CALL TO ORDER: The meeting was called to order at 7:05 pm. 2. ROLL CALL: Present: 6 - Chair Tom Burbank Vice Chair Donald Philpitt Secretary John Harper Member Michael Putkowski Member Dwayne Kennedy Member Ruben Munoz Excused: 1 - Member Stony Sixma 3. APPROVAL OF MINUTES & AGENDA: A. Minutes of August 15, 2018. Motion by John Harper, seconded by Donald Philpitt, to accept the Minutes of August 15, 2018. The motion carried by the following vote: For: 6 - Chair Burbank, Vice Chair Philpitt, Secretary Harper, Member Putkowski, Member Kennedy and Member Munoz 4. PRESENTATIONS/AWARDS/REPORTS: 5. PUBLIC FORUM: Time permitted, public comment shall be permitted at the end of agenda items only and shall not exceed two minutes. 6. OLD BUSINESS: 7. NEW BUSINESS: A. Public Hearing - Resolution No. 2018-64, Lighthouse Pentecostal Church of Jesus, 590 Ft. Smith Blvd. Mr. Paradise provided the Board with a summary of Resolution No. 2018-64. City of Deltona Page 1 Printed on 10/29/2018 Planning and Zoning Board Minutes October 17, 2018 Zechariah Henry, applicant provided the Board with a history of the church, its outreach and ministry. He expressed the desire to expand the church to meet the needs of Deltona. Member Putkowski asked where the existing church is located, funding and timeline. Mr. Paradise noted the conditional use will expire in 12 months. James Darby, 2195 Auburndale St. Deltona, spoke in favor of the proposed Conditional Use. He stated the congregation works very hard for the community. Eluris Rhodes, 2050 Dixie Belle, Deltona resident and works on faith outreach and food distribution. She sees a need for the church in the community. Debra Dinan, 1485 Steeple Chase, Deltona, spoke on behalf of the church. She expressed the church needed a permanent home. Meeting went into Recess Meeting Reconvened Motion by Ruben Munoz, seconded by John Harper, to recommend for approval Resolution No. 2018-64, Lighthouse Pentecostal Church of Jesus, 590 Ft. Smith Blvd. The motion carried by the following vote: For: 6 - Chair Burbank, Vice Chair Philpitt, Secretary Harper, Member Putkowski, Member Kennedy and Member Munoz B. Public Hearing - Ordinance No. 05-2018, Hampton Oaks RPUD. Mr. Paradise provided the Board with a summary of the rezoning application regarding lot size, landscape buffer, infrastructure capacity, and public safety. The project is estimated to generate 2,500 trips on the City's network and there are nearby transportation segments that are deficient. He provided some additional language within the Development Agreement (DA) regarding the model home section and noted that infrastructure is to be constructed prior to the construction of the model homes. Member Munoz and Mr. Paradise discussed the availability of sewer and traffic capacity. Mr. Paradise stated the City applied for a grant from the RIver to Sea Transportation Planning Organization to improve the intersections of Tivoli Drive with Providence Blvd. and Saxon Blvd. The proposed improvements will create more capacity for existing and future development. The improvements will go out to bid in November. Member Munoz noted the improvements may not be enough for this development. Member Harper asked if this project area was under water and flooded years ago. Member Harper stated his concern regarding drainage capacity. Member Philpitt asked about sequencing the traffic signals and mitigation of the traffic. Mr. Paradise stated mitigation is the responsibility of applicant. Member Putkowski stated that road improvements are needed before the subdivision is constructed. He noted his concern about the previously flooded areas. Mr. Paradise stated growth and development is directed away from the flood zone. Chair Burbank discussed access, traffic, ingress and egress and coordination with Volusia County Transportation. Parker Mychenberg, Mychenberg and Associates, provided a summary of his background and previous and existing projects. He showed a separate graphic of a proposed concept plan related to the application. He noted that they haven't done drainage design, stormwater calculations, permitting applications, and assures the drainage will be approved prior to development. He stated that if the rezoning is successful, it will be 4-6 months before breaking ground. He spoke on the traffic study and noted that