BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING SEPTEMBER 17, 2019 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, September 17, 2019 with the following members present: Mayor Mark Saliba, Associate Commissioners Kevin Dorsey, Janasky Fleming, John Ferguson, Beth Kenward, and David Crutchfield. Commissioner Albert Kirkland was absent. Also present were City Manager Kevin Cowper, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Saliba called the meeting to order. Pastor W. Charles Lewis, Dothan Community Church, then led in prayer, afterwhich Commissioner Ferguson led in the Pledge of Allegiance to the Flag. Commissioner Kenward moved that the Minutes of the Meeting of September 3, 2019, be approved, motion seconded by Commissioner Crutchfield and unanimously approved. Mayor Saliba presented and read a proclamation, proclaiming September 26, 2019 as “Family Day – A Day to Eat Dinner with Your Children.” Judy Guiler, Interim Director of the Dothan-Houston County Substance Abuse Partnership, was present for the proclamation. Mayor Saliba presented and read a proclamation, proclaiming September 18-22, 2019 as “Fashion Week” in the City of Dothan. Vanessa Riley Harris, Executive Director of Single Parents in Need Nationally, Inc. (SPINN), Machroyce Corbitt, Entrepreneurship Council President, and Dr. Richard Voss from Troy University were present for the proclamation. Commissioner Crutchfield recognized and congratulated the Dothan National Ponytails 11 & 12 Year Old Dixie Softball 2019 World Series Champion team, and he thanked the coaches for giving their time. Leisure Services Athletic Coordinator Tyson Carter relayed the team’s stats, and he expressed appreciation to the parents, coaches, and players for their participation. Head Coach Scotty Lingo introduced the team members who were present, as well as those who were unable to attend today, and Assistant Coaches Cliff Mendheim and Mike Palmer. Coach Lingo recognized Mr. Carter, James Oates Park Complex Manager Troy Jones and staff, Sports Supervisor Cynthia Debose, Recreation Supervisor Garrett Franklin, and the players’ parents for their involvement. Coach Mendheim reiterated Coach Lingo’s sentiments, thanked him for his leadership and hard work, and he expressed appreciation to the City officials for the investment that has been made in James Oates Park, which he said is a state of the art facility. Commissioner Dorsey said he would like to thank the staff and department heads for making his life much easier through their assistance with handling issues. Commissioner Dorsey sent his deepest condolences out to Ms. Mina Dickens’ family. Commissioner Dorsey announced that he will be hosting a community forum on Thursday, September 26th titled “Can you afford to die?” to discuss community services offered and the economical approach. This forum will be held at Walton Park from 6:00 p.m. until 7:00 p.m. Commissioner Crutchfield thanked the department heads for their work in all the things going on around the City. He requested everyone’s patience with the inconveniences occurring as a result of this progress, and he said these efforts are preparing us for the future. Minutes of the Board of Commissioners – September 17, 2019, continued. City Manager Cowper said we are beginning to prepare for Halloween festivities on Thursday, October 31st and want to make sure all of our street lights in our neighborhoods are working. Citizens are encouraged to play a part in this effort by reporting non-working street lights by calling 615-3302 during the daytime or completing a request online at “Report a Concern” on the City’s website. Mayor Saliba introduced the application of Kevin Patel for a Lounge Retail Liquor License, Class II (Package) (off premise) for Legacy Wine and Spirits, located at 3684 South Park Avenue. Mayor Saliba asked if there was anyone present to speak on this matter. Evan Kohen said he is the pastor at Selma Baptist Church which is less than half a mile from the proposed location and several of their members live in the Lakewood Subdivision adjacent to this property. Pastor Kohen said several concerns have been brought forth and a lot of their members have had petitions signed within the community. He said, as of the last count, they have obtained 242 signatures opposing this store being put in for several different reasons. He spoke about the biblical understanding from the church’s standpoint of promoting the sale of hard liquor and ultimately alcoholism and said the church stands against this. He said, from a community perspective, this is an area that is primarily residential with families and children, and that thoroughfare is already extremely congested, especially during times of going to and from school. He said they feel it is very detrimental to the life of this community, with the addition of James Oates Park and the wonderful things that park is doing, to add to the congestion and to add alcohol as a factor. He said there are families that live in the neighborhood across the street in Stone Creek Landing and on the corner of that intersection that already have complaints of the lights installed that are shining into those properties and causing an issue after dark before it is even open. Tim Bugg said he lives directly across the street at 308-1 Hidden Creek Circle and also owns the adjoining unit at 308-2 Hidden Creek Circle where his 85 year old Mother lives. He said he has four issues to convey and one solution he would like to present as well. He distributed a picture which he said depicts the closeness of the store and the brightness of the lights, and he said he can hear doors slam and conversations. He said these are nuisance issues in violation and it is not right to the community if this becomes a lounge. He said having a liquor store in the neighborhood will decrease the values of their homes and this depreciation will cost him economically. He said another issue is the community impacts. He said informal studies online show that crime will increase a minimum of ten percent. He said there are enough problems in our families and in our community so let’s not bring in a liquor store and decrease the property values of our retired taxpaying voting citizens. He said let them do it on the Circle where there is property available and where it is commercial already. He said there are safety vehicle and water flow issues with roundabouts, and he proposed a solution to condemn this property to use it for a retention pond and emergency vehicle access. Danny Moore said he lives at 1704 Fern Drive which is only a block from the corner of South Park Avenue and Taylor Road. He said there are no liquor stores at nice subdivisions in other areas of Dothan. He said there is a lot of development on South Park Avenue and Taylor Road, such as the