1. CALL TO ORDER:
Mayor Masiarczyk called the City Manager's Agenda Review Meeting to order at 5:30 p.m.

3. INVOCATION AND PLEDGE TO THE FLAG:
Mayor Masiarczyk led the Pledge to the Flag.
Mayor Masiarczyk asked Commissioner Bradford if she would be presenting the
invocation, pledge and the singing of the National Anthem. Commissioner Bradford
responded that Pastor Bradley would be doing the invocation.

4. APPROVAL OF MINUTES & AGENDA:
Mayor Masiarczyk stated he had gotten an email from Mrs. Green that there was a change
to Item 4 -A. City Attorney Segal-George explained the change was that the minutes from
the Executive Session Meetings are not to be shown until the negotiations are done and the
contract is done; it is just a technicality and the City Clerk was asked to remove them from
the agenda even though they are just the opening and closing of the meetings. The only
minutes to be approved are the minutes from the Regular Commission Meeting.

5. PRESENTATIONS/AWARDS/REPORTS:
Mayor Masiarczyk stated next we have presentations and there is a recognition of Jeff
Rupp and Jeanne Irwin who rescued Sal Ferro and his puppy "Harley". He asked who’s
district Lake McGarity was in and it was determined that part of it might be in Vice Mayor
Herzberg's district. He stated Ms. Day could read it and that there should be a little blurb .
Vice Mayor Herzberg stated she could read it. Mayor Masiarczyk suggested Vice Mayor
Herzberg could read it before hand and paraphrase it.
Mayor Masiarczyk asked Commissioner Ramos if he would read the Hispanic Heritage
Month Proclamation and he asked Commissioner Honaker if he wanted to read the Fire
Prevention Week Proclamation and Commissioner Bradford if she would read the
Proclamation on the CATALYST Mentor Celebration.

6. CITY COMMISSION SPECIAL REPORTS AND REQUESTS:
Mayor Masiarczyk asked if anyone had any Special Reports. He stated he would have one
regarding his meeting with Pastor Bradley and that everyone had received copies. He
suggested if anyone had any questions or comments to bring them up with the City
Manager.
7. PUBLIC FORUM: Citizen comments are limited to issues and concerns not on the
agenda and comments on items listed on the agenda will take place after discussion
of each item. Please be courteous and respectful of the views of others. Personal
attacks on Commission members, City staff or members of the public are not
allowed, and will be ruled out of order by the Mayor.

CONSENT AGENDA: The consent agenda contains items that have been determined
to be routine and non-controversial. If anyone in the audience wishes to address a
particular item on the consent agenda, now is the opportunity for you to do so.
Additionally, if staff or members of the City Commission wish to speak on a consent
item, they have the same opportunity.
8. CONSENT AGENDA:
A. Request approval of emergency purchase orders for water/wastewater and
stormwater repairs. - Dave Denny, Public Works (386) 878-8973 and Camille
Hooper, Finance Department (386) 878-8552.
Strategic Goal: Public Safety - Provide quality high-level public safety
services to the community.
Mayor Masiarczyk stated the next item is the Consent Agenda. He stated the item is a
request for approval of emergency purchase orders for water /wastewater and stormwater
repairs which the City has to do each year.
Mayor Masiarczyk asked if anyone else had a Special Report and there were none.
9. ORDINANCES AND PUBLIC HEARINGS:
A. Public Hearing- Ordinance No. 16-2018, Revising the new Sub-Heading
Section 38-124A that provides for the Use of a Uniform Method of
Collecting Non-Ad Valorem Special Assessments levied within the
incorporated area of the City of Deltona Code of Ordinances by specifically
amending Section 38-124A (a) (1) to allow for the accumulation of
assessments for the costs incurred by the City for Nuisance abatements
over multiple fiscal years; Stating a need for such levy; Providing for
incorporation of Recitals, Codification, Severability and for an Effective
date, at first reading and to schedule second and final reading for October

Mayor Masiarczyk stated the next item is a revision to Ordinance 16-2018 regarding the
uniform collection of non-ad valorem special assessments and he suggested the City
Attorney could explain it.

A. Business Retention & Expansion Incentives: Family Health Source. Jerry
Mayes, Economic Development Manager, (386) 878-8619.
Strategic Goal: Economic Development
Mayor Masiarczyk stated the next item is under New Business and is Mr. Mayes'
presentation on business retention and incentives regarding the Family Health Source.

