment of the site. At full strength there are 95 officers, over four shifts with some overlap. Becky Gaytko of 19 Notre Dame Avenue in Dayton spoke next. She supports the proposed plan and sees it as an excellent opportunity to improve the surroundings. Rick Willis Senior Project Manager with App Architecture, 615 Woodside Drive, Englewood, Ohio spoke on behalf of the application. He described the design concept behind the facility. In October 2023, App Architecture was commissioned by the City of Dayton to plan for a new police station. He noted the aviation history of the site, and talked about why this specific location was selected. The corner offers excellent access to other areas of the west geography. He was unaware until May 2024 that there was an adopted Planned Development at this site. He noted the need to account for the presence of the Dayton Metro Library and the historic Wright Factory buildings. In terms of the design, he noted how important safety is for the design of the building. He discussed the theme of aviation for the building. He further talked about the materials for the building and the glazing. Vertical windows were purposefully incorporated. On the north elevation, he noted that the area inside of the building that is nearest West Third is the locker room area. That is why there are no windows on grade. The windows on top will allow for natural light. He shared the models for the building, and why certain design choices were made. Trees will be included, 2.4-inch caliper, 30 feet on center. He described the parking lot, including the fence, the public parking section, and the setbacks. The public meeting room is for 24 individuals. Ms. Schenking asked about the West Third Street building face. It feels less than inviting to the neighborhood. She asked what could be done to address that. Other board members agreed with that perspective. Mr. Willis understood that concern and said they would entertain concepts to “break up” the north wall. It is a work in City of Dayton Page 3 City Plan Board Summary Minute Record June 11, 2024 progress. Ms. Pegues suggested that the building should look more welcoming from West Third Street. Other suggestions were offered to make the building more welcoming, such as using creativity with the bollards, which Ms. Miller suggested. Mr. Willis noted that there is also significant signage that will be added. Mr. Kroeger suggested that maybe there is an opportunity to engage with the neighborhood. Mr. Sauer asked if this was even the best location for this building. He thought it could be a wasted opportunity. He discussed other locations that this building could be placed. Mr. Willis reiterated why this is the preferred location. He also noted that two structures along West Third that are not a part of the Planned Development, which makes this, in a sense, a challenged site. There was further discussion about the West Third Street frontage. Ms. Schenking advised that high- maintenance landscaping should probably be avoided. Mr. Willis talked about the energy efficiency requirements on the building and the inclusion of solar energy. Mr. Saunders expressed that he understood the input on the West Third Street façade, and reiterated the public process that has occurred. He noted that it was promised that they would go back to the community, where different decorative elements could be discussed. Mr. Scott explained that, typically, all parking should be further from the right-of-way than the building. Mr. Sauer expressed a desire to better understand how this building connects with the rest of the site. A contextual guide is needed to better evaluate the proposal. Mr. Scott explained that the City Plan Board is bound to adopted Ordinances and must follow all applicable laws. Additional statements during the course of the discussion included: that due to the property being a corner lot, the site plan as proposed was not compliant with the requirements for the location of the front entrance; the requirements for the landscaping of the parking lot islands were not met; and the setback of the parking lot from Abbey was not sufficient as had previously been held by Plan Board.
