City of Deltona 2345 Providence Blvd. Deltona, FL 32725 Minutes Planning and Zoning Board Wednesday, May 18, 2022 6:00 PM Deltona Commission Chambers A. In an effort to reduce the possibility of exposure of residents to the COVID-19 (Coronavirus) we are allowing limited public access into the Commission Chambers and practicing social distancing with the Planning and Zoning Board Members, staff, and residents. 1. CALL TO ORDER: The meeting was called to order at 6:00 pm. 2. ROLL CALL: Present: 8 - Chair Patricia Northey Vice Chair Jody Lee Storozuk Secretary Allen Pfeffer Member Eric Alexander Member Susan Berk Member Jesus Gonzalez Member Ruben Munoz Alternate Manuel Rodriguez Absent: 1 - Alternate Rachel Amoroso 3. APPROVAL OF MINUTES & AGENDA: A. Minutes of April 20, 2022 Minutes of April 20, 2022 have no corrections and are filed as proposed per Chair Northey. 4. PRESENTATIONS/AWARDS/REPORTS: 5. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the agenda and shall not exceed four minutes. Please be courteous and respectful of the views of others. Personal attacks on Committee/Board members, City staff or members of the public are not allowed and will be ruled out of order by the Chair. Chair Northey opened and closed the public forum. Temporary Moratorium on the Acceptance of New Rezoning's Applications - Density Increase Mr. Paradise presented Ordinance No. 12-2022 as a Moratorium on increased residential density beyond existing residential entitlements. He explained this is a land use matter and consistent with Section 110-1200 of the Land Development Code (LDC), this item should be heard by the P&Z Board. He stated the Moratorium will only impact density increase requests that involve single family detached projects. Mr. Paradise explained the proposed Moratorium is set to take place from July 1, 2022 and terminates on January 1, 2023. He explained projects already being reviewed by the Planning and Development Department will be exempt. He stated the goal of the Moratorium is for the City to engage in thorough public scoping, that is intended as a foundation for changes to City Policy and the City LDC. The scoping topics are to promote more sustainable development patterns and functional residential forms, encourage greater land use compatibility, enhance environmental safeguards, improve general knowledge of the application of residential density, and address general growth management laws and policies within the state of Florida. He stated there are some project that, may be granted administrative exemptions that are small in nature and do not involve sensitive elements such as flood plains, wetlands, or a detached residential area that is known to be part of a mixed use development. May be exempt. Discussion occurred regarding possible changes to the Land Development Code (LDC) and Comprehensive Plan Policy (CPP), public scoping, and how the City plans to reach out to the citizens. Motion by Jody Lee Storozuk, seconded by Ruben Munoz, to recommend the City Commission approve Ordinance No. 12-2022. The motion carried by the following vote: For: 7 - Chair Northey, Vice Chair Storozuk, Secretary Pfeffer, Member Alexander, Member Berk, Member Gonzalez and Member Munoz B. Ordinance No. 13-2022 - An Ordinance of the City of Deltona, Florida, for a major amendment to the Fernanda Place Residential Planned Unit City of Deltona Page 2 Printed on 7/20/2022 Planning and Zoning Board Minutes May 18, 2022 Development (RPUD) to add and rezone two (2) parcels totaling ±43.55 acres of land located south of Fernanda Drive and east of Pine Ridge High School. Currently zoned City of Deltona agriculture classification (A) to RPUD; providing for conflicts, providing for severability and proving for an effective date. Mr. Paradise turned the meeting over to City Attorney Segal-George for an explanation of quasi-judicial hearing processes, including standing. There was one (1) resident with standing who was sworn in. Chair Northey asked each Board Member to state their ex-parte communication. Chair Northey and Member Berk stated they both had visited the site. All other members stated they did not have any ex-parte communication. Mr. Paradise stated the proposal is for 152 single family dwelling units located on the +43.55 acre tract of Phase 3, and explained there will be no access to Osteen Cemetery Road. Mr. Paradise stated the minimum lot size is 5,250 square feet, but most lots are 6,000 square feet. He stated there will be a dog park and overflow parking with 26 parking spaces added for all owners to utilize. A fully signalized light at Fernanda Drive and Howland Boulevard is required for safe ingress and egress. The Developer has stated they are willing to allocate $100,000.00, toward a study for affordable housing needs, as a way to address those needs within the City. Discussion occurred regarding the current parking issues within Phase 1 and 2 of Fernanda Place. Discussion occurred regarding the past excavation on this site, amenities, and current conditions. Michael Woods, Cobb Cole, presented a PowerPoint Presentation on Fernanda Place Phase 3. He stated the project meets all requirements for the Volusia County School Board. He explained the past