BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING SEPTEMBER 20, 2016 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, September 20, 2016 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Jerome Lister, St. Walden Missionary Baptist Church, then led in prayer, afterwhich Commissioner Newsome led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of September 6, 2016, be approved, motion seconded by Commissioner Kenward and unanimously approved. Mayor Schmitz acknowledged Public Works Director Jerry Corbin, who recently returned to work and is recovering from injury, as being present today and he officially welcomed him back. Mayor Schmitz presented and read a proclamation, proclaiming September 26, 2016 as “Family Day – A Day to Eat Dinner with Your Children.” Susan Trawick, Dothan-Houston County Substance Abuse Partnership (DHCSAP), and Kimberley Guiler, DHCSAP Youth Council Member and Northview High School Junior, were present for the proclamation. Commissioner Dorsey thanked all the department heads and Administration staff for providing their assistance to him with citizen calls, and he commended them for a job well done. Commissioner Kirkland said the couple who passed away in a recent house fire was long-time friends of his, and he requested Fire Battalion Chief Chris Etheredge to talk about the efforts of the Dothan Fire Department (DFD) to promote and install smoke detectors. Commissioner Kirkland added that his youngest son had a house fire approximately twelve years ago and a smoke detector saved his life. Fire Battalion Chief Etheredge said the DFD has operated a free smoke detector program for the past eighteen years and this program is completely supported by citizen donations and grant dollars. He explained that the chances of surviving a home fire are 200 percent greater if you have a working smoke detector in the sleeping areas of your home. He said smoke detectors truly do save lives and our fire chief’s goal is to make sure there is a working smoke detector in every home in Dothan. He encouraged residents to call 615-FIRE to have the DFD come out and install a smoke detector. Commissioner Ferguson reminded everyone that he will be having a community forum tonight from 6:00 p.m. until 7:00 p.m. at Ridgecrest Baptist Church on the second floor in the Family Life Center. He invited everyone to attend. Commissioner Kenward said churches from across our community gathered in a celebration at the Dothan Civic Center last Wednesday and it was an incredible experience to see people of different faiths and races and socioeconomic backgrounds come together. She said she has never had 3,100 people pray for her simultaneously and that was a very humbling experience. She said this is part of what makes Dothan so special and she thanked everyone who attended for being a part of this event. She said she hopes this is the first of many to come. Commissioner Crutchfield reiterated Commissioner Dorsey’s sentiments regarding assistance received from the department heads and Administration staff. He said Minutes of the Board of Commissioners – September 20, 2016, continued. he appreciates their help and response so that we can get answers to the citizens who are asking us questions. Mayor Schmitz called up Police Chief Steve Parrish to give an update on the Dothan Police Foundation. Chief Parrish requested Foundation Board Chairman Bob Woodall to join him at the podium. Chief Parrish stated that the Foundation’s bylaws have been made available, and he thanked the Commission for their support. He advised that he and Mr. Woodall would like to come before the Commission approximately every October to provide an update on the Foundation’s activities. Mr. Woodall said the Foundation has held their first meeting and hit the ground running. He said they are designing a new website and developing a brochure for distribution. He said he previously introduced board members Carmen Adams, Susan Anderson, Stanley Davis, Mark Dunning, Mark Saliba, and Wayne Palmer at the August 16th City Commission meeting, and at that time, there were two spots remaining. He said it is now his pleasure to introduce additional board members Janasky Fleming and Kristopher Doss. Mr. Woodall said the Foundation’s Board is now complete and the Foundation offers an opportunity for the community to invest in itself by donating to the nonprofit organization. He said the Foundation is committed to helping the community through the Community First Initiative, the Police Education and Training Program, and the Pro-Life Animal Services Program. He said the Board is looking forward to the completion of the community survey partnership between the City, the Dothan Cultural Relations Group, and Troy University, and it is the Board’s hope to contribute to the community’s needs once those needs are identified. Mayor Schmitz provided an update on Steve Hardwick’s efforts to bring the Angel of Hope statue to Dothan. He said the Commission has been very involved in this endeavor, a great location for the statue has been found, and Mr. Hardwick is within a week of raising the money. Mayor Schmitz said local contractor and businessman Ricky Saliba is helping with the foundation, and City Manager West advised that Assistant Public Works Director Charles Metzger will meet Mr. Saliba on site to coordinate the placement. Mayor Schmitz thanked everyone involved for their assistance in painting the City Gold for the month of September. He said this effort is to bring awareness to the fact that only four percent of all funding goes to childhood cancer research. Mayor Schmitz requested everyone to keep Robert Crowder, Executive Director of Southern Alabama Regional Council on Aging (SARCOA) and past Houston County Commission Chairman, in their prayers as he is going through some very serious health issues. Mayor Schmitz announced that Glasstream Powerboats is adding another fifty jobs and doing an expansion right now. He said we are proud