BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING AUGUST 6, 2019 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, August 6, 2019 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Kevin Cowper, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Pastor Steve Russell, Central Baptist Church, then led in prayer, afterwhich Commissioner Crutchfield led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of July 16, 2019, be approved, motion seconded by Commissioner Kenward and unanimously approved. Mayor Saliba invited Dothan City Schools (DCS) Superintendent Dr. Phyllis Edwards to give an update. Dr. Edwards provided an informational handout and presented a slideshow of pictures while she discussed the many improvements that have taken place at DCS over the summer, Points of Pride, and her vision moving forward. She talked about safety measures, and she expressed gratitude to Police Chief Steve Parrish and the Commission for providing school resource and protection officers. She acknowledged the DCS Board for all of their hard work, recognized WIRED volunteers for their fantastic partnership, gave great credit to her staff for all they are accomplishing, and thanked City staff for their assistance with signs and infrastructure. She said we do have shortfall areas because we are at the lowest level in terms of the millage and we are going to have to look at our funding sources at some point to see what we can do as it is hard for our school system to compete with those who have 30 and 35 mills. She said vision is really critical and vision with a plan and with action provides results. She said she wants the Commission to know that is what they have been doing and she would love to come back in the future to provide another update on the many things DCS is doing. Mayor Saliba thanked Dr. Edwards for this information, and he said the school system is vitally important to us and the community. He expressed appreciation for all they are doing and their hard work in accomplishing the things they have done over the summer. He welcomed Dr. Edwards to come back before the end of the year to give another update. Commissioner Fleming thanked Mama Tina’s Mission House, Aunt Katie’s Community Garden, Joe Davis Body Shop, and everyone who supported the Baptist Bottom Improvement Association Back to School rally this past weekend. Commissioner Fleming expressed appreciation to Police Chief Steve Parrish, Officer Clay Reynolds, and Recreation Center Manager Velton Robinson for going above and beyond in providing assistance to a young lady who had a wreck in front of Walton Park. Commissioner Fleming announced he will be holding a meeting on Monday, August 19th at Glen East Retirement Subdivision and this meeting will be open to the public. He said District 2 will have something here quarterly for the citizens of Glen East and anyone who would like to attend. Commissioner Kirkland said he would like to recognize Wastewater Treatment Supervisor LaDon Driskell who works behind the scenes and keeps our sewer system working properly. Commissioner Ferguson recognized and welcomed back Melissa McGill who was present in the audience. He said Ms. McGill worked as project manager for the Minutes of the Board of Commissioners – August 6, 2019, continued. Mayor and Commission for a few years, and he expressed appreciation for all the things she helped them accomplish during that time. He said her Dad recently passed away, he was a good man, and her family is in our prayers. Commissioner Kenward said there has been a lot of media coverage on what took place at our animal shelter a few weeks ago and now is the time for us to get behind the public-private partnership project for our shelter. She said everyone in our country is looking at us right now and added that she got a call from Ohio from a stepbrother she has not spoken to in years because he saw us on the news. She said our Dothan Police Foundation allows for contributions to be made specifically to Animal Services. She said she has put a challenge out on Facebook as her company will be donating at least $100 a month and $1 for every application they complete during Medicare season this year. She encouraged everyone to like this post and she challenged other businesses to join her company in this initiative. She said the events that took place recently is evidence of why we need a new shelter and why we should get behind this effort. Commissioner Crutchfield also recognized Melissa McGill in the audience and said it is good to see her back. He thanked Melinda McClendon for her great tenure as Community Relations Officer and said she got us back on track with different things that we needed. He said we will miss her and look forward to our new public relations person. Commissioner Crutchfield thanked the department heads for responding to his many calls these past couple of weeks and for their professionalism in keeping citizens informed. Mayor Saliba said he would like to recognize one of the most important people in his life, his wife Angie, sitting on the front row with his Uncle Jim Richards visiting with us this morning from New Hope. Mayor Saliba thanked former Mayor and current DCS Board Chairman Mike Schmitz for being present today and he thanked him for what he is doing for the school system. He said we have a great team, we have a lot of great things going on, and he is proud to be part of it. City Manager Cowper made the following announcements and comments:  The Men’s Health Fair, hosted by Southeast Health, will be held on Saturday, August 10th from 8-11 a.m. in the Civic Center arena and all men are encouraged to come out to this event where free medical tests and screenings will be available.  