None.
13. CITY MANAGER COMMENTS:
City Manager Shang stated the only thing she had was a statement which was handed out
regarding Lake Lorraine in case it comes up at the meeting. She added that Phyllis
Wallace will be available in case anyone has any questions. Vice Mayor Herzberg
suggested this should be under Special Reports because there will be people here asking
about it. Mayor Masiarczyk suggested if someone speaks under Public Participation about
this the City Manager can explain what happened. City Manager Shang stated it could be
done under Special Reports before Public Participation as an update. It was determined
that the update would be given under Special Reports.
14. CITY COMMISSION COMMENTS:
Vice Mayor Herzberg spoke about the Volusia Manufacturers Showcase and that
Commissioner Ramos and Mr. Colon will be participating at the schools in October and she
will bring it up at the meeting.
Mayor Masiarczyk spoke about the City's history and a decision needs to be made on
where to store it. He stated he has 6 - 8 boxes of items and there is tons that came from the
Arts and Historical Center that needs to be made into displays that can be displayed
around the City. He suggested possibly the Center, Deltona Water lobby, Station 62 or City
Hall. He also suggested the Little Red School House but it is dark, there is vandalism, it is
an old wooden building and the items should be protected better than that. He asked that
sometime over the next 40 days the Commission decides where to put the items and he will
bring it up under Commission Comments. He asked that everyone please go directly to the
Chambers for the photos to be taken.

Background: August 2018 - Hometown Heroes - Jeff Rupp and Jeanne Irwin. Their
heroic rescue of Sal Ferro and puppy “Harley” on Lake McGarity is
explained best in Sal’s own words:
To my friends and family.
Seemed to be just like the other times. I have a small 16’ bass boat, we
cruise on our lake that our house is on. It connects to a much larger lake
where there are usually a few boats on it either fishing or skiing.
I was heading towards a park that has a fishing dock on the lake that
people usually like to fish at. So I headed in that direction to give Harley
something to look at, and for the people to see the puppy. As I started
to get close Harley started to get antsy and move around the boat. Well
she went from being by my side to jumping in the water.
I got frantic and reacted without thinking. Before jumping in after her I
shut the boat off. But the movement of the boat was still strong. With a
hoodie and shorts on I swam to Harley to get her. She was dog
paddling just fine but we were both in the middle of the lake now! About
300-400 ft. to the dock where the fishermen were and about 600-800 ft.
away from shore. I started swimming with Harley towards the boat but
now it was about 200 ft. away or so. I was trying my hardest to keep
Harley up but I was getting exhausted extremely quickly. I could see the
people on the dock! I started shouting for help! I couldn’t keep Harley up
anymore so I pushed her in the direction of the boat hoping she could
make it to it! I started inhaling water, swallowing water, I was trying to

keep my head above the water! I could hear the people yelling franticly
but they were just too far away! I started sinking to the bottom, trying to
get the hoodie off me! Finally I got it off, I pushed off from the bottom of
the lake to get to the top again! I only had a few more attempts to stay
at the top, I was so exhausted hyperventilating taking in water! I was
able to yell HELP a few more times. I was done! I didn’t have any more
in me! I just was hoping that Harley was going make it. It was ok if I
didn’t but I couldn’t lose another dog after losing Titan. As I was
blacking out, my neighbor, Jeffery Rupp, saved my life! He was just
happen to be on the lake at the time. Actually it’s not that unusual for
him to be out. I was really surprised he wasn’t out there to begin with.
But as God always has his plans he put the right person at the right
place at the right time! Jeffrey snatched me out of the water, drove to
where Harley was got her and brought us to shore! The people at the
dock had already called 911! The EMS and Sheriff met us at the shore
of the park. I spent 3 days in the hospital. I had a lung and kidney
infection and broke my toe along with some cuts and bruises. But I’m
fine now! Getting better every day. So for those who wanted to know
the story or for those that had no idea. That was my past 3 days! Harley
is Great! More energy than I know what to do with!
Thank you so much Lord for sending Jeffrey my way! Thank you Jesus.

C. Proclamation - Hispanic Heritage Month September 15-October 15, 2018
Background: Each year, Americans observe National Hispanic Heritage Month from
September 15 to October 15, by celebrating the histories, cultures and
contributions of American citizens whose ancestors came from Spain,
Mexico, the Caribbean and Central and South America.
The observation started in 1968 as Hispanic Heritage Week under
President Lyndon Johnson and was expanded by President Ronald
Reagan in 1988 to cover a 30-day period starting on September 15
and ending on October 15. It was enacted into law on August 17, 1988,
on the approval of Public Law 100-402.
The 2018 theme for this annual tribute is “Hispanics: One Endless
Voice to Enhance Our Traditions.”