an updated traffic study will be provided with the preliminary plat and the impact fees can be redirected to prioritize traffic improvements. Member Munoz and Mr. Mychenberg discussed the impact of the project on the City. Member Munoz stated the City is not prepared for the project. He noted that the County does not care about the existing roads. Mr. Mychenberg noted the existing zoning allows for 300 homes and was always planned to have houses. Member Harper asked about streets, homeowner's association, and responsibilities for drainage. Doug Macdonald, 1494 Surrey Run Court, Deltona, spoke as a resident that is adjacent to the project. His concern is drainage, traffic and potential cut through road from his neighborhood to the project. He had additional concerns regarding lot size, house size and would not like to see smaller lots. Tony Figueirdo, 1464 Surrey Run Court, Deltona, spoke with concerns regarding the traffic, drainage from Kensington Estates towards the proposed development, the existing sink hole and wildlife mitigation. He hoped for additional buffer between the development and the Kensington Estates Subdivision. Jeff Dinan, 1485 Steeplechase Lane, Deltona, spoke regarding the concerns within the development. He noted the increased traffic, increased density and is concerned about the impervious service and stormwater run off. He summarized the previous hurricanes and how the engineers didn't anticipate the storm strength. He is concerned about flooding and wildlife relocation. City of Deltona Page 3 Printed on 10/29/2018 Planning and Zoning Board Minutes October 17, 2018 Gail Vayko-Ford, 2149 Clearwater Drive, Deltona, spoke regarding the impact traffic, wildlife and drainage. Thomas Vayko, 1327 Star Court, Deltona, spoke regarding his concern for drainage, pervious and impervious ratios, traffic, construction and wildlife. He stated the builder should carry more of the impact. David Dawson, 1698 Sterling Silver Blvd., Deltona, spoke on behalf of the Sterling Park Estates Homeowners Association and is concerned about traffic and the two entrances through their neighborhood. Diana Ho-Yen Underwood, 1340 Lake Baton Drive, Deltona, spoke regarding the traffic and noted builders don't always do what they say. She stated Lake Baton Estates is experiencing problems with stormwater and when it rains homes are having issues with drainage. She is concerned about wildlife and noted her development is a cut through for traffic. Theresa Brazee, 1057 Platinum Court, Deltona, spoke regarding the existing drainage and noted that when it rains, a portion of her property floods. She is also concerned about school capacity, local jobs, wildlife and traffic. Bill Brazee, 1057 Platinum Court, Deltona, spoke regarding traffic and the Sterling Silver Blvd. entrance and suggested there be a different development plan with regard to the proposed streets. Timothy Diggs, 1701 Sterling Silver Blvd., spoke regarding existing infrastructure that needs improving and suggested the City and the County work together regarding traffic concerns first before development of the residential neighborhood. Matthew Borgens, 1665 Gold Oaks Road, spoke regarding the crime in the area and safety. He stated that the surrounding areas drain into proposed development area. Mr. Mychenberg spoke to the concerns regarding traffic, drainage, infrastructure, wildlife and entitlements. He noted environmental permitting requirements and relocation. He stated the main entrance is by the school and the ancillary accesses were stubbed out already. He will address the traffic concerns after the rezoning approvals. He spoke to the landscape buffer and rear yard setback. Member Munoz spoke regarding the impact of traffic and the need for evacuation. Mr. Mychenberg restated the Tivoli improvements. Member Munoz is concerned about the expectation versus realization regarding traffic improvements. Chair Burbank stated that this project is asking too much at this time. Member Philpitt noted that Staff should have highlighted the drainage issue in the report. Member Putkowski likes development but this needs improvement and noted the City should spend more on what residents want not building. Motion by John Harper, seconded by Michael Putkowski, to recommend for denial, Ordinance No. 05-2018, Hampton Oaks RPUD.