multi-million dollar James Oates Park complex where kids play, the rescue, City offices, our church, and a store which serves a purpose of people in our neighborhood and surrounding area. He said he does not think putting in a liquor store is something that is good for our community because there are too many negatives. Mayor Saliba requested those present in the audience who are opposed to please stand, and approximately twenty-five people stood. A lady then approached the podium but did not state her name or address. She inquired into the closure of Moore Road and the decision to now put in a roundabout at the South Park Avenue and Taylor Road intersection. Commissioner Ferguson explained that this is a County intersection and it is their decision to make. She said the City’s plan to route Honeysuckle Road to 231 is brilliant and her suggestion is to complete this go-around before the roundabout because of the increasing traffic on that street. There being no further discussion, Mayor Saliba called for a motion. Hearing no motion, the application died. Mayor Saliba introduced the application of Birenkumar Soni for a Retail Beer and Retail Table Wine License (off premise) for Selma Street Market, located at 1351 East Selma Street. Mayor Saliba asked if there was anyone present to speak on this matter and there were none. There being no discussion, Mayor Saliba called for a motion. Mayor Saliba introduced the application of Parker Armstrong for a Retail Beer and Retail Table Wine License (on or off premise) for David’s Catfish House, located at 1708 Westgate Parkway. Mayor Saliba asked if there was anyone present to speak on this matter. Parker Armstrong said he is the applicant and anticipates alcohol will account for five percent or less of sales. Commissioner Dorsey moved for approval, motion seconded by Commissioner Crutchfield. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Saliba announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Saliba declared the Public Hearing closed. Mayor Saliba introduced Resolution No. 2019-233 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-234 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on October 15, 2019. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-235 (recorded in Ordinance Book No._______at Page_______), amending various accounts in the 2019 Fiscal Year Budget. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kenward. Commissioner Kenward requested explanation for the sake of the public. Finance Director Lisa Reeder said this is our routine catch up resolution for items approved during the year but not appropriated at that time or for accounts that were not budgeted but needed to be approved. She said we used to do these quarterly but we try to only do these twice a year now. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2019-236 (recorded in Ordinance Book No._______at Page_______), declaring certain personal property as obsolete and no longer needed for public or municipal purposes and authorizing the disposal of said property by whatever means is determined to be in the best interest of the City. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-237 (recorded in Ordinance Book No._______at Page_______), approving Alabama Department of Environmental Management (ADEM) fees, in the amount of $17,990.00, and accepting Environmental Covenants as part of completing the remediation of the Complex Fuel Spill. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-238 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed and other related documents to C and R Contracting, LLC. for Bid No.19-100, Alternate 1A Omussee Creek WWTP Dewatering Building Cover, for the sum of $64,693.20. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-239 (recorded in Ordinance Book No._______at Page_______), applying for and accepting grant funds from the State of Alabama Department of Education for the At-Risk After School Food Service Program for children; entering into an agreement with the United States Department of Agriculture for administration of the program; and entering into an agreement and awarding the bid to Breakfast at Tammie’s, in the amount of $263,117.40, for providing the food services. Commissioner Dorsey moved for Minutes of the Board of Commissioners – September 17, 2019, continued. adoption, motion seconded by Commissioner Fleming. Commissioner Ferguson confirmed with City Manager Cowper this is money passing through the City, and he stated that he did not remember the City ever naming a vendor. City Manager Cowper clarified that the program was previously done through the Dothan City Schools system but they are unable to do it going forward. There being no further discussion, the resolution was unanimously adopted. Mayor Saliba introduced Resolution No. 2019-240 (recorded in Ordinance Book No._______at Page_______), accepting funding from the United States Secret Service to participate in the U.S. Secret Service Alabama Electronic Crimes Task Force for reimbursement of equipment totaling $829.00, and appropriating funds for said equipment. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Crutchfield and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-241 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Organized Crime Drug Enforcement Task Forces (OCDETF) Program for reimbursement of overtime expenditures related to the Organized Crime Drug Enforcement Task Force up to $16,000.00. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-242 (recorded in Ordinance Book No._______at Page_______), accepting a Community Involvement Grant Award from the United States Tennis Association Pro Circuit, in the amount of $1,000.00, to help fund the Kids’ Days activities at the Hardee’s Pro Classic, and appropriating funds for said activities. Commissioner Kenward moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-243 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Academy Sports + Outdoors for the sponsorship of the Dothan Leisure Services “Youth Fishing Day”. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-244 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of August, 2019, in the amount of $23,262,714.38. Commissioner Kenward moved for adoption, motion seconded by Commissioner Fleming and unanimously adopted. Mayor Saliba introduced Resolution No. 2019-245 (recorded in Ordinance Book No._______at Page_______), re-appointing Ruby Harris, Michael Wyant, Victor Laurie, Twyla Williams, Buford George, Rufus Davis, Vanessa Riley Harris, Melissa Wilson, and Anita Dawkins as members of the Community Development Advisory Board. Commissioner Fleming moved for adoption, motion seconded by Commissioner Crutchfield. Commissioner Crutchfield thanked all who volunteer for this board for their effort and time, and Commissioner Kenward seconded this.