of this expansion and grateful for these jobs, and he expressed appreciation for the community’s participation in the recent job fair. City Manager West, along with Police Chief Steve Parrish, presented a service award to Captain Stacy Robinson for twenty-five years of service with the City. City Manager West, along with Chief Parrish and Captain Robinson, recognized Mr. James E. Johnson for ten years of service as a Police Department Volunteer. City Manager West invited Senior Civil Engineer Ernie Stokes to provide an update on the landfill and permitting process. Mr. Stokes said the City will resubmit all permit modification information to Alabama Department of Environmental Management in a few weeks, a public hearing will follow, and this will start the process to move forward with the expansion. City Manager West explained that the entire property was resurveyed to ensure that all adjoining property owners were identified and this is why the process is taking a little longer than anticipated. City Manager West made the following announcements: • The Forever Wild Trails Grand Opening is Saturday, October 1st and everyone is invited to attend. Minutes of the Board of Commissioners – September 20, 2016, continued. • The City of Dothan is a pacesetter for the United Way campaign and employees have exceeded their goal again this year. • A “How to Do Business with the City of Dothan” free workshop will be held on Tuesday, October 4th in the City Commission Chambers. Networking begins at 5:30 p.m. and the program begins at 6:00 p.m. Call 615-3154 to register for this event. • The Troy University Drama Department will perform Flyin’ West at the Dothan Opera House at 7:00 p.m. on Tuesday, October 4th. This is a free event and attendance is encouraged as we would like Troy University to continue to bring their performing arts to Dothan. Please call 615-3175 to make reservations. • The October 4th City Commission meeting has been cancelled due to lack of quorum because a majority of members will be in Washington, D.C. attending the annual Association of the United States Army Convention. Mayor Schmitz introduced the application of Charles Teel for a Retail Beer License (on or off premise) for Chuck’s Billiards, located at 110 East Crawford Street. Commissioner Newsome moved for approval, motion seconded by Commissioner Kirkland. Mayor Schmitz asked if there was anyone present to speak on this matter and there were none. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Schmitz confirmed that the applicant was present. Mayor Schmitz introduced the application of Jeff Groover for a Retail Beer and Retail Table Wine License (off premise) for Hobo Pantry 32, located at 4468 West Main Street. Commissioner Newsome moved for approval, motion seconded by Commissioner Kirkland. Mayor Schmitz asked if there was anyone present to speak on this matter and there were none. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Schmitz confirmed that the applicant was present. Mayor Schmitz introduced the application of Aaron Palmer for a Special Retail License – More than 30 days (on or off premise) for The Cellar, located at 1481 Westgate Parkway, Suite 1. Commissioner Kirkland moved for approval, motion seconded by Commissioner Kenward. Mayor Schmitz asked if there was anyone present to speak on this matter and there were none. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Schmitz confirmed that the applicant was present. Mayor Schmitz introduced the application of Melissa Peterman for a Lounge Retail Liquor License – Class I (on or off premise) for After Dark, located at 2970 East Main Street. Commissioner Kirkland moved for approval, motion seconded by Commissioner Newsome. Mayor Schmitz asked if there was anyone present to speak on this matter and there were none. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Schmitz confirmed that the applicant was present. Mayor Schmitz announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz introduced Ordinance No. 2016-262 (recorded in Ordinance Book No. _______at Page_______), amending Chapter 94, Taxation, Article IV, Lodgings Tax of the City of Dothan Code of Ordinances. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2016-262, motion seconded by Commissioner Kenward. Mayor Schmitz explained that discussions were held several years ago with Dothan Area Convention & Visitors’ Bureau Executive Director Bob Hendrix and the hotel owners regarding funding for Minutes of the Board of Commissioners – September 20, 2016, continued. new parks. He said the hotel owners proposed a three percent addition to the bed tax with the challenge to the Commission and to the City that we aggressively market the ballparks to help ensure hotel occupancy and to properly staff the parks. Mayor Schmitz said Leisure Services runs a first class operation and James Oates Park is going to be a wonderful park for this community. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Schmitz introduced Ordinance No. 2016-263 (recorded in Ordinance Book No. _______at Page_______), entering into a Franchise agreement with Southern Lights, LLC to allow construction, operation and maintenance of a fiber-optic transmission line within the City of Dothan. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Ferguson and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2016-263, motion seconded by Commissioner Kenward. City Manager West explained that the fiber will be a combination of inground and aboveground construction and the company will be leasing space on their lines. Commissioner Crutchfield noted that there have been pole relocation issues in the past with franchise agreements, and he said he wants to make sure there are no issues with this agreement. City Manager West advised that this matter has been discussed at length with Southern Lights, LLC. