The meeting was called to order at 9:00 a.m.

Motion by Jerry Mayes, seconded by Leigh Grosvenor, to approve the
Minutes of the Development Review Committee Meeting of April 1,
2021. The motion carried unanimously.
4. PRESENTATIONS/AWARDS/REPORTS:
None.
5. PUBLIC FORUM: Time permitted, public comment shall be permitted at the end of
agenda items only and shall not exceed two minutes.
Chair Phyllis Wallace opened and closed public forum as there were no public comments.

7A. 3108 Howland Blvd. - Pre-application Meeting - Advent Health Phase II
Background: ***NOTE***
Advent Health has two lots, with two different zonings. The C-1 zoning has the
current Emergency Department on it, and the other lot is zoned PB which would be
for Phase II. She has the following question:
· If the future phase 2 building overlaps the property line separating the two
zoning parcels would we need to rezone or plat? The FAR for C-1 is 0.35 but
a medical office building within PB has a FAR of 0.12. If the building does
overlap both zoning properties would the FAR be measured respective to
each lot?
Ms. Stickler spoke regarding the proposed Advent Health Park Building, explaining the
building would be located in a Professional Business Zoning District (PB) extending into the
Retail Commercial District (C-1). She asked the Committee for guidance on how to move
forward with the proposed project.
The Committee spoke regarding Section 100-400 regarding split zone situations but
suggested having a unified zoning classification. The Committee gave guidance on the
rezoning process, DRC review, Staff Reports, and the three (3) public hearings required for
an Ordinance.
Discussion occurred regarding a timeline for a Rezoning and Site Plan application.
The Committee suggested rezoning to a Business Planned Unit Development (BPUD) to
restrict the uses allowed on the land; which may receive more support from the surrounding
neighbors. The Committee explained the requirements of a Master Development Plan and
a Development Agreement for a BPUD application.
Discussion between the applicant and Committee occurred regarding the Conceptual Site
Plan, construction access, and a Traffic Impact Analysis (TIA).
7B. 8130-57-00-0030 - Pre-application Meeting - Proposed Church
Background: ***NOTE***

Chair Phyllis Wallace explained the pre-application meetings are for the applicant to ask
questions and tell the DRC what they would like to do. She explained the Committee would
try to help guide the applicants as they proceed to their submittal. Mr. Rodriguez explained
the International Center for Families would like to build a church on this parcel.
The Committee explained the property is environmentally constrained and would not

recommend building here because it is located in a 100 year flood plain and also contains
wetlands. The Committee spoke regarding the property requiring a Conditional Use
application for a House of Worship to be located in the C-1 zoning. They explained a
Conditional Use process would require two (2) public hearing where the environmental
issues and lack of suitability would be major factors.
The applicant asked if there was anything they could do to use this land. The Committee
explained it would be possible to find a civil engineer to change the floodplain with an
amendment to the FEMA Map, but this would be an uphill challenge. They explained the
costs to fill in wetlands and the various permits that would have to be pulled with multiple
agencies.
The Committee also suggested the applicant doing title work due to the land being in the
Tract C.
7C. 450 Doyle Rd. - Pre-application Meeting - Vineland Reserve Phase 1
Background: ***NOTE***
Vineland Reserve Phase I proposal is for the Townhome portion of the
Vineland Reserve PUD.
Ms. Widick explained the proposed property would have 50 townhomes in a California
Cluster Unit setup. The proposal presented alleyways used to access individual extended
driveways. The applicant stated this would allow multiple open space areas for residents.
The townhomes would be single family detached dwelling with three (3) bedrooms, two (2)
baths, and a two (2) car garage.
Discussion between the applicant and the Committee occurred regarding alleyway
measurements, fire vehicle simulations, additional parking, and a requirement for a major
amendment to the Vineland Planned Unit Development. Discussion continued regarding
setback requirements, sidewalks, ingress and egress to courtyards, and a shared amenity
center.
The Committee expressed concerns with having a shared amenity center between all
phases, as the DA requires an amenity center per phase. The Committee advised the
applicant to speak with WastePro regarding solid waste pickup requirements and if the
alleyways could accommodate garbage trucks. Discussion occurred regarding new
subdivisions requiring overflow parking. The applicant stated there would be no parking
allowed in the alleyways.
The Committee asked the applicant to provide the market dynamics driving this type of
project and visuals from other projects built as California Clusters.
Mr. Jackson stated these townhomes would look like villas with green space around the
homes and he would send applicable data to the Committee. The Committee expressed
concerns of limited access to the open green spaces.

