1. CALL TO ORDER:
The meeting was called to order at 6:00 pm.
2. ROLL CALL:
For the record Jesse Gonzalez is no longer on the Board and it needs to be communicated
to the Commission.

3. APPROVAL OF MINUTES & AGENDA:
A. Minutes of July 20, 2022
Minutes to be filed with no changes per Chair Northey.
4. PRESENTATIONS/AWARDS/REPORTS:
None.
5. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the
agenda and shall not exceed two minutes. Please be courteous and respectful of the
views of others. Personal attacks on Committee/Board members, City staff or
members of the public are not allowed and will be ruled out of order by the Chair.
Public forum was opened and closed as there were none.

7. NEW BUSINESS:
A. Ordinance No. 17-2022 - An Ordinance of the City of Deltona, Florida,
Amending the Official Zoning Map to rezone ± 5.3 acres of land located at
the northwest corner of the intersection of Howland Boulevard and Forest
Edge Drive from Agriculture (A) and Single Family (R1) to Business
Planned Unit Development (BPUD); providing for conflicts, providing for
severability and providing for an effective date.
Mr. Paradise explained Ordinance 17-2022 is to rezone 5.3 acres of land from agriculture
and R-1 single-family to business planned unit development. He stated this is a
quasi-judicial hearing and asked for all members to provide a rationale for their vote..
Attorney Segal-George swore in everyone who wished to speak regarding the subject
property. She turned the meeting over to Chair Northey who asked each member if they had
any ex-parte communication regarding Ordinance 17-2022.
Alternate Rodriguez, Member Alexander, Member Munoz, and Secretary Pfeffer stated they
did not have any ex-parte communication and did not visit the site.
Member Berk stated she visited the site.
Vice Chair Storozuk stated he visited and walked the site.
Chair Northey said she drove the roadways near the site.
Mr. Paradise stated the property is located is within the Activity Center and any
development in the Activity Center has to be processed through a Planned Unit
Development Rezoning. The proposal is to create three (3) lots and they will have three (3)
drive-through restaurants and one (1) small retail office space. He explained the goal is to
limit the uses allowed and keep them compatible with nearby single-family development.
Mr. Paradise explained the applicant plans on purchasing the closest home and lot to utilize
it for a buffer and stormwater management. He discussed access, driveway cuts, and
safety. He stated the project would generate approximately 1,900 additional trips on the
City roadway network. To manage the traffic, a right turn lane will be constructed on Forest
Edge to Howland Blvd. and there will be an approximately $160,000 in fair share payment
to Volusia County
City staff recommends the Planning and Zoning Board recommend the City Commission
approve the Howland Boulevard Marketplace Business Planned Unit Development
because the request is consistent with the Comprehensive Plan, meets economic goals for
the City, and the City has the infrastructure in place to support the project.
Discussion occurred regarding pedestrian crosswalk safety concerns and buffers.

The Board suggested crosswalk for Deltona High students in the area who would utilize this
project.
Mark Watts, 231 Woodland Blvd., spoke regarding the history of the property and the
current Agricultural Zoning. He spoke regarding the Ford and Deltona Holdings ownership
and buying the single-family home for extra buffering. He stated Tijuana Flat's and Popeyes
Chicken would like to come into this development.
Mr. Watts addressed pedestrian safety and stated he would work with both the City and
County.
Discussion occurred regarding internal circulation, pedestrian access, and buffers.
Chair Northey opened public forum.
Tina Wright Stewart, 3246 Scenic Woods Dr., expressed her concerns about privacy in her
pool since she lived on a corner lot. She stated her son uses the pool for physical therapy
and her five (5) foot fence would not provide enough privacy for the family with added traffic
from the development.
Carmidaris Rivera Vega, 3244 Boxelder St., expressed concerns with traffic from the
proposal. She stated people already use her driveway to turn around for school. She stated
the neighborhood is very busy with walkers, especially during different holidays.
Attorney Segal-George swore in two (2) members of the public who wanted to speak.
Alison Loiacono, 3241 Kings Ridge, explained Halloween is a huge holiday for the
neighborhood and people come from all over Deltona come to walk to the neighborhood.
She explained Deltona High is very busy and it concerns her because the added trips could
create a potential for a lot of accidents.
Marco Loiacono, 3241 Kings Ridge, expressed concerns about traffic. He explained he is
a claims adjuster and believes using Forest Edge for this development may cause
accidents. He explained the road is not very long and traffic will back up.
Chair Northey closed the public forum.
Mr. Watts explained the County will not let the development connect to Howland so they
have to connect to local roads.
Chair Northey requested the applicant look at the widths of the sidewalks to ensure there is
enough space for families to walk.

Pete Pensa with the Avid Group spoke regarding the internal layout. He spoke regarding
the traffic study including traffic generation and traffic distribution.
Motion by Jody Lee Storozuk, seconded by Eric Alexander, to
recommend the City Commission approve Ordinance No. 17-2022 - An
Ordinance of the City of Deltona, Florida, Amending the Official Zoning
Map to rezone ± 5.3 acres of land located at the northwest corner of the
intersection of Howland Boulevard and Forest Edge Drive from
Agriculture (A) and Single Family (R1) to Business Planned Unit
Development (BPUD); providing for conflicts, providing for severability
and providing for an effective date.. The motion carried by the following
vote:
For: 7 - Chair Northey, Vice Chair Storozuk, Secretary Pfeffer,
Member Alexander, Member Berk, Member Munoz and
Alternate Rodriguez
Member Alexander stated he voted for the development because it is in the Activity Center.
Member Berk stated she voted for the development because it is a retail use and the
applicant will have to follow the Development Agreement. She knows City staff will ensure
student and pedestrian safety during the Land Development processes.
Member Munoz stated traffic will always be a concern whether it is residential or
commercial being built, so he is voting yes to the development.
Alternate Rodriguez explained he's in favor of the project because the property owners have
the right to build on their land and this will add needed revenue to the City.
Secretary Pfeffer stated he is voting yes because the City has voted to approve large
projects for employment in this area and to balance it, resturants/service is needed.
Vice Chair Storozuk stated he is voting yes for this project because he believes this will
attract a big chain restaurant that the City would want in this neighborhood. He explained
that once you put in chains bigger chains will see the income of the smaller chains and want
to come into Deltona.
Chair Northey stated she votes yes because it meets all stipulations in the Comprehensive
Plan and believes Mr. Watts will address all the safety issues and including widening the
sidewalks.

9. BOARD/COMMITTEE MEMBERS COMMENTS:
Member Munoz requested the members receive the same notice letters that are mailed out
to residents for each meeting.
Chair Northey stated it would be helpful if the City Commission would issue Planning and
Zoning Board members IPAD's for the Planning and Zoning Board meetings.
