City of Deltona 2345 Providence Blvd. Deltona, FL 32725 Minutes Planning and Zoning Board Thursday, February 24, 2022 6:00 PM Deltona Commission Chambers A. In an effort to reduce the possibility of exposure of residents to the COVID-19 (Coronavirus) we are allowing limited public access into the Commission Chambers and practicing social distancing with the Planning and Zoning Board Members, staff, and residents. 1. CALL TO ORDER: The meeting was called to order at 6:00 pm. 2. ROLL CALL: Present: 7 - Chair Patricia Northey Secretary Allen Pfeffer Member Susan Berk Member Tom Burbank Member Jesus Gonzalez Member Ruben Munoz Alternate Manuel Rodriguez Absent: 4 - Vice Chair Jody Lee Storozuk Alternate Adam Kemmerling Alternate Crystal Lilly Alternate Steven Webster A. Election of Officers Mr. Paradise spoke regarding Election of Officers Section 110-1200 of the City Land Development Code and explained the Planning and Zoning Board is to hold elections on the first calendar year meeting. Secretary Dr. Pfeffer called for nominations for Chairperson. Motion by Tom Burbank, seconded by Susan Berk, to nominate Patricia Northey as Chairperson of the Planning and Zoning Board. Motion by Tom Burbank, seconded by Ruben Munoz, to nominate Ruben Munoz for Vice Chair. The motion carried by the following vote: Against: 7 - Chair Northey, Secretary Pfeffer, Member Berk, Member Burbank, Member Gonzalez, Member Munoz and Alternate Rodriguez Motion by Allen Pfeffer, seconded by Manuel Rodriguez, nominate Member Susan Berk as Vice Chair. The motion carried by the following vote: For: 7 - Chair Northey, Secretary Pfeffer, Member Berk, Member Burbank, Member Gonzalez, Member Munoz and Alternate Rodriguez Chair Northey called for nominations for Secretary. Motion by Patricia Northey, seconded by Tom Burbank, to nominate Dr. Allen Pfeffer for Secretary. The motion carried by the following vote: For: 6 - Chair Northey, Secretary Pfeffer, Member Berk, Member Burbank, Member Gonzalez and Alternate Rodriguez Against: 1 - Member Munoz 3. APPROVAL OF MINUTES & AGENDA: Minutes of December 15, 2021 have no corrections and are filed per Chair Northey. A. Minutes December 15, 2021 4. PRESENTATIONS/AWARDS/REPORTS: City of Deltona Page 2 Printed on 3/17/2022 Planning and Zoning Board Minutes February 24, 2022 None. 5. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the agenda and shall not exceed two minutes. Please be courteous and respectful of the views of others. Personal attacks on Committee/Board members, City staff or members of the public are not allowed and will be ruled out of order by the Chair. Chair Northey opened and closed public forum as there were none. 6. OLD BUSINESS: None. 7. NEW BUSINESS: A. Ordinance No. 05-2022 - amending the Comprehensive Plan of the City of Deltona, by amending the Capital Improvements Element providing for the replacement of the Capital Improvement Project Five Year Schedule. Mr. Paradise presented Ordinance 05-2022, the annual update on the Comprehensive Plan for the City of Deltona, which is a mandate the City is required to do by state. He explained the document is an analysis to ensure the City has financially underpinned its level of service standards for Class A concurrency items, within the comprehensive plan. The Class A concurrency items consists of Solid Waste, Parks, Potable Water, Schools, Transportation, Storm Water, and Waste Water. Discussion occurred regarding a level of service analysis report that is a part of the Capital Improvement update. Mr. Paradise explained based on staff analysis the City has and continues to implement its level of service standards articulated in its Comprehensive Plan. He stated supporting documentation to this report includes excerpts from the City Budget, which is already decided policy. It is not the intent of the process or this public hearing to revisit elements of the budget, which were decided. It upon by the City Commission in September 2021. Secretary Pfeffer stated level of service is technical, and explained there is no record of statistics showing satisfaction level by citizens. He expressed his concerns with complaints regarding the City on social media. Mr. Paradise acknowledged there may be some dissatisfaction regarding service provision and noted that the City in the near future will be working on public scoping in preparation for updates to the Comprehensive Plan. Discussion occurred regarding, an ADA Transitions Plan and past participation in surveys. Chair Northey recommended City Commission send out a survey regarding satisfaction. City of Deltona Page 3 Printed