excavation area will be restored and the original Residential Planned Unit Development (RPUD) did not require additional parking. He stated a fully signalized light at Fernanda Drive and Howland Boulevard will be installed and an additional pool will be added. Tina Lee, Starlight Homes, spoke regarding a 60 foot Right-of-Way (ROW) for safety at New York Avenue. A stub out on Trade Street allowing access to State Road (SR415) from Fort Smith Boulevard, will also be added. She explained the ponds will be brought up to code as Phase 3 is developed. Discussion occurred regarding access and parking. City of Deltona Page 3 Printed on 7/20/2022 Planning and Zoning Board Minutes May 18, 2022 Vice Chair Storozuk spoke regarding Clarion Street and traffic during school drop off and pickup, and emergency access on Osteen Cemetery Road. Discussion occurred regarding the Pride Elementary connection on New York Avenue and the proposed dog park. Chair Northey opened the public forum. Jennifer Sutton, 1028 Landing Lane, spoke regarding her concerns with the current parking and traffic. Lew Lang, 1017 Landing Lane, spoke regarding parking, traffic issues, and stated a traffic signal at Fernanda Drive and Howland Boulevard is imperative for safety. Maria Ramos, 1027 Landing Lane, spoke regarding parking, wildlife and current traffic concerns. She stated the pool needs to be in a different area because there are parking issues already. Ferdinand Ramos, 1027 Landing Lane, stated he has concerns with wildlife, traffic and the drop off of elementary students. The size of the pool is small for the size of the community, and the Fernanda Drive and Howland Boulevard traffic signal for safety is a must. Luis Vargas, 1058 Wanderer Drive, spoke regarding his concerns on traffic, stating delivery drivers have difficulty maneuvering around vehicles parked on the street. He stated there are speeding issues that will only get worse with people and vehicles increasing. Hope Yancey, 1066 Wanderer Drive, explained her frustration of having to replace tires due to past construction in the community and traffic concerns. Sheryl Brown, 3755 Camby Street, spoke regarding her concerns with speed bumps and she does not welcome the extra traffic. Leon A. Pike, 811 Osteen Cemetery Road, requested a wall to prevent egress on to Osteen Cemetery Road. Alejandro Corrales, 3526 Fernanda Drive, expressed his concerns with traffic, residents parking on streets, and the one (1) main access road. Chair Northey closed public forum. Mr. Woods stated there is no intent to increase problems, and indicated it is the intent to address concerns. He explained an alternate for student drop off needs to be addressed, alleviating congestion is a priority, and suggested parking enforcement being implemented. City of Deltona Page 4 Printed on 7/20/2022 Planning and Zoning Board Minutes May 18, 2022 Tina Lee stated a neighborhood meeting was held four (4) to five (5) months ago. Vice Chair Storozuk stated Phase 1 and 2 issues should be addressed before Phase 3 begins. Tina Lee stated the round about is intended to alleviate parent drop off and explained they are not obligated to fix the issues with Phase 1 and 2. Ms. Segal-George confirmed Ordinance No. 13-2022 will go to the City Commission June 20, 2022. Motion by Jody Lee Storozuk, seconded by Ruben Munoz, to recommend the City Commission deny Ordinance No. 13-2022. The motion carried by the following vote: For: 5 - Vice Chair Storozuk, Secretary Pfeffer, Member Alexander, Member Gonzalez and Member Munoz Against: 2 - Chair Northey and Member Berk 8. STAFF COMMENTS: Mr. Paradise noted there will not be a Planning and Zoning Board meeting in the month of June. The invite to Ms. Stephanie Doster with the Volusia County School Board (VCSB) has been acknowledged tentatively agreeing to attend the Planning and Zoning Board meeting in July. 9. BOARD/COMMITTEE MEMBERS COMMENTS: Chair Northey voted for Phase 3 because there are advantages and this is a pattern of development in the area. Vice Chair Storozuk voted to deny stating he has wildlife concerns. He stated the development is incompatible with the area and movement of emergency vehicles is already restricted. Secretary Dr. Pfeffer voted to deny because the current issues which are not addressed. Member Alexander voted to deny and suggested a redesign of Phase 3. He stated there were issues with access and the pool needs to be relocated. Member Berk voted for Phase 3 providing the outstanding issues be addressed, including new roadways in and out of the development, additional parking, a traffic signal, relocation of the pool to Phase 3 and the City hold everyone to task for what needs to be addressed. Also noted the provision to address efforts of Affordable Housing by contributing the City of Deltona Page 5 Printed on 7/20/2022 Planning and Zoning Board Minutes May 18, 2022 $100,000.00. Member Munoz voted to deny the development because he is concerned with the density of the area, traffic, and the current issues not being addressed. Member Gonzalez voted to deny stating the egress is an issue, as well as traffic and parking. Mr. Paradise confirmed this agenda item will go before the City Commission on June 20, 2022. 10.
