City of Deltona 2345 Providence Blvd. Deltona, FL 32725 Minutes Ordinance Review Committee Thursday, July 6, 2017 6:00 PM Second Floor Conference Room 1. CALL TO ORDER: The meeting was called to order at 6:00 pm. 2. ROLL CALL: Also present: Planning & Development Director, Chris Bowley, AICP; Planning & Development Assistant Director, Ron Paradise and Administrative Assistant, Kathrine Kyp. Present: 7 - Vice Chair Sonjia Kihlmire Member James Diehl Member Eric Taulbee Chair Cheri Taylor Member Maritza Avila-Vazquez Member Troy Shimkus Member Sherwin Kendall 3. APPROVAL OF MINUTES & AGENDA: A. Minutes of May 4, 2017. 4. PRESENTATIONS/AWARDS/REPORTS: 5. PUBLIC FORUM: 6. OLD BUSINESS: A. Discussion: Carports. Mr. Bowley provided the committee with a background on carports. He stated that he has talked with Code Enforcement and the Building Official and stated that the issue is with a temporary and permanent carports and it's permitting. He stated that Code Enforcement will continure to monitor the permanent carports as written and the Committee can make changes for temporary carports in that section of the code, if needed. Member Vazquez and Mr. Bowley discussed the permitting process for temporary carports. Member Kilhmire noted that temporary carports can be dangerous during a hurricane. Discussion ensued amongst all regarding existing permits throughout the City. Discussion: Sidewalk Cafes. Mr. Paradise provided the Committee with an update on his research on sidewalk cafes in the surrounding cities. He noted that the City of Sanford and the City of Deland both are within the ROW and have extensive regulations which include, permitting, restrictions on type of furniture, clear zones, allowing for the sale of alcohol. City of Sanford further regulate the aesthetic requirements by stating the type of furniture used, outside entertainment and the apparel employees can wear. He noted the City of Deland states that if the sidewalk cafe is greater than 30% of the gross floor area then the need for additional off-street parking could be required. Mr. Paradise noted that the City of Deltona's sidewalk cafes provision appears to be adequate. Discussion occurred regarding public safety, liability and property owner responsibilities. Member Kendall and Mr. Paradise discussed the reason the Committee is reviewing the sidewalk cafe ordinance. Mr. Paradise stated that there was an incident that involved the Volusia County Sheriff's Department to be called and the Commission wanted to have it reviewed for consistency and if the provision is still applicable. Member Kendall noted that there are a small amount of businesses with sidewalk cafes and hopes that the City doesn't place onerous restrictions on them or prevent more restaurants from entering the city. Discussion occurred regarding the need to revise the provision based on one incident. Mr. Bowley stated that the ordinance was written and adopted in 2013/14 with much research from other departments and other municipalities. He noted that since adoption, the number of sidewalk cafe's have grown in number within the City. Member Diehl and staff discussed the next step surrounding the review of the ordinance. Member Diehl stated that they could make a recommendation that no action is necessary with regard to the ordinance. Motion by James Diehl, seconded by Eric Taulbee, to communicate to the City Commission, no action is necessary with Sec. 110-832, Sidewalk Cafes. The motion carried by the following vote: For: 7 - Vice Chair Kihlmire, Member Diehl, Member Taulbee, Chair Taylor, Member Avila-Vazquez, Member Shimkus and Member Kendall 7. NEW BUSINESS: 8. STAFF COMMENTS: Mr. Bowley stated that the Committee will be reviewing the Landscape Code next. Discussion regarding the beautification contest the city. 9. BOARD/COMMITTEE MEMBERS COMMENTS: Member Diehl asked for nominations of Secretary and nominated Troy Shimkus. Member Vazquez asked for the provisions on signs for Crunch Fitness as the business City of Deltona Page 2 Printed on 7/12/2017 Ordinance Review Committee Minutes July 6, 2017 has been placing signs and Code Enforcement picks them out. Member Shimkus noted that the business can apply for a sign permit to allow him to place various approved signage. Motion by James Diehl, seconded by Eric Taulbee, to approve Troy Shimkus as Secretary. The motion carried by the following vote: For: 7 - Vice Chair Kihlmire, Member Diehl, Member Taulbee, Chair Taylor, Member Avila-Vazquez, Member Shimkus and Member Kendall 10.
