Wednesday, March 30, 2022 6:00 PM Deltona Commission Chambers
A. In an effort to reduce the possibility of exposure of residents to the
COVID-19 (Coronavirus) we are allowing limited public access into the
Commission Chambers and practicing social distancing with the Planning
and Zoning Board Members, staff, and residents.
1. CALL TO ORDER:
The meeting was called to order at 6:00 pm.

A. Election of Officers
Chair Northey nominated Jody Lee Storozuk as Vice Chair. The motion
carried unanimously.
3. APPROVAL OF MINUTES & AGENDA:

4. PRESENTATIONS/AWARDS/REPORTS:

5. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the
agenda and shall not exceed four minutes. Please be courteous and respectful of the
views of others. Personal attacks on Committee/Board members, City staff or
members of the public are not allowed and will be ruled out of order by the Chair.
Chair Northey opened and closed public forum as there were none.
6. OLD BUSINESS:
None.
7. NEW BUSINESS:
A. ORDINANCE NO. 07-2022 AN ORDINANCE OF THE CITY OF DELTONA,
FLORIDA, AMENDING THE OFFICIAL ZONING MAP TO REZONE ±39.36
ACRES OF LAND LOCATED ON THE EAST SIDE OF ALEX LANE FROM CITY
OF DELTONA SINGLE FAMILY CLASSIFICATION (R1-A) TO RESIDENTIAL
PLANNED UNIT DEVELOPMENT (RPUD); PROVIDING FOR CONFLICTS,
PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE
DATE.
Mr. Paradise explained this is a quasi-judicial meeting due to the rezoning application and
would be turning the meeting over to City Attorney Segal-George.
City Attorney Segal-George asked for all members of the public who intended to speak
during Public Participation on the rezoning to please stand to be sworn in. She asked if any
Board members had any exparte communication regarding the rezoning application.
Vice Chair Storozuk stated he visited the property. Chair Northey stated she visited the site,
viewed the zoning signs, and spoke with Mark Watts.
All other Board members did not have any exparte communication.
Mr. Paradise explained this area is currently forested, and there are four (4) areas of
wetlands on site.
He stated the applicant has presented a lot size transition with larger lots on the outside,
approximately 13,000 sq. ft., to smaller lots towards the middle of the subdivision. He
explained the Development Agreement states the developer will build a lake overlook,
overflow parking, and a trail, which will be managed by a HOA.
Mr. Paradise explained the applicant is asking for 126 lots but with the current zoning, the
applicant could build approximately 100 lots. He stated the developer would be bringing
sewer and water to the site, and a pioneer agreement with the City is already in place.
There is enough school capacity, and per the Traffic Impact Analysis (TIA) the current roads

can handle the projected trips from this subdivision.
He reminded the Board the applicant is only requesting an extra 26 units.
Mr. Paradise explained the developer would be required to put sidewalks on Barger Drive,
Alex Lane, and Tradewinds Drive. He stated staff recommends the Planning and Zoning
Board recommend the City Commission approve Ordinance No. 07-2022.
He explained the developer plans on protecting or moving gopher tortoises. He stated the
developer may be responsible for improving access roads.
Discussion occurred regarding the Volusia County School Board counts provided. Chair
Northey requested to have a planner from Volusia County School Board speak to the
Planning and Zoning Board regarding their school capacity process.
Chair Northey asked questions regarding the current buffers and asked when a map of
gopher tortoises and scrub jays would be done. Mr. Paradise explained mapping is done
during the preliminary plat process and the City does not allow developers to harm gopher
tortoises.
Discussion occurred regarding the wetlands being repurposed for the subdivision and lake
access for residents.
Michael Woods, Cobb Cole, explained this is an infill project with 3.27 dwelling units per
acre. He spoke regarding the TIA and proportionate fair share analysis. He explained this
subdivision would bring sewer to the area and spoke regarding the gopher tortoise survey.
Secretary Pfeffer expressed concern regarding emergency access.
Discussion occurred regarding the amenities.
Chair Northey opened public comments.
Heather de Rose, 781 Barger Dr., expressed concern regarding access roads, lack of
sidewalks, traffic, and safety for children.
Joshua de Rose, 781 Barger Dr., expressed concern regarding the current traffic going
down Barger Dr. He asked for clarification regarding sewer, and sidewalks. He asked if
local hospitals can handle more residents in the area.
Pamela Braun, 788 Adler Dr., spoke regarding the current wildlife on this property
explaining there are black bears, scrub jays, and gopher tortoises. She asked if a traffic
light could be put in this area because there are already accidents on Fort Smith Blvd.