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Schmitz introduced Resolution No. 2016-264 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on October 18, 2016. Commissioner Kenward moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-265 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be in violation of Article III, Chapter 106 of the City of Dothan Code of Ordinance (repeat offenders) and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-266 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2016-204 and 2016-229 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-267 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Kenward moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-268 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Grey Communications for television advertising and marketing of events for the Dothan Civic Center and Opera House at a cost of $20,000.00 for a one year period. Minutes of the Board of Commissioners – September 20, 2016, continued. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome. Commissioner Ferguson requested that events be removed from the advertising after they have ended. Performing Arts Director Marshall Perry said the station pulls these ads when notified and they credit us and run additional spots when this happens. Commissioner Kenward asked if there is data available to show that the attendance has increased in proportion to the advertising in order to justify the cost. Mr. Perry confirmed this to be the case, and he advised that the number of events, the attendance, and the exposure have all increased. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-269 (recorded in Ordinance Book No._______at Page_______), entering into a service agreement between the City of Dothan and the Dothan/Houston County Communications District for services necessary to operate, monitor, maintain, support, document, upgrade, improve, and advise on the PSAP systems, all underlying infrastructures, all equipment, and IT related contracts for the District at a cost of $150,000.00 annually, paid in monthly installments. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome. City Manager West explained that this is a $25,000.00 reduction from the previous agreement because the District is going to hire someone to handle some of these tasks, and Mayor Schmitz clarified that the District is paying the City for these services. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-270 (recorded in Ordinance Book No._______at Page_______), approving Change Order No. 1 with Donald Smith Company, Inc., to include the removal and inspection of Well No. 11. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West explained that this is an additional well that requires work and there will be no increase in the contract price. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-271 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed and other related documents to Palmer Electric Construction Co. for the Well #24 Motor Control and Upgrades for the sum of $37,945.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome. City Manager West explained that a fire occurred at this well, the work will entail rewiring the motor and control panel, and this money is budgeted in Dothan Utilities budget. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-272 (recorded in Ordinance Book No._______at Page_______), approving the bid tabulation, awarding the bid, entering into a contract, and issuing a Notice of Award, Notice to Proceed and other related contract documents to U.S. Tank, Inc., for the amount of $332,217.00 for the 2016 Tank Rehab, Elevated Tanks 3, 10, 11 and 12. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West advised that this money is budgeted each year for a certain number of wells in order to keep them sanitary and in good maintenance condition. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-273 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Employment Screening Services for a fee based service for background checks required for employment with the City of Dothan for a three year period. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West said this is the company we have used in the past and we have found them to be acceptable. Commissioner Newsome inquired into the reason for a three year period. City Manager West said this is agreed upon term for the cost and is what we have done in the past. City Manager West confirmed for Commissioner Kenward that background checks are performed once the finalists are identified in the process. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-274 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Southern Minutes of the Board of Commissioners – September 20, 2016, continued. Regional Council on Aging (SARCOA) to administer and operate the Nutrition/Transportation Program of Title III of the Older Americans Act. Commissioner Kenward moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said this is the funding that goes through Rose Hill Senior Adult Center for their transportation and meals program. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-275 (recorded in Ordinance Book No._______at Page_______), declaring certain personal property as obsolete and no longer needed for public or municipal purposes and authorizing the disposal of said property by whatever means is determined to be in the best interest of the City. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-276 (recorded in Ordinance Book No._______at Page_______), amending various accounts in the 2016 Fiscal Year Budget. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West said this is the something we do at the close of every year at this time for bookkeeping purposes. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-277 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of August, 2016 in the amount of $19,651,786.30. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West said the amount is higher this month because a bond payment was made. There being no further discussion, the resolution was unanimously adopted.
