APPROVAL OF MINUTES & AGENDA: A. Minutes of March 20, 2019. Motion by John Harper, seconded by Stony Sixma, to A. Minutes of March 20, 2019.. The motion carried by the following vote: For: 4 - Vice Chair Harper, Member Kennedy, Member Sixma and Member Whittock Abstain: 1 - Chair Burbank 4. PRESENTATIONS/AWARDS/REPORTS: 5. PUBLIC FORUM: Time permitted, public comment shall be permitted at the end of agenda items only and shall not exceed two minutes. 6. OLD BUSINESS: 7. NEW BUSINESS: A. Resolution No. 2019-17, Conditional Use for 935 Howland Boulevard. Mr. Paradise provided a summary regarding the conditional use application. He noted the application was to expand the house of worship and to allow a private school on 6.35 acres at 935 Howland Blvd.He stated the school will be required to adhere to building code setback, parking regulations and landscape buffer requirements. Woodland Blvd. spoke on behalf of the applicant and clarified the address within the Resolution. Discussion ensued regarding operation and student attendance. Chair Burbank opened the public hearing. James McCully, 920 Gage Ave, Deltona asked about any other proposed projects at this location. Mr. Paradise stated that there are three (3) commercial lots along Howland Blvd. and future residential is planned on the remaining area. Motion by Stony Sixma, seconded by John Harper, to recommend for approval Resolution No. 2019-17, Conditional Use for 935 Howland Boulevard. The motion carried by the following vote: For: 5 - Chair Burbank, Vice Chair Harper, Member Kennedy, Member Sixma and Member Whittock B. Ordinance No. 04-2019, N/E of Doyle Rd. and S. Courtland Blvd., CP19-001; Changing the Future Land Use Map of 0.138 acres of land from Low Density Residential (LDR) to Commercial (C). Mr. Paradise provided a summary regarding the proposed comprehensive plan amendment. The intent is to join the parcel with the adjacent parcel located at 65 Courtland Blvd. to better afford access, landscaping, parking and stormwater management. Darren Eyre, Thomas Engineering, applicant, noted the Volusia County Transportation department required the access be further from the intersection. Motion by John Harper, seconded by Stony Sixma, to recommend for approval Ordinance No. 04-2019, N/E of Doyle Rd. and S. Courtland Blvd., CP19-001; Changing the Future Land Use Map of 0.138 acres of land from Low Density Residential (LDR) to Commercial (C). The motion carried by the following vote: For: 5 - Chair Burbank, Vice Chair Harper, Member Kennedy, Member Sixma and Member Whittock C. Ordinance No. 05-2019 – Amending the Official Zoning Map from Agriculture (A) to Retail Commercial (C-1), N/E of Doyle Rd. and Courtland City of Deltona Page 2 Printed on 4/23/2019 Planning and Zoning Board Minutes April 17, 2019 Blvd., Project No. RZ19-002. Mr. Paradise provided a summary regarding the proposed rezoning request. The intent is to join with the adjacent parcel located at 65 Courtland Blvd. to afford better access, landscaping, parking and stormwater. Motion by Stony Sixma, seconded by John Harper, to recommend for approval Ordinance No. 05-2019 - Amending the Official Zoning Map from Agriculture (A) to Retail Commercial (C-1), N/E of Doyle Rd. and Courtland Blvd., Project No. RZ19-002. The motion carried by the following vote: For: 5 - Chair Burbank, Vice Chair Harper, Member Kennedy, Member Sixma and Member Whittock D. Garage Sales amendment Chapter 22, Article V (Ordinance No. 08-2019). Mr. Paradise provided a summary and timeline of the review of the proposed Garage Sales ordinances. He explained the need for two (2) ordinances as it encompasses three (3) chapters within the City's Code of Ordinances. The proposed changes removes the garage sale provision within Chapter 110 and places it into Chapter 22. Changes also define a garage or rummage sale event as three consecutive day event, and a non-profit rummage sale. The changes increase the quantity of events annually from two (2) to four (4), with a minimum of four weeks in between each event, and adds a registration requirement made either online or in person. He noted that the Ordinance Review Committee reviewed the ordinance changes. Discussion occurred regarding the enforcement of these provisions and whether this covers rummage sales on commercial properties. Motion by Ruben Munoz, seconded by Dwayne Kennedy, to recommend for approval, Garage Sales amendment Chapter 22, Article V (Ordinance No. 08-2019). The motion carried by the following vote: For: 5 - Chair Burbank, Vice Chair Harper, Member Munoz, Member Sixma and Member Whittock E. Amendment to Chapter 102 “Signs” and Deletion of Section 110-814(j) “Garage Sales or Yard Sales” (Ordinance No. 09-2019). Mr. Paradise provided a summary regarding the proposed provisions regarding signs for garage sales. Removing garage sale the language from Chapter 110 and placing it in Chapter 22. The proposed changes to Capter 102 include the allowance of no more than five (5) signs, four (4) are to be directional, and no more that 4 sq ft. in size each. A timeframe to remove signs, a registration number depiction requirement, and enforcement were also discussed. Motion by John Harper, seconded by Dwayne Kennedy, to recommend for approval, Amendment to Chapter 102 "Signs" and Deletion of Section 110-814(j) "Garage Sales or Yard Sales" (Ordinance No. 09-2019). The motion carried by the following vote: For: 5 - Chair Burbank, Vice Chair Harper, Member Kennedy, Member Sixma and Member Whittock 9. BOARD/COMMITTEE MEMBERS COMMENTS: 8. STAFF COMMENTS: Mr. Paradise provided a summary of a future agenda item, CDBG Public Service applications ranking. He noted that the City is estimated to receive $583,000.00 from the CDBG program, of which 15 % approximately (approximately $87,000) is to be used for the public service allocation. He stated the city attorney will be present, and will be requesting the Board provide disclosures regarding potential relationships with any applicant. He noted the ranking criteria has been changed to be weighted for homelessness prevention. He stated the City did an Analysis of Impediments and found Homeless Prevention was the number one (1) issue and will be relying on the Board to ensure the applicant's missions are linked to homelessness prevention. Discussion occurred regarding Fernanda Landings construction and Planning and Zoning Board duties related to final plat approval. 10.
