A. In an effort to reduce the possibility of exposure of residents to the
COVID-19 (Coronavirus) we are allowing limited public access into the
Commission Chambers and practicing social distancing with the Planning
and Zoning Board Members, staff, and residents.
1. CALL TO ORDER:
The meeting was called to order at 6:00 pm.

5. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the
agenda and shall not exceed two minutes. Please be courteous and respectful of the
views of others. Personal attacks on Committee/Board members, City staff or
members of the public are not allowed and will be ruled out of order by the Chair.

A. Ordinance No. 11-2022 - an Ordinance of the City of Deltona to amend the
official zoning map to rezone ±197 acres of land located east of SR 415 and
west of Keelhaul Road from County zoning classifications RC, A-1, and RA
to City of Deltona Business Planned Unit Development (BPUD) for the
purposes of an excavation.
Mr. Paradise stated that Ordinance No. 11-2022 is a request for 197 acres to be rezoned
from Volusia County A-1, RC,and RA to City of Deltona Business Planned Unit
Development (BPUD). The property will be used as a borrow pit. However only a small
percentage of the 197 acre property will be excavated.
The property is located east of SR415 and is owned by the Pell family. This property is
located in the Osteen Joint Planning Area (JPA). The County has approved the excavation
on the neighboring property owned by Susan McCaskill. There is a condition put forth by the
County that the City must approve the BPUD before the McCaskill property can be
excavated.
Approximately 1.2 million cubic yards of fill will be removed from both the Pell and
McCaskill properties. The site use will have a life span of five (5) years and then the site will
be reclaimed. Afterwards the area will not be available for urban or suburban uses.
An estimated 400 heavy truck trips a day will enter and exit from this site.
Discussion occurred regarding access, hours of operation, and traffic flow.
Mr. Paradise stated City Staff recommend the Planning and Zoning Board recommend, the
City Commission approve Ordinance No. 11-2022.
Discussion occurred regarding setbacks, access, possible excavation noise, truck trips,
and a large wetland system known as the Savanna.
Member Gonzalez asked if fill from this site would only be used in Deltona, Mr. Paradise
replied no.
Vice Chair Storozuk asked for clarification on the amount of acreage being utilized and the
monitoring of the excavation site.

Alternate Berk inquired about the 50 foot buffers - noting the County approved 100 foot
buffers and pointing out consistency is important. Mr. Paradise stated the 100 foot buffers
are wetland buffers and the City and County codes are almost identical when it comes to
excavations.
Mr. Paradise stated the Development Agreement will be updated to reflect a 6:00 am start
to coincide with the County's agreement.
Chair Northey pointed out the JPA has to be done under a Business Planned Unit
Development (BPUD), the County did it with a special exception.
Discussion occurred regarding the County's process and the requirements being
standardized.
Alternate Berk asked about the number of truck trips the City has versus the County's which
were less. Mr. Paradise stated that a Traffic Impact Analysis (TIA) combined all trips which
will be capped at 400 trips per day.
Alternate Rodriguez asked if future urban development could be done here, Mr. Paradise
stated the only area that could be developed will be converted to open water after the
excavation.
Discussion occurred regarding the possibility for public use after the five (5) years,
Mr. Glenn Storch from Storch Law Firm, 420 South Nova Road, Daytona Beach, FL 32114,
thanked everyone in attendance. Mr. Storch stated the entire excavation consists of 386
acres in total between the Pell and McCaskell properties. Mr. Paradise stated these uses
are well monitored. St. Johns River Water Management District permits are extensive.
Mr. Dowst from Mark Dowst & Associates, Inc., 536 N. Halifax Avenue, Daytona Beach, FL
32118, spoke regarding excavating. He explained they will dewater before digging the pits
for future lakes.
Discussion occurred regarding how the excavation would proceed, phasing, site
management, bonds and the long term traffic impact on both Doyle Road and SR 415.
Mr. Clarke, Apex Trucking, confirmed the property would be fenced and gated. He stated
management would be available 24 hours a day.
Mr. Storch confirmed the permitting will take another year. He stated he would go back to,
the traffic engineer to create a safe way for traffic to enter on Doyle Road and SR 415.
Discussion occurred about safety, traffic lights, and the effect the truck traffic is going to
have on the area and roads.

Mr. Dowst stated there will be plenty of signage stating 'Trucks entering and exiting road',
and explained
SR 415 is a four (4) lane road, which should allow plenty of movement.
Mr. Storch spoke regarding natural lake areas remaining untouched. He stated he would
speak with the client to put a conservation easement on the Savanna wetland system on the
property and will work with the residents.
Discussion occurred regarding a bond being put in place.
Mr. Storch thanked the Board.
Motion by Jody Lee Storozuk, seconded by Manuel Rodriguez, to
recommend the City Commission approve Ordinance No. 11-2022. The
motion carried by the following vote:
For: 6 - Chair Northey, Vice Chair Storozuk, Secretary Pfeffer,
Member Gonzalez, Alternate Berk and Alternate Rodriguez
8. STAFF COMMENTS:
Mr. Paradise noted that he is going to invite Ms. Stephanie Doster with the Volusia County
School Board to a Planning and Zoning Board meeting to discuss matters of concern
regarding local schools and student body population within the City.

The Planning and Zoning Board is dedicated to working hard and
keeping our City moving forward and a top priority during the
COVID-19 pandemic is to help maintain the health of our employees
and residents. Another top priority is being able to maintain public
participation in our City meetings. Following CDC Guidelines, we are
allowing limited public access into the Commission Chambers and
practicing social distancing with the Planning and Zoning Members,
staff, and residents. Though there are restrictions when it comes to
public gatherings, we are dedicated to making sure those who would
like to make their voice heard are able to.
Please note your public comments can be submitted via one of the
following mediums no later than Noon, April 18, 2022, to ensure they
are available for the Board Members to review prior to the meeting.
