1. CALL TO ORDER:
The meeting was called to order at 6:00pm.
2. ROLL CALL:
Also present: Ron Paradise, Planning and Development Services and Kathrine Kyp,
Planning and Development Services.

3. APPROVAL OF MINUTES & AGENDA:
A. Minutes of April 6, 2017.
Motion by Member Taulbee, seconded by Member Shimkus, to accept
the Minutes of April 6, 2017. The motion carried by the following vote:
For: 6 - Vice Chair Kihlmire, Member Diehl, Member Taulbee, Chair
Taylor, Member Avila-Vazquez and Member Shimkus

A. Discussion: Sidewalk Cafe.
Mr. Paradise spoke regarding Sidewalk Cafe's. He noted that in 2013 it was requested
from certain businesses to add Sidewalk Cafe's to the City's current code. He noted the
guidelines for businesses to adhere to include, fire code setbacks, adequate pedestrian

access on sidewalks an insurance. He stated in the past four (4) years there have been
complaints surrounding sidewalk cafe's. These include, sidewalk storefront
encroachment on adjacent businesses, encroaching on the sidewalk clear zone,
neighboring disruptive patrons and potential fire hazards. He discussed potential ideas
for the Committee to consider such as requiring storefront setbacks, prohibiting the sale
of alcohol and meeting with the Development Review Committee for review. Discussion
from the Committee occurred regarding the Business Tax Receipt license and complaint
process, defining and requiring setbacks and reviewing neighboring municipalities and
their code. Mr. Shimkus noted that a review of the Building and Fire Code should be
done to ensure consistency. Mr. Paradise stated that he will research the Building and
Fire code requirements and Deland and Sanford's setback requirements and rationale.