Reference: This meeting is to discuss general information/DRC
Review Comments dated January 28, 2021, related to the
Eloah Estates Final Site Plan Application submitted on
October 5, 2020, with Ms. Christine Hall, PE and Jason
Bullard, PE (Exo Limited, LLC), new Engineers of record for
this project.
Tax Parcel No.: 8108-00-00-0035 & 8105-14-10-0190
Property Location: 2982 Howland Blvd/1000 Eloah Estates Rd.
Background:
The applicant D32 submitted a final site plan application on October 5,
2020. The application request is to construct approximately 326
multi-family units (Phase I). The first review comments memo from the
Development Review Committee was transmitted to the applicant on
January 28, 2021. These comments are still outstanding. In addition, the
BCC Engineering comments on the TIA review were transmitted to the
applicant on February 12, 2021. The applicant replied to the TIA review
comments on February 24, 2021. This project required a Volusia
County Traffic Engineering (VCTE) TIA review. Per VCTE, comments
were provided by their office on December 2020 and as of February 26,
2021, no response to comments has been received by the County.
On March 19, 2021, City staff received notification that the new EOR for
the Eloah Estates Final Site Plan application will be Exo Limited LLC.;
and Mr. Jason Bullard, PE, has requested a meeting with DRC to further
discuss this project.
Mr. Paradise explained to the Committee that Eloah Estates is a submitted Site Plan
project zoned for multifamily, and the engineering team has changed for the project. He
spoke regarding the extensive comments by City Staff and the need to reevaluate access.
He recommended the applicant applying for a Plat instead of a Site Plan if phasing is to
occur.
Mr. Ruiz explained he, Ms. Santana, and Ms. Merced spoke with the applicant on the 9th.
Mr. Bullard stated he was the new engineer for Eloah Estates, and he plans to develop a

portion of the property. Mr. Paradise recommended the applicant do a Plat to address
phasing. Mr. Bullard stated there would no longer be phasing.
Discussion occurred between Mr. Bullard and the Committee regarding the Traffic Impact
Analysis (TIA) and a scheduled meeting with Volusia County regarding the TIA. Discussion
continued regarding FEMA flood zone defined elevations, recreation requirements, access,
and an amenity center.
The Committee spoke regarding an Autumn Street connection, and a possible proposal by
the applicant for realignment.
7E. 1200 Deltona Blvd. Deltona Wellness - Plat Application
Background: ***NOTE***

Project Type: Re-plat
Property Acreage: Approximately 15.086 acres
Parcel ID: 813006000020 & 813006000024
Property Location: 1200 Deltona Blvd.
Background:
On 02/23/2021, the applicant submitted the Re-plat Application for
approximately 15.086 acres of land located at 1200 Deltona Blvd. On
03/01/2021, a review of the submittal had been determined to be insufficient;
therefore, staff has not yet accepted the application for review. An insufficiency
letter with staff’s comments was sent to the applicant on 03/01/2021.
On March 8, 2021, the applicant sent an email asking for clarification on the
insufficiency letter comments dated March 1, 2021. Upon internal review of the
applicant questions, staff determined that a follow up DRC Pre-app meeting be
scheduled to discuss the following:
1. The City does not have a record for the creation of Parcel ID
813006000024. Therefore, the City does not recognize this illegal
subdivision. The creation of lots are required to be processed as a plat
or in certain circumstances as an exempt subdivision (Code of
Ordinance Sec. 106-27). The creation of Parcel ID 813006000024 does
not qualify as an exempt subdivision. However, a lot conforming to City
Codes should be created during the plat process.
2. Mr. Robert Ziegenfuss’s email dated March 8, 2021.
3. Insufficiency letter dated March 1, 2021.
Mr. Ziegenfuss explained City Staff requested for 1200 Deltona Blvd. to come back to a
DRC meeting.
The Committee expressed concerns regarding how the project was proposed in previous
pre-application meetings but was submitted differently.
Mr. Ziegenfuss discussed email transmissions between Mr. McGrath and himself regarding

submittal requirements and an example provided regarding a turn lane. He gave an
explanation regarding the utilities shown on the survey.
The Committee explained construction plans for utilities would be required and spoke
regarding several lots extending to Deltona Blvd. The Committee advised the applicant of
the 25-foot buffer requirement. They spoke regarding the Subdivision application not being
consistent with the City requirements and also asked for a parking evaluation. The
Committee explained the utilities would need to be relocated because they cannot be built
on.
Mr. Ziegenfuss explained a Subdivision was done illegally, and there is a building through a
lot line, and he is doing research on the issue. The Committee advised the dispensary use
building was done without a Replat and should have been done through a condominium
arrangement. The Committee explained a lot of record Subdivision Exemption process
should be used to subdivide and explained a variance should be used as a last possible
option due to having strict legal matters requiring proof of hardship. Staff requested the
applicant submit a lot combination application in the meantime to correct the illegal
subdivision.
Discussion occurred regarding rezoning to a Business Planned Unit Development, condo
lines, the property appraiser's office, and scheduling a meeting with the City Engineer.
