City of Deltona 2345 Providence Blvd. Deltona, FL 32725 Minutes Development Review Committee Thursday, March 7, 2024 9:00 AM 2nd Floor Conference Room A. The DRC and Informational/Pre-application meeting is held both in person and in a virtual environment via Microsoft Teams and can be accessed by the following methods: 1. CALL TO ORDER: The meeting was called to order at 9:00 am. 2. APPROVAL OF MINUTES & AGENDA: A. Minutes of February 15, 2024 Motion by Jessica Entwistle, seconded by Leigh Grosvenor, to approve City of Deltona Page 1 Printed on 3/13/2024 Development Review Committee Minutes March 7, 2024 the Minutes of February 15, 2024, as presented. The motion carried unanimously. 4. PRESENTATIONS/AWARDS/REPORTS: Chair Wallace stated if she had a consensus from the members she would like to move Item B. for the Raintree Subdivision to last item and allow the public to speak at that point. The Committee unanimously agreed. 5. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the agenda and shall not exceed two minutes. Please be courteous and respectful of the views of others. Personal attacks on Committee/Board members, City staff or members of the public are not allowed and will be ruled out of order by the Chair. Chair Wallace explained public forum for the pre-application Raintree would be done during the project. 6. OLD BUSINESS: A. 2902 Cardinal Street - SP21-0010- DRC Approval for D.O. Extension Ms. Entwistle explained this application was approved on February 3, 2022, and the Development Order (D.O.) has now expired. The D.O. expired on February 3, 2024, and the applicant is requesting an extension due to funding issues. She explained staff has drafted a new D.O. that has been reviewed by all departments, and recommends the Development Review Committee approved the extension. Chair Wallace stated staff would like to see activity within 90 days on the property. Mr. Badillo explained the hold on the property has been due to the lack of funding from banks, and changes in the market. He stated the project is now being funded through HUD, and closing should be in July. Chair Wallace explained the project would need to go through a new preconstruction meeting, and Mr. Badillo would need to speak with the building and fire department regarding his building permits when he was ready to move forward. Motion by Jessica Entwistle, seconded by Leigh Grosvenor, to approve the Development Order Extension of 2902 Cardinal Street Apartments, with the conditions listed in the Development Order. The motion carried unanimously. 7. NEW BUSINESS: A. Pre-Application - 875 Deltona Boulevard - Retail Plaza Mr. Poliner explained the project is back for clarification on a few items before a full submittal. He stated he would would like to put a swale in the front buffer. Mr. Poliner stated an environmentalist has been to the site and there are no wetlands, but it is located in floodplain A. Discussion occurred regarding stormwater and base flood elevations. Mr. Knight gave the applicant parking requirements and stated parking islands are required every 10 parking spaces per LDC Section 110-808. Discussion occurred regarding landscaping, parking, and dumpster enclosure requirements. Mr. Poliner asked if sewer would be brought near this location. Staff stated sewer is not there yet, and they were unsure about when sewer would be brought to this section of the City. Ms. Grosvenor explained the fire hydrant requirements and stated the closest hydrant is across Deltona Boulevard, which would need to be brought across the thoroughfare. Discussion occurred regarding hydrant connections and DBH requirements for trees. Chair Wallace stated the Raintree Subdivision item would be heard in the Commission Chambers, and stated staff would head down once the next item was done. C. Informational - 2668 Arcadia Street- Subdivision Ms. Entwistle stated this lot is a tract, that was platted in 1981. She explained that the only way to split the lot into anything smaller than one (1) acre parcels would be through connecting sewer to each lot. Chair Wallace explained staff may not be able to support Variance to exempt the sewer requirement. Ms. Entwistle explained a Variance requires an undue hardship, and this land is developable as is, so staff may not be able to support the request. Staff explained they may be able to support splitting the lot to make two (2) lots. Mr. Alvarez stated the two (2) lots would be acceptable, and that he would like to build houses on each. He requested minimum lot sizes. Staff requested the applicant to try to be contiguous with the surrounding lots. City of Deltona Page 3 Printed on 3/13/2024 Development Review Committee Minutes March 7, 2024 The meeting paused at 9:36 am to allow the Committee members and staff to head down to the Commission Chambers. B. Pre-Application - 315 Pervis Rd.- Raintree Subdivision The meeting reconvened at 9:50 am. Chair Wallace explained she would allow the applicant to speak first. She explained the Development Review Committee meetings are pre-application meetings, and they do not start any type of review process or start an application. Attorney Joseph Posey introduced the project and stated the applicant was willing to listen to the neighbors. Chair Wallace explained the citizens and Commission are not normally unfavorable towards these types of projects. She stated while she cannot speak for the Planning and Zoning Board or the City Commission, but the citizens are likely not going to favor this. Ms. Entwistle stated the property would not be contiguous with the surrounding properties. Vineland Reserve has larger lots and stated this area is rural. She asked the applicant about the open water areas on the lot. Mr. Duran stated he intends to meet all requirements by the City and will do everything possible for the community needs. He stated he does not have a clear answer regarding the open water yet, and knows there are ecological concerns the applicant will need to address. Chair Wallace opened public forum. Lori Warnick, stated she has been concerned about this project since 2022 when it originally came to the DRC. She explained there is a large pit in the middle of the property, and believes developing this land would cause flooding issues. She raised concerns regarding traffic from Vineland Reserve. She stated she would not be opposed to this project building one (1) acre lots, but she is opposed to the current proposed layout. Tina Swift, stated she is concerned about developments being built in Deltona and the negative effects towards New Smynra, Osteen, and Enterprise. She spoke regarding the JPA and sprawl. Brandy White, expressed concerns regarding the City looking at rezone requests while the Theresa Basin Study is being done. She stated the land should remain RE-1, since Deltona now has housing diversity. Cory Juhlini, expressed his concerns regarding flooding in this area and stated it was overwhelming. He stated the rezone is not a good idea. City of Deltona Page 4 Printed on 3/13/2024 Development Review Committee Minutes March 7, 2024 Randi Priest, spoke regarding Vineland Reserve changing the area, and stated the RPUD is not contiguous and would cause traffic issues. She spoke regarding crime and flooding in the area. She asked if there was a study showing the roads could handle this type of project. Terry Konash Luise, explained there are flooding issues through the Lake Butler chain. She spoke regarding the tree's needing to be saved and school capacities. She requested staff to review the Volusia County Comprehensive Plan for this area, because this type of project goes against it. She spoke regarding an illegal drain on the property. Katherine O'Brien, spoke regarding the history of this area. She stated the flooding has been horrible and its causing insurance rates to go up. She spoke regarding Collins Road and school capacities. John Hengehold, spoke regarding easements being changed in the area, and asked if it was legal. He stated the property was used as a burrow pit for 15-20 years. Lee Gibbons, spoke regarding his background in Deltona. He explained the property has a lot of impervious soils that are over saturated. Willow Coyle Bordner, explained she lives across from the proposal and the area is full of wildlife. She stated the land has been altered throughout the years, and is probably not stable enough to build on. She expressed her concerns with the proposal not being compatible with the area. Richard Taylor, spoke regarding City water challenges and raised concerns regarding access. He stated the property should stay at the current zoning as one (1) acre lots. Tim Blodgett, spoke regarding the Theresa Basin and concerns regarding flooding. Chair Wallace closed public forum. Chair Wallace explained the DRC reviews projects for compliance with the Land Development Code. She explained rezone projects go through public hearings in order to be approved. She spoke on the applicant's next steps. Attorney Posey spoke regarding communication efforts with the residents, and stated he would encourage a scoping meeting.