D. Proclamation - Fire Prevention Week October 7-13, 2018
Background: The 2018 Fire Prevention Week theme, “Look. Listen. Learn. Be aware
- fire can happen anywhere ™” effectively serves to remind us that we
need to take personal steps to increase our safety from fire.

Look for places fire could start. Take a good look around your home.
Identify potential fire hazards and take care of them.
Listen for the sound of the smoke alarm. You could have only minutes
to escape safely once the smoke alarm sounds. Go to your outside
meeting place, which should be a safe distance from the home and
where everyone should know to meet.
Learn two ways out of every room and make sure all doors and
windows leading outside open easily and are free of clutter.

E. Proclamation - CATALYST Mentor Celebration
Background: CATALYST Global Youth Initiatives, Inc., was started in 2010 and
serves 28 schools and hundreds of children with mentoring adults from
all walks of life.

Background: Significant rainfall in September 2018 impacted Deltona’s water &
stormwater infrastructure, requiring immediate and unforeseen repairs.
Two emergency purchase orders were approved by the City Manager

to facilitate the repairs necessary to maintain safe and operational
equipment. Because both purchase orders exceed $25,000, they are
submitted for Commission approval in accordance with Section 4.09 of
the City’s Procurement Policies:
· Emergency Purchase Order to Danus Utilities for $26,900 to
repair damaged gravity sewer line at Austin Avenue (Invoice
#091718-DI).
· Emergency Purchase Order to Volusia County for $47,300 for
emergency 12” reconnect to County to allow drainage of
stormwater (Invoice #000180001359).

Strategic Goal: Economic Development
Background: The OED staff is currently working with the Family Health Source (FHS),
a medical service clinic currently located at 2160 Howland Blvd.,
Deltona, which is in the Lowes/Publix center at DuPont Plaza (Howland
and Elkcam). They have been at that location for over ten years and are
currently looking to expand. As a medical provider, they are classified
as a TARGETED INDUSTRY.
The City OED is attempting to retain this business and their services
that are provided to the City. To assist with the business’ planned
expansion, the City OED showed FHS the half vacant former Winn
Dixie at 1200 Deltona Boulevard. They are currently in negotiations with
the plaza owners to determine if that location, and the costs involved in
the renovation, would make that relocation financially feasible. Please
note that the Deltona Plaza is in the City’s “Community Redevelopment
Area (CRA)”, a TARGETED ECONOMIC GROWTH LOCATION. Plus,
the new location will be six times the size of their current location and
the estimated renovation expenditures are expected to exceed
$900,000,
Retaining FHS would allow the City to retain fifteen (15) existing
medically related jobs in Deltona. Keeping the expansion within
Deltona would mean fifteen (15) medically related jobs at the Deltona
Plaza location and an extensive expansion of medical services would
be offered to the citizens of Deltona and SW Volusia County. Medically
related jobs are TARGETED INDUSTRY JOBS.
Family Health Source is applying for the following incentives based on
job creation.
· The fifteen (15) new jobs would be created over the initial
24 months of occupancy in the new facility. The City of
Deltona would incentivize these jobs per the Volusia
County Salary Range (State of Florida Average Wage
Requirements). Of the new jobs, the total proposed
payroll is $1,132,500 with incentivization on the
qualifying jobs calculated to be approximately $37,000,
paid in four equal, quarterly segments of $9,250
annually. All payments are performance based and the
proof of the incentives and proof of the incentives due is
the burden of the applicant.
· The fifteen (15) retained jobs that would also be
incentivized, per the Volusia County Salary Range

(State of Florida Average Wage Requirements). Of the
retained jobs, the total payroll is $826,660 and the
incentivization on the qualifying jobs is calculated to be
approximately $20,000, paid in four equal, quarterly
segments of $5,000 annually. All payments are
performance based and the proof of the incentives due
is the burden of the applicant.
Again, this is a TARGETED INDUSTRY BUSINESS. It provides
TARGETED INDUSTRY JOBS (health services). The business is
contemplating remaining in the City of Deltona and expanding
(Business Retention & Expansion), a Strategic Goal under The City
Strategic Goal of Economic Development. Plus, the business is
considering occupying the remaining half of the former Winn Dixie at
Deltona Plaza (1200 Deltona Boulevard), the heart of the City of
Deltona’s Community Redevelopment Area (CRA) and a TARGETED
REDEVELOPMENT AREA.
Based on these criteria, staff requests approval of the incentive
package to Family Health Services and upon approval authorizes the
necessary budget transfers to facilitate Commission approval and
further authorizes the City Manager to sign any documents necessary to
further Commission approval of this item.
