CALL TO ORDER: The meeting was called to order at 6:30 p.m. by Mayor Avila. 2. PUBLIC FORUM: Citizen comments are limited to issues and concerns not on the agenda and comments on items listed on the agenda will take place after discussion of each item. Members of the City Commission shall not enter into discussion or respond to individuals' comments during the public forum other than to give directions or to ask for clarification. However, individual Commissioners may wish to respond under their "City Commission Comments". Personal attacks on Commission members, City staff or members of the public are not allowed, and will be ruled out of order by the Mayor. Beata Stys-Palasz, Richard Bellach, Michael Steininger, Carolyn Hickerson, Doug MacDonald, Kathy Bryan, Elbert Bryan, Daniel Carrico, Jose Santos and David Sosa addressed the Commission. 7. ORDINANCES AND PUBLIC HEARINGS: 8. OLD BUSINESS: A. Request for approval of Resolution No. 2023-08 and budget amendment to provide funding for phase 2 of the contract with Community Solutions Group (GAI) to complete the City of Deltona Parks and Recreation Master Plan - Mark Manning, Parks & Recreation (386) 878-8905. Strategic Goal: Fiscal Issues Motion by Vice Mayor Bradford, seconded by Commissioner McCool, to recommend approval of Resolution No. 2023-08, the budget amendment and change order to increase the purchase order in the amount of $82,000 in order to continue phase 2 of the completion of the Parks and Recreation Master Plan. The City Manager has the authority to correct scrivener's errors and the like. Strategic Goal: Infrastructure Motion by Vice Mayor Bradford, seconded by Commissioner Avila-Vazquez, to approve entering into a contract with Tyler Technologies to assist with importing meter reading data into Munis in the amount of $48,800.00. The City Manager has the authority to make corrections of scrivener's errors and the like. The motion carried by the following vote: For: 7 - Mayor Avila, Vice Mayor Bradford, Commissioner Avila-Vazquez, Commissioner Burbank, Commissioner Colwell, Commissioner JodyLee, and Commissioner McCool C. Request approval of Resolution No. 2023-05, amending the Deltona City Commission Operating Guidelines & Meeting Rules and Procedures - City Attorney. The City Attorney and City Manager gave a brief explanation of the item. The Commission discussed quasi-judicial hearings, props, seating arrangement, changing code/Comprehensive Plan, State mandates, and governing. Motion by Vice Mayor Bradford, seconded by Commissioner Avila-Vazquez, to approve Resolution No. 2023-05 amending the Deltona City Commission Operating Guidelines & Meeting Rules and Procedures. The motion carried by the following vote: For: 4 - Vice Mayor Bradford, Commissioner Avila-Vazquez, Commissioner Burbank, and Commissioner Colwell Against: 3 - Mayor Avila, Commissioner JodyLee, and Commissioner McCool 9. NEW BUSINESS: A. Results of the Southwest Deltona Community Redevelopment Area City of Deltona Page 3 City Commission DRAFT Minutes March 20, 2023 (CRA) Agency annual meeting and review of the CRA 2022 Annual Financial Report - Jerry Mayes, Economic Development & Ecological Tourism Sustainability Manager, (386) 878-8619. Strategic Plan: Economic Development Motion by Vice Mayor Bradford, seconded by Commissioner JodyLee, to accept the Southwest Deltona Community Redevelopment Area 2022 Annual Financial Report, as approved by the Southwest Deltona Community Redevelopment Board of Directors on March 13, 2023, and transmit the 2022 Annual Financial Report to the County of Volusia, the State Department of Economic Opportunity, and have said approved report posted on the City's website. The City Manager has the authority to make corrections of scrivener's errors and the like. CONSENT AGENDA: The Consent Agenda contains items that have been determined to be routine and non-controversial. If discussion is desired by any member of the City Commission, that item must be removed from the Consent Agenda and considered separately. All other matters included under the Consent Agenda will be approved by one motion. Citizens with concerns should address those concerns by filling out a public participation slip and giving it to the Deputy City Clerk prior to Consent