1. CALL TO ORDER:
The meeting was called to order at 6:30 p.m. by Vice Mayor Bradford.
2. PUBLIC FORUM: Citizen comments are limited to issues and concerns not on the
agenda and comments on items listed on the agenda will take place after discussion
of each item. Please be courteous and respectful of the views of others. Members of
the City Commission shall not enter into discussion or respond to individuals'
comments during the public forum other than to give directions or to ask for
clarification. However, individual Commissioners may wish to respond under their
"City Commission Comments". Personal attacks on Commission members, City staff
or members of the public are not allowed, and will be ruled out of order by the
Mayor. (6:30 to 7:00 PM)
Former Commissioner Loren King, American Legion Post #255, Deltona, spoke about
unused land, ECHO (Environmental/Ecological, Cultural, Historical/Heritage or Outdoor),
the plan, Mackle Brothers' donations, and American Legion Post #255 history.
Richard Bellach, Deltona, spoke about fear and reality, VSO (Volusia Sheriff's Office),
elections, trailers and mobile homes, and records.
Elbert Bryan, Deltona, spoke about Lakeshore Project, flooding and the City webpage.

A. Approval of minutes of the Regular Commission Meeting of December
12, 2022 as presented. - Joyce Raftery, City Clerk (386) 878-8502.
Motion by Commissioner Burbank, seconded by Commissioner
JodyLee, to approve the minutes of the Regular Commission Meeting
of December 12, 2022, as presented. The motion carried by the
following vote:
For: 6 - Vice Mayor Bradford, Commissioner Avila-Vazquez,
Commissioner Burbank, Commissioner Colwell,
Commissioner JodyLee, and Commissioner McCool
6. PRESENTATIONS/AWARDS/REPORTS:
A. Presentation: Annual Holiday Parade Awards
Strategic Goal: Internal and External Communication. Solicit
partnerships with businesses, schools, hospitals, and residents for
information dissemination.
B. Presentation - Quarterly Reports of City Advisory Boards/Committees -
Joyce Raftery, City Clerk (386) 878-8502.
7. ORDINANCES AND PUBLIC HEARINGS:
A. Public Hearing - Emergency Ordinance No. 02-2023, waiving the
enforcement of several sections and a chapter of the City Code of
Ordinances to allow residents whose properties have been damaged as
part of Hurricane Ian and/or Nicole to reside at their properties in
temporary housing including travel trailers and recreational vehicles -
Ron A. Paradise, Community Services Director (386) 878-8610.
Strategic Goal: Effective Governance
Planning & Development Services Director Ron Paradise gave a brief explanation of the
item.
The Commission, Interim City Manager and staff discussed requests received,
enforcement, FEMA (Federal Emergency Management Agency), verification/proof,
monitoring, sewer/septic, hurricane affected, language, flooding, homeless, distressed
areas, protecting the City, compliance, and expiration date.
Motion by Commissioner Jodylee, to table Ordinance No. 02-2023 to
January 17, 2023 so staff can narrow down the broad language. The

motion died for lack of a second.
The Commission and staff discussed FEMA trailers and waiving provisions.
Motion by Commissioner Avila-Vazquez, to adopt Emergency
Ordinance No. 02-2023 per instructions or certification from FEMA that
the homes are inhabitable, proof. The motion died for lack of a second.
The Commission, City Attorney and staff discussed verification and adding language.
Amended motion by Commissioner Avila-Vazquez, to adopt Emergency
Ordinance No. 02-2023 with the added language after the "WHEREAS"
clauses "that this ordinance only applies to properties damaged in the
City of Deltona in the recent hurricanes". The Interim City Manager has
the authority to make corrections of scrivener's errors and the like. The
motion died for lack of a second.
Motion by Commissioner Jodylee, seconded by Commissioner McCool,
to table Emergency Ordinance No. 02-2023 to the next meeting.
Amended motion by Commissioner Jodylee, seconded by
Commissioner McCool, to continue the Emergency Ordinance No.
02-2023 to the January 17, 2023 Regular Commission Meeting.
Vice Mayor Bradford opened the public hearing.
Elbert Bryan, Deltona, spoke about Code/FEMA certified, parking locations, and damaged
properties.
Vice Mayor Bradford closed the public hearing.
The motion carried by the following vote:

Strategic Goal: Fiscal Issues - Maintain a Balanced Budget
Finance Director Mari Leisen gave a brief explanation of the item.
Vice Mayor Bradford opened the public comments.
Elbert Bryan, Deltona, spoke about CRA (Community Redevelopment Agency),
stormwater, transportation, municipal complex, and Deltona Water.
Vice Mayor Bradford closed the public comments.
Motion by Commissioner JodyLee, seconded by Commissioner
Avila-Vazquez, to approve Resolution No. 2023-03 and Budget
Amendments 2023-006, 2023-007, 2023-010, 2023-004, 2023-013,
2023-005, 2023-009 and 2023-014 for the Stormwater, Transportation,
Municipal Complex, Deltona Water, Capital Equipment Replacement,
Parks Projects, Community Redevelopment Area and State Housing
Initiatives Partnership Program Funds for FY 2022-23. The Interim City
Manager has the authority to correct scrivener's errors and the like. The
motion carried by the following vote:

