1. CALL TO ORDER:
Mayor Masiarczyk called the City Manager's Agenda Review Meeting to order at 5:30 p.m.
2. ROLL CALL – CITY CLERK:

4. APPROVAL OF MINUTES & AGENDA:
There were no questions or comments on this item.

Mayor Masiarczyk stated the next item is Quarterly Reports which are all written.

A. Presentation - Quarterly Reports of City Advisory Boards/Committees -

6. CITY COMMISSION SPECIAL REPORTS, REQUESTS AND DISCUSSION TOPICS:
Mayor Masiarczyk stated the next item is City Commission Special Reports and he asked if
there were any Special Reports.
Commissioner Nabicht stated he would have a report from the Transportation Planning
Organization (TPO).
Vice Mayor Herzberg stated she would have a Department of Environmental Protection
(DEP) update on who will be administering the funding regarding the septic systems.
Commissioner Bradford stated she may be bringing up something at the end regarding a
resident complaint on the noise ordinance. She stated it is concerning a neighbor who has
a garage band that plays every single night. She told the resident she needs to call the
Sheriffs' Office and file a report but the resident stated she did that and the neighbor asked
her if she was prejudiced. Mayor Masiarczyk responded the resident needs to file the
report. It was determined that Commissioner Bradford would bring the issue up under
Commission Comments.
7. PUBLIC FORUM: Citizen comments are limited to issues and concerns not on the
agenda and comments on items listed on the agenda will take place after discussion
of each item. Please be courteous and respectful of the views of others. Personal
attacks on Commission members, City staff or members of the public are not
allowed, and will be ruled out of order by the Mayor.
CONSENT AGENDA: The consent agenda contains items that have been determined
to be routine and non-controversial. If anyone in the audience wishes to address a
particular item on the consent agenda, now is the opportunity for you to do so.
Additionally, if staff or members of the City Commission wish to speak on a consent
item, they have the same opportunity.
8. CONSENT AGENDA:
Mayor Masiarczyk stated next is the Consent Agenda and he listed the items on the
Consent Agenda. The first item is to extend the Pilot Trap, Neuter Release Program, next is
the naming of three (3) Echo-Parks and last is the 2019 Holiday Meeting Schedule.
Commissioner Bradford asked if the Commission wanted to do the 2019 Holiday Meeting
Schedule now or wait for the new Commission. Mayor Masiarczyk responded this is our
normal procedure and if the new Commission wants to change anything it only takes an
action at a meeting.

Neuter, Release Program - Dale Baker, Building & Enforcement Services

9. ORDINANCES AND PUBLIC HEARINGS:
A. Public Hearing - Ordinance No. 16-2018, Revising the new Sub-Heading
Section 38-124A that provides for the Use of a Uniform Method of
Collecting Non-Ad Valorem Special Assessments levied within the
incorporated area of the City of Deltona Code of Ordinances by specifically
amending Section 38-124A (a) (1) to allow for the accumulation of
assessments for the costs incurred by the City for Nuisance abatements
over multiple fiscal years; Stating a need for such levy; Providing for
incorporation of Recitals, Codification, Severability and for an Effective
date, at second and final reading. Marsha Segal-George, Assistant City

Mayor Masiarczyk stated next is Ordinances and Public Hearings. Item A is an ordinance
revising the uniform collection of non-ad valorem assessments and the Commission
already discussed this at the first reading.
Vice Mayor Herzberg asked if City Attorney Segal-George could explain again exactly what
this ordinance is about and especially that it does not pertain to homesteaded properties .
Mayor Masiarczyk responded he would go to the City Attorney first and then get comments
from the public. The City Attorney explained this is the policy for all of Volusia County and
that is why it is not the City's ordinance.

11. NEW BUSINESS:
A. Ratification of collective bargaining agreement between the City of Deltona
and Deltona Firefighters, I.A.F.F. 2913 for a period of October 1, 2018
through September 30, 2022. - Jane Shang, City Manager, (386) 878-8850.
Strategic Goal: Public Safety
Mayor Masiarczyk stated the next item is under New Business regarding the collective
bargaining agreement between the City of Deltona and the Fire Union.
There were no questions or comments on this item.

14. CITY COMMISSION COMMENTS:
Mayor Masiarczyk commented the Fire Department's Honor Guard will be at the Dedication
and naming of Hwy 415 between Reed Ellis Rd. and Acorn Lake Rd. after David
Ledgerwood the only Deltona resident killed in action in Vietnam.
15. ADJOURNMENT:
Mayor Masiarczyk adjourned the meeting at 5:38 p.m.

Strategic Goals: Fiscal Issues
Background: On November 3, 2014 the City Commission of the City of Deltona
authorized a Pilot Trap, Neuter and Release (TNR) program to address
concerns about feral cats in Deltona. Resolution 2015-38 extended the
program to November 2, 2018. The program has proven to be
beneficial and cost effective.
Staff is recommending that the TNR program be extended for another
three (3) years. Minor operational changes are also being reviewed
and evaluated based on citizen comments.

B. Request approval of the naming of three Eco-Parks - Jerry Mayes, Economic
Development Manager, (386) 878-8619.
Strategic Goal: Infrastructure
Background: On August 13, 2018, the Commission for the City of Deltona
designated funds for the development of three new nature-themed
parks. While offering a relaxing natural setting for the City’s residents,
this is also an integral part of the City’s Ecological Tourism
Sustainability Program for visitors. During the Office of Economic
Development’s August presentation, it was requested that the parks be
nature themed and “ nature named”, to lend recognition to the park’s
intended use.
The suggested names for the parks is as follows:
1. Deltona’s 3-Island Lake Nature Park (District 1);
2. Deltona’s Big Lake Rookery Nature Park (District 6); and,
3. Deltona’s Blue Heron Nature Park (District 4).

C. Request for approval of the 2019 holiday meeting schedule - Joyce Raftery,
City Clerk’s Department (386) 878-8502.
Background: In the past, the Commission has chosen to change the Commission
meeting schedule in December due to the holiday season, i.e.
combining the two (2) regular meetings in December to one (1)
meeting in the middle of the month of December and to have no
workshops during the month of December.
Attached for the Commission's approval is the proposed schedule for
the calendar year 2019 City Commission meetings which includes one
(1) regular City Commission meeting and no workshops for the month
of December, 2019 and for the Commission's information the
invocation schedule for 2019 is also included.

Strategic Goal: Public Safety
Background: In accordance with the Collective Bargaining Agreement with Deltona
Professional Firefighter Union, Local 2913 in effect from October 1,
2015 to September 30, 2018, the City is to enter into negotiations to
ratify a new contract agreement. The City’s bargaining team was
appointed by the City Commission and consists of myself and City
Attorney Marsha Segal-George. The Union’s bargaining team consists
of John Viccaro, Kurt Vroman and Brandon Brower. Beginning in June
2018, fourteen collective bargaining meetings occurred. Three
executive sessions were held with the City Commission.
On, October 4, 2018, the City Commission tentatively agreed upon all

items and then on October 8, 2018 the Union presented the proposed
contract to their general membership where it received majority
acceptance.
