CALL TO ORDER: This meeting was called to order at 6:07 p.m. 2. Approval of AHAC Report Mr. Paradise lamented that this is the latest triennial report from the City of Deltona Affordable Housing Advisory Committee and this is being prepared pursuant to Florida Statute 420.9076. There are several parameters a SHIP recipient is required to review. The AHAC through the last number of months has gone through and reviewed each one of these 11 items and has made recommendations. At this time he would like to go through the report and verify that these recommendations are what the AHAC intended. Mr. Paradise stated he does have a couple of questions on the recommendations that he would like to get clarification on and make sure all the recommendations are consistent with what the AHAC committee wanted. The next step is that this report will be advanced to the city commission for transmittal to the Florida Housing Finance Corporation. He reminded the committee that this is a state mandate and without completion of the report the State may not continue to grant entitlements to the city under the SHIP program. Before continuing Mr. Paradise wanted to thank all of the members for their hard work and service so that we may continue to administer the SHIP entitlements. At this time Mr. Paradise reminded everyone the report is not paginated and incorrect spelling or grammar will be corrected before going to the commission. With that said, he asked them to turn to section 3, incentives and recommendations. Mr. Paradise asked the committee to please ask any questions as he covers each incentive. Incentive A: The processing of approvals of development orders or permits, as defined in s. 163.3164, for affordable housing projects is expedited to greater degree than other projects. Recommendation: The Committee recommends continuing expedited permitting as it relates to affordable housing projects and to encourage appropriate building permit and inspection staffing levels to encourage greater building permit application flow. Incentive B: The modification of impact-fees requirement, including reduction or waiver of fees and alternative methods of fee payment for affordable housing. Recommendation: The Committee recommends taking no action regarding impact fees as it relates to affordable housing. Member Williams asks if the impact fees could be waived as it pertains to affordable City of Deltona Page 2 Printed on 10/26/2018 Affordable Housing Advisory Minutes October 16, 2018 Committee housing. Mr Paradise responded, that there could have been a recommendation, but the city's impact fee structure is under pinned by bond covenants and it would be very difficult to waive impact fees. Incentive C: Allowance of flexibility in densities for affordable housing. Recommendation: The Committee’s recommendation is to encourage and promote the strategic expansion of sewer through cost share proposals and other methods as deemed appropriate and to ensure a robust investment in public infrastructure including utilities, roadways, sidewalks and parks. Incentive D: The reservation of infrastructure capacity for housing for very-low- income persons, low-income persons, and moderate-income persons. Recommendation: The Committee’s recommendation is to ensure and promote cost share agreements with developers when sewer expansion or improvements are needed for developments. Mr. Paradise stated he had some questions concerning Incentive E. He wanted to verify the committee wanted to repeal the city's zoning regulations for accessory dwelling units/granny flats. Member Putkowski answered yes, because the infrastructure is not there. If a granny flat is built it would need its own septic tank and space is usually an issue. Therefore, the committee did recommend that it be repealed. Mr. Paradise stated he would elaborate these issues in the recommendation to repeal based on the fact that there is a lack of infrastructure, parking is an issue and a lack of space with the lot. Member Williams asked if this is being raised because people are coming in and requesting this type of structure? Mr. Paradise replied yes, it is on the books now as a permitted principal use in many of the residential zoning classifications. Member Williams stated, as a realtor I sometimes hear the city does not want people to have these apartments/inlaw apartments as they relate to housing, is this something different? No Mr. Paradise replied. Member Williams replied, earlier statements concerning the septic systems really should not be a problem due to the fact that most of the lots located in Deltona are 80' by 125', you could put the septic in the front or back. Mr. Paradise explained that the cost for these accessory dwelling units based on the needed upgrades to the septic systems really made them unfeasable and we have not had a lot of demand for this nor issued many permits for them and if memory serves this has been on the books since 2016. Mr. Paradise thanked the members for the questions and clarification. Incentive E: Allowance of affordable accessory residential units in residential zoning districts. Recommendation: The Committee recommended repealing the existing accessory structure provisions as illustrated in the city zoning regulations for residential units in City of Deltona Page 3 Printed on 10/26/2018 Affordable Housing Advisory Minutes October 16, 2018 Committee residential districts. Incentive F: The reduction of parking and setback requirements for affordable housing. Recommendation-Reduction in Parking: The Committee recommended to maintain Comprehensive Plan provisions that further multi-modal transportation options and continue to allow driveway expansions associated with single family dwellings. Recommendation-Setbacks: The Committee did not recommend maintaining the PUD zoning tool as a method to relax some setback requirements. Incentive G: The allowance of flexible lot configurations, including zero-lot-line configurations for affordable housing. Recommendation: The Committee did not recommend the PUD rezoning process be used to encourage flexible lot configuration. Incentive H: The