CALL TO ORDER: The meeting was called to order at 9:00 am. 2. ROLL CALL: Also present: Dinelia Santana, Planning and Development Services; Tobborah Cottingham, Public Works; Zhaokai Lui, Planning and Development Services; Nashla Merced, Planning and Development Services; and David Cortez. APPROVAL OF MINUTES & AGENDA: A. Minutes for September 17, 2020 Motion by Scott McGrath, seconded by Leigh Grosvenor, to approve Minutes for September 17, 2020. The Committee concurred. 4. PRESENTATIONS/AWARDS/REPORTS: 5. PUBLIC FORUM: Time permitted, public comment shall be permitted at the end of agenda items only and shall not exceed two minutes. 6. OLD BUSINESS: 7. NEW BUSINESS: A. Pre-application Meeting - 2011 Montero Circle Mr. Paradise provided the Committee with an explanation surrounding the pre-application meeting request. He noted 2011 Montero Circle is also known as the East 87 feet of Block 1377 Unit 49, Deltona Lakes subdivision. He noted the remainder of lot 8 is under the same ownership as the neighboring parcel. He explained that the subdivision was done inconsistent with the City's code. He noted the parcel to the north is unplatted and the east 87 feet of lot 8 has been used as a driveway to access this parcel. Mr. Cortez, the current owner of 2011 Montero Circle, has a potential buyer that is willing to deed the east 12 feet City of Deltona Page 2 Printed on 10/12/2020 Development Review Committee Minutes October 1, 2020 of the parcel to the property to the north, which would leave 75 feet and still conform to the City's code requirements. The Committee spoke regarding the need of a legal opinion on the proposed 12 foot easement and if it constitutes as street or a driveway. Discussion occurred on access points for other neighboring lots, building in the floodplain, and drainage. The Committee spoke regarding flag lots, fire truck access, civil matters, setbacks, and stipulations on the split. They discussed their concerns with the complex history and the involvement with the 100 year floodplain. The Committee stated they needed the owners of the property to the north to produce the language regarding an easement and a survey of the easement on which Weimer Lane is based. They explained the builder for this lot will most likely have to deal with two front yard set backs based on the proposed 12 foot access easement. In addition, DRC members also indicated further subdividing the east 87 feet of lot 8 would not be appropriate as it would make floodplain avoidance more difficult. 8. STAFF COMMENTS: 9.
