Thursday, February 17, 2022 9:00 AM 2nd Floor Conference Room
A. In an effort to reduce the possibility of exposure of residents to the
COVID-19 (Coronavirus) the Development Review Committee meeting will
be held in the virtual environment via Webex and can be accessed by the
following methods:
1. CALL TO ORDER:
The meeting was called to order at 9:00 am.
2. ROLL CALL:
Also present: Dinelia Santana, Nashla Merced, and Renee Cairney, Planning and
Development Services; Toborrah Cottingham and William Colon, Public Works; Sharon
Shivers, Fire Safety; Scott McGrath, Buying Paradise; Jean Maldonado, Oscar Marthi, and
Robert Anarumo, Florida Realty Market Place; and Holly White, Vector Civil Engineering.

3. APPROVAL OF MINUTES & AGENDA:
A. Minutes of February 3, 2022
Motion by Joseph L. Ruiz, seconded by Jerry Mayes, to approve the
Minutes of February 3, 2022, as presented. The motion carried
unanimously.
4. PRESENTATIONS/AWARDS/REPORTS:

5. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the
agenda and shall not exceed two minutes. Please be courteous and respectful of the
views of others. Personal attacks on Committee/Board members, City staff or
members of the public are not allowed and will be ruled out of order by the Chair.
Chairperson Wallace opened and closed public forum as there were none.
6. OLD BUSINESS:
A. McCaskill Property - Subdivision Exemption Application
Mr. Ruiz explained this proposal came to the DRC on December 2, 2022, and there were
questions from the DRC that needed to be answered by the applicant regarding access
connections, floodplains, and the current development order.
Chair Wallace explained someone has to commit to maintaining the road because the
agreement states an HOA will maintain the road. She explained that if they want to change
the Development Order, the DRC would need to speak with the City Attorney because that
may void the lot split.
Discussion occurred regarding fire safety requirements and requiring access to all lots.
Mr. Danskine stated TetraTech submitted to FEMA, and maps are in the process of being
modified now.
7. NEW BUSINESS:
A. Pre-application Meeting - 2130 Missoula Trail
Mr. Marthi explained he would like to retire in Florida and wants to build approximately eight
(8) houses on the property for family and friends.
Mr. Ruiz explained the current zoning is R3, a low-density land use from the County,
meaning the land would need a Comprehensive Plan Amendment and Rezone. He
explained the City is not against the change in zoning, but the project would need a Plat
application because it is more than four (4) lots.
Mr. Danskine explained utilities would have to be connected, and the closest connection to
the sewer is on Captain Dr.
Discussion occurred regarding flood zones, wetlands, street and stormwater regulations,
and a pioneer agreement with impact fee reimbursement.
Chair Wallace advised the applicant to verify if Missoula Trail can be legally used because
it's a private road.
B. Pre-application Meeting - Fort Smith Blvd. and Howland Blvd. - Car Wash

and Tire Store
Mr. Tilly explained the proposal is for a Car Wash and Tire Shop on this property.
Mr. Ruiz stated since there are two (2) separate end-users, this would need a final plat
application and final site plan application.
Discussion occurred regarding Howland Blvd. being a County road and the types of
automobile service stations.
The Committee explained the proposed auto repair use would need to go through a
Conditional Use process for the Type A service station being requested, which means it
would have to go before Planning and Zoning and the City Commission for approval.
Mr. Ruiz asked if there was a way to reduce the noise from the tunnels of the car wash and
tire shop. He suggested the applicant get in contact with WastePro for the dumpster
location. He stated there may be questions and conditions issued during the public
meeting.
The Committee suggested the applicant apply for a Conceptual Site Plan to receive further
DRC guidance. They explained the conceptual site plan, review process, and timeline.
Ms. Santana spoke regarding the impact fees and advised the applicant to contact Volusia
County for their impact fees.