on 3/17/2022 Planning and Zoning Board Minutes February 24, 2022 Mr. Paradise explained level of service could be classified as follows: water pressure issues, trash build up, etc., but would include maintenance items like potholes in area roads. Secretary Pfeffer expressed concern regarding citizen satisfaction with the City. Member Burbank stated citizen satisfaction would be addressed at future public scoping meetings. Chair Northey requested all be notified when the publics scoping starts. Vice Chair Berk asked about the five (5) year census plan population increase. Mr. Paradise noted the City's population is 94,953 with an annual increase of 2.5%. Member Burbank asked if the ADA Transition Plan will require changes to the Land Development Code and if it would come to the Planning and Zoning Board. Mr. Paradise explained changes to the Land Development Code will come to this Board. The ADA Transition Plan will impact road construction and pedestrian facilities. The ADA Transition is going out strategically and analyzing pedestrian facilities that may not be ADA compliant. The plan is to target areas of retrofit. Discussion occurred regarding the ADA Transition Plan related to TPO Grants. Member Rodriguez stated the level of service versus the quality of service needs to be differentiated. Mr. Paradise agreed this could be one way of viewing the level of service, which is independent of this exercise. Member Gonzalez inquired if the City has a long range forecast for sewer systems and if it can withstand an upgrade to the treatment plants. Mr. Paradise stated the City does have a forecast in place. Mr. Paradise explained that the City cannot operate only on grants. Infrastructure revenues are derived from taxes, impact fee, bonds and future revenues. Grants can be used for waste water and water work type of activity and represent a small percentage of roadway improvements. Chair Northey discussed her past experience, explaining when change happens in the economy, the County and City act immediately to adopt policies and processes to accommodate changes within the government. Motion by Ruben Munoz, seconded by Tom Burbank, to recommend the City Commission adopt Ordinance No. 05-2022 and forward it to the Development of Economic Opportunity. STAFF COMMENTS: Mr. Paradise thanked the Board for accommodating the rescheduling of this meeting. He explained the March Planning and Zoning meeting will be held March 23, 2022. The reason for the rescheduling is there are three (3) sitting Members whose terms expire March 15, 2022 and the City Commission meeting will determine membership on March 21, 2022. Mr. Paradise explained a rezoning / quasi-judicial hearing will most likely be on the March Agenda. Chair Northey asked if the rezone coming to the next meeting was Parma Drive. Mr. Paradise said no and explained Parma Drive, Island Walk North, was deferred by the City Commission with the recommendation of staff to remand the rezoning application back to the Planning and Zoning Board for review. 9. BOARD/COMMITTEE MEMBERS COMMENTS: Member Burbank brought up the Food Truck Ordinance, he stated he is not in favor and expressed it does need to be brought back to the Planning and Zoning Board for review and comment, due to the significant number of changes since the first presentation of the Ordnance. Secretary Pfeffer stated he voted against the Capital Improvements Element (CIE) because the service issue needs to be addressed. Chair Northey suggested talking to the City Commission regarding the resident satisfaction survey. Secretary Pfeffer asked if he was able to speak with City Commission without violating the Sunshine Law. City Attorney Segal-George stated the Board can communicate with the City Commission through email or come to a City Commission meeting to speak. The Board cannot talk with other members of this Board regarding potential applications. Member Munoz asked after an Ordinance is approved, if it can be discussed. City Attorney Segal-George explained projects can be discussed once approved as long as if it never comes back before the Board. If there is a particular issue that could possibly come back for further voting, then no, it cannot be discussed. She stated based on what was presented before there were issues and concerns causing a redesign to take place. She explained, what was presented before will not be the same at the next presentation. Ms. Segal-George directed members to speak with the Planning and Zoning Board administration. 10. Another top priority is being able to maintain public participation in our City meetings.