Agenda items being pulled. A. Request approval of 1st Addendum to Municipal Utility Installation and Reimbursement Agreement between Lakeside Landings, LLC as successor to Mijax Deltona, LLC and the City of Deltona in the amount of $376,611.84- Glenn Whitcomb, Public Works/Deltona Water (386) 878-8929. Strategic Goal: Sewer Expansion - Infrastructure City of Deltona Page 4 City Commission DRAFT Minutes March 20, 2023 Motion by Vice Mayor Bradford, seconded by Commissioner Avila-Vazquez, to authorize the execution of the 1st Addendum to Municipal Utility Installation and Reimbursement Agreement between Lakeside Landings, LLC and the City of Deltona in the amount of $376,611.81. The City Manager has the authority to make corrections of scrivener's errors and the like. CITY COMMISSION SPECIAL REPORTS AND REQUESTS: Commissioner Burbank requested a workshop on the Comprehensive Plan, a downtown and CRA. He also requested a party in recognition of Deltona Plaza's 60th Birthday. Commissioner Avila-Vazquez requested a report on the businesses not open on Deltona Blvd. that are abandoned. She also requested whether sewer lines are connected on Deltona Blvd., specifically the homes that used to belong to the House Next Door, in Justin Square, and the Public Works/Deltona Water Director responded they are on septic. Commissioner McCool requested by the next Regular Commission Meeting the status on the previous Acting City Manager, Deputy City Manager and the City Attorney's contract. She announced the next Transportation Planning Organization (TPO) meeting this Wednesday at 9:00 a.m. at the Daytona Beach International Airport if anyone would like to attend. She asked anyone had an objection to her sitting on the TPO and if there are any issues, she would like to air them. Commissioner JodyLee requested that the City Manager look into the Courtland Crossings development because trucks are going in and out through the neighborhoods instead of using the construction entrance as discussed on Doyle Road. Vice Mayor Bradford requested a workshop on quasi-judicial hearings and who has standing and a policy on social media stalking banning Commissioners from being stalked by residents and vice versa. She requested to make sure the City's social media policy was distributed and signed by the newly elected Commission. Mayor Avila requested a workshop on a tax lien, code, amnesty for the residents and businesses. He requested to look into a cleaning company to maintain City Hall and he requested the status on the Land Development Code (LDC). 13. CITY ATTORNEY COMMENTS: 14. CITY MANAGER COMMENTS: City of Deltona Page 5 City Commission DRAFT Minutes March 20, 2023 The City Manager stated in response to Commissioner McCool's request he can give her information privately on litigation but, he would not recommend doing that publicly because it is regarding matters of litigation. 15. CITY COMMISSION COMMENTS: Commissioner Avila-Vazquez spoke about employee appreciation month, free pasta night at Sons & Daughters of Italy. Commissioner McCool spoke about the Deltona Job Fair, Adult Basketball, the City Manager's Report, Parks & Recreation ADA compliance, First Amendment rights, bullying, an email about her language, the treatment of women, social media policy and government, and employee appreciation month. Commissioner JodyLee spoke about moving toward electronic time sheets, employees abusing time, employee appreciation month, the City Manager's Report, Congressman Corey Mills and making comments on his page, funding for different projects Vice Mayor Bradford spoke about employee appreciation month, the City Manager Report, fence comments, managing lakes, the Bacon and Brew Festival and new development. The City Manager stated the City did get notice of legislature filed on our behalf totaling about $5 million in funding from the State, through the filings that the City made earlier. It was not close to the $115 million but, it is $5 million so that is a good start. The City is also pursuing other options, so we are not through. We are working on a number of other things too. Mayor Avila spoke about resident email regarding an employee, employee appreciation month, the Adopt-a-Road Program and the Mayor's Fitness Challenge. 16.