modification of street requirements for affordable housing. Recommendation: The Committee recommends the City maintain the ability to reduce right-of-way width as stated in the LDC (Land Development Code). Incentive I: Establishment of a process by which a local government considers, before adoption, policies, procedures, ordinances, regulations, or plan provisions that increase the cost of housing. Recommendation: The Committee recommends the establishment of a process by which the local government considers before adoption of policies, procedures, ordinances and regulations that could increase the cost of housing. Mr. Paradise told the committee before moving on to Incentive J that a review of city owned/controlled property has been started. Incentive J: The preparation of printed inventory of locally owned public land suitable for affordable housing. Recommendation: The Committee recommends that City staff conduct a review of City owned/controlled property to determine if any such land could be used for affordable housing purposes, and that the inventory should be completed within the next twelve City of Deltona Page 4 Printed on 10/26/2018 Affordable Housing Advisory Minutes October 16, 2018 Committee months. Incentive K: The support of development near transportation hubs and major employment centers and mixed-use developments. Recommendation: The Committee recommends that the City continue to build on the Halifax Hospital project by encouraging more medical development and promote expanded transit service to the Activity Center. Mr. Paradise stated that we have reviewed all the incentives and recommendations and staff will be making any and all corrections needed before it moves forward to the commission. Tonight we are looking for a recommendation from the AHAC committee to the city commission to transmit this report to the Florida Housing Finance Corporation. Vice Chair Ulicny-Hoback asked for a motion. Member Putkowski asked for a brief discussion before the motion. He wanted to let staff know that there are a couple typographical errors. Mr. Paradise relayed to the members to please mark down any errors, he commented that the report is not yet 100 percent and it will be scrubbed. Any revisions the members have are welcomed and he will see that the corrections are made. Mr. Paradise informed the members the report will be going to the commission on the 19th of November. Mr. Paradise asked if at this time are the members ready to make a motion. Motion by Member Putkowski to approve the Ctiy of Deltona, Volusia County Florida Affordable Housing Advisory Committee 2018 Initial Review and Recommendation Report with corrections, seconed by Member Pena-Castaldi. Motion carried by the following vote. For: 6 - Vice Chair Ulicny-Hoback, Member Pena-Castaldi, Member Daniels, Member Diaz, Member Putkowski and Member Williams 8. STAFF COMMENTS: None 9. BOARD/COMMITTEE MEMBERS COMMENTS: Member Putkowski announced that the Community Life Center is hosting an Italian Dinner fund raiser in the Sanctuary at Pine Ridge Fellowship on October 27th, 5:00 p.m. to 7:00 p.m. at 1045 E. Normandy Blvd. and tickets are $20.00 per person. Vice Chair Ulicny-Hoback expressed her thanks to the staff and commented on how happy City of Deltona Page 5 Printed on 10/26/2018 Affordable Housing Advisory Minutes October 16, 2018 Committee she is for the way the meetings have been handled in such a manner that so many things have been accomplished. She asked staff if this is the last meeting the committee will be having. Mr. Paradise responded by saying we will have the committee come back some time in February to look into changing the LHAP and the Owner Occupied Home Repair Program. Member Pena-Castaldi announced that Community Legal Services of Mid Florida is having the annual free walk in legal advice clinic on the 24th of October from 3:00 p.m. to 7:00 p.m. Intakes are 1:00 p.m. to 3:00 due to the fact the walk ins will have to be income eligible/qualified. This will take place at Our Lady of Lourdes Catholic Church at 1014 N. Halifax Ave. in Daytona Beach. Member Williams asked staff if funds are still available for the SHIP Down Payment Assistance Program? Ms. Briggs responded only for the very low and low, no moderate at this time. Ms. Briggs relayed to Member Williams that as a realtor he may want to contact the local Board of Realtors to start soliciting people with the Sadowski Trust in Tallahassee next year for release of funds that have been collected and that housing has only received $135,000 this year for the SHIP program. Mr. Paradise stated it is important to keep in mind that with hurricane Michael the legislature is probably going to try to use as much as they can from the Sadowski Trust as they have in the past with hurricane Irma. Vice Chair Ulicny-Hoback asked if there is a breakdown with the results from the surveys that had been handed out and completed. Mr. Paradise responded yes and it was included in the Analysis of Impediment and was approved by the city in August or September. Ms. Briggs answered, there is a graph that we can share with the committee. Vice Chair Ulicny-Hoback stated that the committee would like to see how it turned out. Ms. Briggs also relayed to the committee that the Annual Action Plan (1 year plan) has been approved and now we are just waiting on the Con Plan portion (five year plan) for CDBG. Mr. Williams asked how much was received? Mr. Paradise replied, a half a million dollars. Member Putkowski asked if this is for this fiscal year? Ms. Briggs said yes, starting October 1. Mr. Paradise stated as a heads up that in the future the CDBG funds may not be as plentiful, with the federal government and a spike in the deficit, we need to be vigilant and aware. Member Putkowski states, every time that there is cuts it is always programs that help the people that need it the most. Member Pena-Castaldi replies, the budget is always balanced on the backs of the poor. Member Williams states on a lighter note, there is going to be a jazz festival in Deland at the Cafe Davinci, tickets are $20.00, and it will be great entertainment.
