In an effort to reduce the possibility of exposure of residents to the COVID-19 (Coronavirus) the Development Review Committee meeting will be held in the virtual environment via Webex and can be accessed by the following methods: 1. CALL TO ORDER: The meeting was called to order at 9:00 am. 2. Please be courteous and respectful of the views of others. Personal attacks on Committee/Board members, City staff or members of the public are not allowed and will be ruled out of order by the Chair. I-4 Logistics Park - SD21-0014 - DRC Conditional Approval for Preliminary Plat Application Chari Wallace stated there was a quorum for the record. Mr. Paradise explained this special DRC meeting would be very brief. He stated this would be a conditional approve the Preliminary Plat Application for the I-4 logistics park. He read the following conditions outlined in the Development Order: 1. The property has been surveyed for gopher tortoises on March 23, 2022. If applicable, all tortoises determined to be located on site will be either maintained on site or relocated. In addition, burrows located adjacent to the property will be afforded a 25 foot buffer. If applicable, all on-site protection, relocation, and 25 foot buffer burrow protection areas shall be conducted consistent will all Florida Fish and Game Conservation Commission (FWC) regulations and practices. A site engineering permit will not be granted for mass grading FWC permits are obtained and tortoises are relocated as applicable. 2. A five day long (weather permitting) nesting period scrub jay survey of the property shall commence on March 25, 2022, and conclude on March 31, 2022. Scrub jay habitat shall be verified on the property. A site engineering permit for clearing and mass grading shall not be issued until the jay habitat and population have been established. Once jay habitat is determined utilizing best science practice, jay habitat shall not be cleared or altered until requisite permits are secured from the U.S. Fish and Wildlife Service (USFWS). According to past environmental analysis, there is no scrub jay occupation or usage of the property referred to as Lot 1 of the preliminary plat. This area and a right - of - way will be subject to Condition 7 below. 3. Upon issuance of this Development Order, the applicant may place a 24’ x 60’ construction trailer on site per Sec. 110-819(b) of the City Land Development Code. The construction trailer will occupy an already cleared area of 40’ x 70’ on the property as identified by the March 24, 2022 illustration of staging and silt fence installation. However, to facilitate the location of the trailer, extra land containing no more than 150 square feet can be cleared. The cleared area will not be occupied by gopher tortoises or within a 25 foot burrow protection area. In addition, the 150 square foot cleared area shall not be associated with gopher tortoise burrows or a 25 foot burrow protection radius. The applicant will be responsible for obtaining an on-site construction trailer permit from the City. 4. Upon issuance of this Development Order, the applicant is authorized to store and otherwise stage heavy equipment consisting of no more than 20 land clearing/grading machines and ancillary equipment/vehicles on already cleared land provided the land is not occupied by gopher tortoises or a burrow protection area. The cleared land eligible for storage is depicted on the March 24, 2022 illustration of staging and silt fence installation. When the scrub jay survey is completed and the location of jay habitat is accurately identified and mapped by the applicant’s biological staff as per the determination of City staff, the applicant may commence the installation of silt fencing. The silt fencing operation shall not impact any tortoise burrow or burrow buffer - on-site or off-site. In addition, silt fencing shall avoid jay habitat until USFWS permits are granted for the alteration of habitat and/or take. The silt fencing operation shall be limited to a 20 foot wide corridor along the margins of the property and/or habitat. Vegetative debris will remain in a hedgerow condition within the 20 foot wide clearing window. 6. If applicable, once all tortoises are protected and/or relocated, an engineering permit can be issued. However, the engineering permit will not authorize clearing/alteration of any scrub jay habitat area until those areas have been permitted for impacts by the USFWS. 7. Since the site was surveyed for gopher tortoises on March 23, 2022, there has been a determination the City will issue an engineering permit to install silt fencing along the margin of and allow the commencement of clearing of an area of the property referred to generally as the south 1225 feet of parcel 8106- 04-00-0840 and 8107-00-00-0020. This is area corresponds generally with Lot 1 and the 60 foot wide public right of way extending along the northern margin of Lot 1. 8. No further clearing beyond condition 7 above will be authorized until the following information is submitted to and approved by the City notwithstanding environmental conditions: a. Note: Three lanes already exist between Energy Av. and the retention pond towards the eventual intersection of N. Normandy Blvd. and the Rhode Island Av. extension. b. City has plans for an eventual upgrade to a five (5) lane facility - four (4) travel lanes and one (1) middle turn lane. c. Future urban cross section is anticipated. As part of the three (3) lane design plan for a five (5) lane urban cross section via the shoulders. d. All stormwater systems shall be designed and otherwise sized to accommodate the eventual five (5) lane improvement. City shall pay for the extra cost to upgrade. e. All infrastructure cross sections, including pavement slopes (2%), shall be designed and constructed to facilitate appropriate drainage to accommodate a seamless upgrade to five (5) lanes. f. Necessary cross drains for the future expansion shall be designed and installed as part of the project lane improvements. The City will pay for the upgrades proportional to the needed five (5) lane expansion. g. All driveway cuts including the Rhode Island Av. extension intersection and all related curbing and directional controls shall be setback to the ultimate five (5) lane cross section. d. Sidewalks shall be set back one (1) foot in front of the east N. Normandy right-of-way line. e. Sidewalk shall be eight (8) feet in width. The Rhode Island Av. corridor shall be designed to accommodate an eight (8) foot wide sidewalk along the northern side of the road/right of way. g. Use of temporary strain poles will be acceptable until mast arms/control boxes, etc. can be procured. Temporary will mean one year from the issuance of a D.O. for a preliminary plat by the DRC. An extension of no more than 24 months shall be granted upon providing written information from producers, etc. as to when the mast arms will be procured and installed. Information will need to include a detailed schedule of events and payments. A letter of credit is required to be submitted to the City to ensure mast arms will be procured and installed. If the mast arms and related infrastructure are not installed within a year, the City shall take code compliance action. h. The above information shall be depicted on a plan set. The plan set shall be prepared to applicable engineering standards and submitted to the City as soon as a preliminary plan set (30%) is prepared. 9. Any clearing or land alteration activity beyond what is allowed as per the above conditions will be subject to a stop work order and/or a Code Compliance notice of violation (NOV). Any non-authorized land alteration as per what is depicted on the March 18, 2022 graphic of staging and silt fence installation will be subject to a $10,000 a day fine and a cost of $100.00 a square foot of land disturbed. The determination of impact will be determined by City staff. Motion by Ron Paradise, seconded by Jerry Mayes, to approve the Preliminary Plat SD21-0014, I-4 Logistics Park, with the conditions outlined in the Development Order. The motion carried by the following vote: For: 6 - Chair Wallace, Member Danskine, Member Grosvenor, Member Lynch, Member Mayes and Member Paradise Against: 1 - Member Ruiz Mr. Paradise explained the next step would be to secure an engineering permit with Public Works. He stated no clearing is allowed this weekend, but it gives the ability to stage equipment on site as per the Development Order. A construction trailer permit could also be processed for this weekend. He advised the applicant to address the terms of the conditions sooner than later, including the roadway design work.