Jose Echevarria, 497 Tradewinds Dr., expressed concerns regarding traffic, sewer, and
disrupting the wildlife. He stated the proposal is not compatible with the area.
Dean Napolitano, 810 Alex Ln., spoke regarding the wildlife on the property and stated
there is a gopher tortoise nest where the developer is proposing the street.
Alvin Walker, 2088 Monterey Dr., expressed concerns regarding traffic and safety.
Miguel Rivera, 711 E. Lehigh Dr., stated there would be safety issues with the traffic. He
asked how the developer plans on protecting the scrub jays. He stated he would appeal this
application. Chair Berk explained the Planning and Zoning Board is a recommendation
Board, and the City Commission makes the final decision.
Edwin Diaz, 891 Adler Dr., stated he would like to leave the property how it is and he has
concerns for traffic, wildlife, and children in the area.
Nixa Hernandez, 891 Adler Dr., explained this would do a lot of damage to the area. She
expressed concerns about traffic, sewer, and wildlife being disturbed.
David Goldstiek, 780 Barger Dr., expressed concern regarding traffic and adding
sidewalks. He stated he did not agree with the TIA.
City Attorney Segal-George swore in more members of the public who wanted to speak.
Elizabeth Walker, 2088 Monterey Dr., expressed concerns regarding traffic.
Ken Thompson, 785 Barger Dr., spoke regarding traffic and sewer concerns.
Chair Northey closed public forum.
Mr. Paradise explained this property has been zoned R1-A for many years and was going
to be developed in 2015 but there were wastewater issues. He explained the mail outs
were sent to all residents within a 300 ft. radius.
Mr. Woods explained there was a public scoping meeting 18 months ago. He spoke
regarding the neighborhood's traffic concerns and explained the developer is not obligated
to fix the existing roads, but only to try to make them a little better.
Chair Northey suggested the public expressed their concerns regarding traffic in the area
when speaking in front of the City Commission.
Mr. Paradise explained there are Right-of-Ways on all properties which is where the sewer

would be located.
Mr. Woods explained the project is expected to have an 18-month build-out time.
Mr. Rowley, Zev Cohen, explained an environmental habitat survey of 100% of the property
would be done 90 days before they started building to ensure accuracy.
Discussion occurred regarding the size of the proposed homes.
Mr. Paradise explained with the applicant going through the RPUD rezoning process, this
allows the City to set forth conditions and obligations in a Development Agreement. If they
just build the 100 homes that are allowed, they would not have to provide extra amenities.
Chair Northey explained smaller lots are more popular now and asked for residents to
express their concerns with the roads and traffic at the City Commission Meeting.
Secretary Pfeffer asked for the whole building process after the rezone.
Mr. Paradise explained the applicant would need to apply for a Preliminary Plat Application
next, which is reviewed by staff, and once approved by the Development Review
Committee the applicant has a Development Order which allows clearing and grading. The
Final Plat application allows the applicant to build homes but this has to be brought in front
of the City Commission for approval.
Motion by Jody Lee Storozuk, seconded by Allen Pfeffer, to
recommend the City Commission deny Ordinance No. 07-2022. The
motion carried by the following vote:
For: 5 - Member Storozuk, Secretary Pfeffer, Member Munoz,
Alternate Amoroso and Alternate Berk
Against: 2 - Chair Northey and Member Alexander
Member Alexander explained he is in favor of the rezone because it is consistent with the
Future Land Use Map.
Alternate Berk stated there are too many traffic issues and concerns with the environment.
Alternate Amoroso stated she is for the denial of the project.
Member Munoz said he voted against the project because of the environment, density, and
traffic concerns.

Secretary Pfeffer stated with the traffic concerns he cannot recommend the project for
approval.
Vice Chair Storozuk stated the development would not be fair to the current neighborhood
and the issues with the streets need to be addressed.
Chair Northey stated she is in favor of the development because it meets the City's criteria
and would better serve the City as a RPUD.

The Planning and Zoning Board is dedicated to working hard and
keeping our City moving forward and a top priority during the
COVID-19 pandemic is to help maintain the health of our employees
and residents. Another top priority is being able to maintain public
participation in our City meetings. Following CDC Guidelines, we are
allowing limited public access into the Commission Chambers and
practicing social distancing with the Planning and Zoning Members,
staff, and residents. Though there are restrictions when it comes to
public gatherings, we are dedicated to making sure those who would
like to make their voice heard are able to.
Please note your public comments can be submitted via one of the
following mediums no later than Noon, March 28, 2022, to ensure they
are available for the Board Members to review prior to the meeting.