10. COMMENTS ON CONSENT ITEMS: Citizen comments are limited to issues and
concerns on the Consent Agenda item(s). Please complete a public participation slip
and indicate in the subject line the issue you wish to address. Members of the City
Commission shall not enter into discussion or respond to individuals' comments
during the public forum other than to give directions or to ask for clarification.
Please be courteous and respectful of the views of others. Personal attacks on
Commission members, City staff or members of the public are not allowed, and will
be ruled out of order by the Mayor.
11. CONSENT AGENDA: The Consent Agenda contains items that have been
determined to be routine and non-controversial. If discussion is desired by any
member of the City Commission, that item must be removed from the Consent
Agenda and considered separately. All other matters included under the Consent
Agenda will be approved by one motion. Citizens with concerns should address
those concerns by filling out a public participation slip and giving it to the Deputy
City Clerk prior to Consent Agenda items being pulled.
12. CITY COMMISSION SPECIAL REPORTS AND REQUESTS:
Commissioner McCool requested that the partitions on the dais be re-installed. Also, there
is an ethics complaint that has been filed against her by another Commissioner and she

asked that any public records there may be, to be released.
After discussion, the majority of the Commission concurred to re-install the
partitions on the dais.
Commissioner JodyLee requested to give local vendors in the City preference when
applying to bids.
The Interim City Manager stated there is a way to do that where extra points are granted to
a local business vs. a business outside the City but, it's done in a way that it is applied fairly
across the board and he will put something together.
After discussion, the Commission concurred to give local preference to vendors
living in the City.
Motion by Commissioner Jodylee, to rescind the food truck Ordinance
No. 03-2022. The motion died for a lack of a second.
The Commission discussed any complaints, life and safety, Code Enforcement, prior
administration, and minorities.
After discussion, the Commission concurred to have a Workshop on Ordinance
No. 03-2022, food trucks.
13. CITY ATTORNEY COMMENTS:
14. CITY MANAGER COMMENTS:
The Interim City Manager stated the Legislative Delegation Meeting is on January 9th and
he has circulated to the Commission various projects totaling $97 million. Representatives
at the Special Commission Meeting on December 21st requested that the City provide
information to them. Let him know if anyone has any comments, suggestions or ideas on
those or any additional items that were not included. The second thing is the Commission
asked staff to do a Request for Letters of Interest (ROLI) for Attorneys and he has a draft
which he has circulated to the Commission and both of the documents will go out this week.
The Legislative Delegation piece has already gone to the Delegation because it had to be
in for their agenda purposes. The ROLI is the City's own making and he is ready to move
forward with both those items at the Commission's pleasure.
Vice Mayor Bradford asked about the City Manager search information which was
circulated to the Commission. The Interim City Manager replied he circulated the same
document on or about November 1st. The document lists the previous solicitation of

professional firms to find a City Manager for the City. It ranked them and he provided the
top three ranked firms in the package but, if it was not included he will need to get them to
the Commission. He also has the scoring document that was used where the previous
Commission scored them. All three are qualified companies and to expedite the process
suggested the Commission staff to move forward with the process.
Vice Mayor Bradford suggested putting the item on the Regular Commission
Meeting for January 17th for an official vote and the Commission concurred.
15. CITY COMMISSION COMMENTS:
Commissioner Jodylee spoke about the City Attorney and City Manager search.
Commissioner Avila-Vazquez spoke about the Lakeshore Drive project and the Interim City
Manager replied the consulting has been looking at options and staff has not met back with
them due to holidays but, they will do that and try to get a report with the status of that project
to the Commission because staff is just as concerned as the residents are.
Commissioner Avila-Vazquez spoke about the Fire Department toy drive. She wished
everyone a happy, healthy and blessed New Year.
Commissioner Burbank spoke about the holidays, the Lakeshore Drive project, and
updating the website.
16. ADJOURNMENT:
There being no further business, the meeting adjourned at 7:35 p.m.

2011, the City Commission approved to have each Commissioner by
District schedule someone to present the invocation at each Regular
City Commission meeting rotating each Commissioner by District
starting with District #1, #2, #3, #4, #5, #6 and the Mayor.

Background: The City of Deltona held its Annual Holiday Parade on December 10,
2022. The entries selected, were judged by local stakeholders. The
results of the judging are as follows:
3rd Place - Best Overall (TIE)
-Iglesia Del Nazareno Nueva Vida & Pentecostal Church of God M.I.
New Life
Both groups earned high remarks on their theme and craftmanship.
2nd Place - Best Overall
- Florida Jeep Girl Club
The club earned high remarks for their show of holiday spirit.
1st Place - Best Overall
- Trinity Christian Academy
The judges scored high remarks for the energy from the academy and
their interpretation of the parade theme.

Strategic Goal: Effective Governance
Background: The City of Deltona was impacted by both Hurricane Ian and Hurricane
Nicole. Many homes were flooded by the storm or otherwise damaged.
In many cases, these homes were rendered uninhabitable and will
require extensive restoration/remediation to make the dwellings livable.
There is anticipation the restoration/remediation process for any
damaged home could protract over many months.
Therefore, to provide opportunity for residents to live on their properties
while damaged houses are being fixed and repaired, Ordinance No.
02-2023 will allow the waiver of certain provisions of City Code to allow
the location and use of travel trailers, RVs, or similar on hurricane
damaged properties. The travel trailers, RVs, or similar could be
provided by FEMA or privately procured and located.
The Ordinance allows the ability to locate the temporary housing in a
way that may encroach on yard setbacks or in some cases could be
located within a City right-of-way. The provision of power to the
temporary housing will need to be permitted by the City. Other utility
connections and service will need to be provided and will be addressed
on a case by case basis.
The use of the temporary housing is intended to be for a period of 180
days. However, a resident has the ability to request an extension of up
to another 180 days with justification from the City Manager.

September 19, 2022. Staff has submitted the attached budget
