CALL TO ORDER: The meeting was called to order at 7:00 pm 2. ROLL CALL: Present: 5 - Chair Tom Burbank Member Donald Philpitt Secretary Michael Putkowski Member Stony Sixma Member Dwayne Kennedy Excused: 1 - Vice Chair John Harper Absent: 1 - Member Ruben Munoz 3. APPROVAL OF MINUTES & AGENDA: A. Minutes of October 17, 2018. Motion by Michael Putkowski, seconded by Stony Sixma, to accept the Minutes of October 17, 2018.. The motion carried by the following vote: For: 5 - Chair Burbank, Member Philpitt, Secretary Putkowski, Member Sixma and Member Kennedy B. Election of Officers Member Sixma nominated Tom Burbank for the position of Chairman. With no further nominations for the position of Chairman, nominations were closed. The motion was seconded by Member Putkowski and the motion carried unanimously. Chairman Burbank called for nominations for the position of Vice-Chairman. Member Sixma nominated John Harper. With no further nominations for the position of Vice-Chairman, nominations were closed. The motion was seconded by Member Philpitt and the motion carried unanimously. Chairman Burbank called for nominations for the position of Secretary. Member Sixma nominated Michael Putkowski. With no further nominations for the position of Secretary, nominations were closed. PRESENTATIONS/AWARDS/REPORTS: 5. PUBLIC FORUM: Time permitted, public comment shall be permitted at the end of agenda items only and shall not exceed two minutes. 6. OLD BUSINESS: 7. NEW BUSINESS: A. Ordinance No. 19-2018 - Amending The Capital Improvements Element Providing For The Replacement Of The Capital Improvement Project Sheets. Mr. Paradise gave a brief summary of the Capital Improvements Element update. There was discussion amongst the Board members concerning the impact of the suspension of recycling would have on next years CIE update and solid waste level of service. Member Putkowski asked questions regarding Public Works paving projects illustrated in the CIE update. Mr. Paradise referred Member Putkowski to City Public Works for more information. Motion by Donald Philpitt, seconded by Michael Putkowski, to approve Ordinance No. 19-2018 - Amending The Capital Improvements Element Providing For The Replacement Of The Capital Improvement Project Sheets. The motion carried by the following vote: For: 5 - Chair Burbank, Member Philpitt, Secretary Putkowski, Member Sixma and Member Kennedy B. Resolution No. 2018-76 - Conditional Use application for 2281 Bannister Street to allow a Community Residential Home in the R-1 Single Family Residential Zoning district. Mr. Paradise provided a summary of Resolution 2018-76 for a proposed community residential home (CRH) located at 2281 Bannister Street. He noted that F.S. 419 has conditions for community residential homes including serving no more than six (6) people and provide a thousand foot separation between similiar uses. He stated that the proposal is to house six (6) female, low functioning residents and noted that the facility will not be used to house juvenile justice clients, hospice clients, be maintained as a halfway house or other use of the like. He noted that the City is proposing to add additional conditions such as; the CRH becomes occupied by Duval Homes within 12 months, remains under the ownership of Duval Homes, and only serve persons with disabilities as defined and regulated by the Florida Agency for Disabled Persons. Marsha Shankleton, applicant, 44 Wisteria Dr. Debary, provided a summary of her City of Deltona Page 2 Printed on 1/28/2019 Planning and Zoning Board Minutes January 16, 2019 background and the history of Duval Homes. She advised that the six (6) women are currently living at 730 Outrigger Drive and this conditional use application is to relocate them to 2281 Bannister Street. The ages of the women range between 40-63 years old and have resided with Duval Homes for over 30 years. Discussion between the board and Ms. Shankleton occurred regarding the level of function of the residents and whether the CRH use would be coed. Ms. Shankleton remarked that the level of function is low. The women are fed by staff and require staff to bathe and clothe them. Therefore, the CRH would not be coed. Beverly Rehrer, 2291 Bannister Street asked about the staff to resident ratio and the ability for them to go outside. Ms. Shankleton said shifts will have two (2) staff for the first shift, two (2) for the second shift, and one (1) for the night shift. Ms. Shankleton further advised the residents will likely be only on the back porch. Ms. Rehrer is concerned about frequent ambulance trips and related sirens as she suffers from seizures. Aristide Maniscalchi, 2291 Bannister Street. Stated his concerns about safety and frequent ambulance trips. Mary Servello, 2265 Bannister Street. talked about the neighborhood, and stated concers related to children safety, crime and property values. Carmen Bellezio, 1743 Concert Road, spoke in favor of the home and expressed her hope they will stay for a long time. Martha Kelly, 2248 Bannister Street, stated she doesn't see how six people can live within the home and is concerned about the quality of care. Raymond Schneider, 1735 Concert Road, worked in nursing home and has concerned for traffic and the care of the residents. He is also concerned about property values decreasing and children safety. Dana Zern, 2268 Bannister Street, stated that she has two children and has concerns about traffic and their safety. Joseph Laverde, 2300 Bannister Street, stated that this is a quiet street and has concerns about property values. Ms Shankleton stated the requirements of the State for the number of residents is six (6) and spoke regarding traffic. She says a staff manager drops off food in the morning twice a week and noted that the Duval Homes takes care of their properties. She also noted that they will have a full time generator in case of emergencies. Board members and Ms. Shankleton discussed the ages of the residents, any potential drug addition and parking. Ms. Shankleton stated that the women are non verbal, half are in City of Deltona Page 3 Printed on 1/28/2019 Planning and Zoning Board Minutes January 16, 2019 wheelchairs and are severally disabled. She stated the medication cart is double locked and approved by the State and parking will be a mini van and no more than 2 additional vehicles. Chairman spoke to other CRH types uses already in the City and noted they are well maintained. Motion by Michael Putkowski, seconded by Stony Sixma, to recommend for approval with conditions Resolution No. 2018-76 - Conditional Use application for 2281 Bannister Street to allow a Community Residential Home in the R-1 Single Family Residential Zoning district.