Water World and the City pools are closing a little earlier this year; the last day is Sunday, August 11th.  A City Commission work session will take place on Tuesday, August 13 th at 8:30 a.m. in the Board Room to discuss the upcoming FY 2020 and 2021 budgets and everyone’s attendance is encouraged.  A Citywide Back to School Rally will be Saturday, August 17th from 3-6 p.m. at Westgate Park where backpacks and school supplies will be provided.  The Dothan Ponytails Softball Team is currently undefeated at the World Series and will be playing this evening in the semifinals. The boys are out of the tournament but we are proud of how they represented the City of Dothan. Mayor Saliba introduced Resolution No. 2019-181 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on August 20, 2019. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Minutes of the Board of Commissioners – August 6, 2019, continued. Mayor Saliba introduced Resolution No. 2019-182 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Numbers 2019-137 and 2019-164 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-183 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be in violation of Article III, Chapter 106 of the City of Dothan Code of Ordinance (repeat offender) and turning the cost over to the County Tax Collector so that the amount can be added to the next regular bill for taxes levied against the respective lots and parcels of land. Commissioner Kenward moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-184 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract, and issuing a Notice to Proceed to Wiregrass Construction Company, Inc. for the Dothan Landfill Cell 6 Construction Project, in the amount of $3,262,645.25. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Dorsey said he is glad to see this is going to a local contractor. Upon Commissioner Ferguson’s inquiry into the timeline, Public Works Director Charles Metzger said the work is anticipated to begin in two to three weeks and will last approximately six months, depending on the weather. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2019-185 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with CDG Engineers & Associates, Inc. for construction engineering services for the Dothan Landfill Cell 6 Construction Project, for the sum of $277,000.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Dorsey said he is glad to see this is going to a local contractor. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2019-186 (recorded in Ordinance Book No._______at Page_______), entering into a Supplemental Agreement for the relocation of Water and Sanitary Sewer Utility Facilities on Public Right-of-Way to be completed by the City of Dothan Contractor for Project No. RPF-NHF-HPPF- 0210(501)(Phase 2), Additional Lanes on Ross Clark Circle (SR-210) from South of US-84 to North Cherokee Avenue, on SR-53 (US-231) from Girard Avenue to Buyers Drive and on SR-12 (US-84) from Bel Aire Drive to North Englewood Avenue, including Engineering and CE&I, at a cost of $2,141,172.00, bringing the total revised agreement to $4,791,778.00. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-187 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed and other related documents to L and K Contracting Company, Inc., for the 2019 Red Water Watermain Replacement Project C, for the sum of $214,283.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Dorsey said he is glad to see this is going to a local contractor. Mayor Saliba introduced Resolution No. 2019-188 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Alabama Department of Transportation for the installation of a sanitary sewer lateral to an existing sanitary sewer manhole within the ROW near the 2100 Block of South Oates Street (U.S. Hwy. 231 South) to serve a new business. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Minutes of the Board of Commissioners – August 6, 2019, continued. Mayor Saliba introduced Resolution No. 2019-189 (recorded in Ordinance Book No._______at Page_______), approving Change Order #1 (Final) with Max Foote Construction Company, LLC for the Omussee Creek Wastewater Treatment Plant, to deduct $18,745.96 from the original contract amount, resulting in a final contract price of $39,206,254.04. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-190 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with ALEA and the Drug Enforcement Administration for participation in the Montgomery HIDTA (High Intensity Drug Trafficking Area) Task Force to disrupt illicit drug trafficking. The HIDTA grant will reimburse overtime expenses, not to exceed $18,344.00 and $8,400.00 in vehicle allowance, totaling $26,744.00 annually. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-191 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Dick’s Sporting Goods for sponsorship of the Dothan Leisure Services Youth Football and Soccer programs. (Tillman) Black as a member of the Board of Zoning Adjustment and appointing Morris Stringer as a supernumerary member of the Board of Zoning Adjustment.
