The City Council may choose to discuss and take public comment on these items as necessary. A. Presentation on Dripping Springs Visitors Bureau's Annual Report. Pam Owens, President, Dripping Springs Visitors Bureau Pam Owens gave a presentation on the Dripping Springs Visitors Bureau's Annual Activities which is on file. B. Proclamation recognizing July as Parks and Recreation Month in the City of Dripping Springs. Sponsor: Council Member King Council Member King read the Proclamation and presented it to Kelly Schmidt and the Parks & Community Services Department. V. PRESENTATION OF CITIZENS A member ofthe public who desires to address the City Council regarding any item on an agenda for an open meeting may do so at presentation of citizens before an item or at a public hearing for an item during the City Council's consideration of that item. Citizens wishing to discuss matters not contained within the current agenda may do so, but only during the time allotted for presentation of City Council June 16, 2020 Regular Meeting Minutes Page2ofll  citizens. Speakers are allowed two (2) minutes to speak during presentation of citizens or during each public hearing. Speakers may not cede or pool time. Members of the public requiring the assistance of a translator will be given twice the amount of time as a member of the public who does not require the assistance of a translator to address the City Council. It is the request of the City Council that members of the public wishing to speak on item(s) on the agenda with a noticed Public Hearing hold their comments until the item(s) are presented for consideration. By law no action may be taken during Presentations of Citizens. Carol Phillips spoke regarding her support for reduced rental fees related to Frosty ' s Christmas Trees rental of the Triangle. Kim Barnett spoke regarding the proposed DSRP rules and commended Event Center Tina Adams on the work she has done thus far. Jason Ehler spoke regarding the proposed DSRP rules and stated that new management is going well. He also requested that members of the Event Center be allowed to offer input on any new rules. VI. CONSENT AGENDA A. Approval of Revised Job Description Changing the Communications Coordinator Job Title to Communications Director. Sponsor: Mayor Foulds B. Approval of a Resolution of the City of Dripping Springs accepting improvements and approving and accepting a maintenance bond for Caliterra subdivision Phase 3 Section 9 and offsite wastewater improvements and releasing a construction bond. Council Member Crow seconded the motion which carried unanimously 5 to 0. VII. BUSINESS A. Discuss and consider approval of a Co-Sponsorship Agreement between the City of Dripping Springs and The Isaac Family, and a Temporary Street Closure Request at Sports Park Road at the entrance to Dripping Springs Sports & Recreation Park regarding the Annual 4th of July Fire in the Sky event to be held at Sports and Recreation Park on July 4, 2020. Applicant Jason Isaac presented the item and reviewed the event. Michelle Fischer presented the applicant's request for a fee waiver of $250.00 for Street Closure Fees. City Council June 16, 2020 Regular Meeting Minutes Page 3 ofll  A motion was made by Council Member Purcell to approve a Co-Sponsorship Agreement between the City of Dripping Springs and The Isaac Family, and a Temporary Street Closure Request at Sports Park Road at the entrance to Dripping Springs Sports & Recreation Park regarding the Annual 4th of July Fire in the Sky event to be held at Sports and Recreation Park on July 4, 2020, with the condition that all City fees for the event request be waived. Council Member King seconded the motion which canied unanimously 5 to 0. B. Discuss and Consider approval of City Co-sponsorship Agreement for the Hill Country Rally for Kids Car Show between the City of Dripping Springs and the Hill Country Rally for Kids, and approval of a Temporary Street Closure request to close Mercer St from RR 12 to US Hwy 290, Mercer St at San Marcos St, Mercer St at Bluff St, College St. north of Mazama's Entrance to Mercer St, and from Old Fitzhugh Rd. south of Edward Jones to Mercer St. from 6am to 5pm on Saturday, September 26, 2020, with a rain date of Saturday, October 3, 2020. Kelly Schmidt presented the staff report which is on file. Staff requests postponement to the July 14, 2020 City Council meeting. No action was taken on this item. C. Discuss and consider approval of a Resolution Adopting Park Rules for the Dripping Springs Ranch Park Indoor Arena and Riding Memberships. Council Member Purcell presented the item. Kelly Schmidt and Tina Adams presented the staff repmi and updated rules which are on file. Mike Canoll, Penny Reeves, Jason Ehler and Paul Wolter spoke regarding the item. A motion was made by Council Member Purcell to approve a Resolution Adopting Park Rules for the Dripping Springs Ranch Park Indoor Arena and Riding Memberships as recommended and presented by staff, and pulling out page 3, numbers 1 - 4, and giving the authority to the Mayor to implement rules 1 - 4 and on page 3, at later date and after a stakeholders meeting. Cmmcil Member King seconded the motion. Upon further discussion, Council Member Purcell amended his motion so that the final approved rules will be reviewed and agreed upon by the Mayor and Council Member Crow prior to implementation. Council Member King agreed to the motion as amended. The amended motion canied unanimously 5 to 0. Mayor Foulds directed Council Member Purcell to meet with stakeholders within the next week, before the next City Council meeting. Filed as Resolution No. 2020-R28 D. Discuss and consider approval of an Amendment to the Professional Services Agreement between the City of Dripping Springs and Horizon Environmental Services regarding the South Regional Water Reclamation Facility Expansion Project. Discuss and consider approval of a Resolution of the City of Dripping Springs, Texas supporting Hays County's Proposed FY 2020 Flood Infrastructure Fund Project Abridged Application for an Awarded Project. Discuss and consider approval of an Ordinance Approving the Renewal of a Franchise Agreement between the City of Dripping Springs and Pedernales Electric Cooperative. Laura Mueller presented the staff report which is on file. Staff recommends approval of the resolution. A motion was made by Mayor Pro Tern Manassian to approve an Ordinance Approving the Renewal of a Franchise Agreement between the City of Dripping Springs and Pedernales Electric Cooperative. Council Member Crow seconded the motion which canied unm1imously 5 to 0. Filed as Ordinance No. 2020-32 G. Discuss and consider approval of an Ordinance granting to Waste Connections Lone Star, Inc., its successors and assigns, the right to operate and maintain trash and refuse collection routes within the City of Dripping Springs, extending an exclusive franchise for both residential and non-residential customers; and Authorization for the City Administrator to execute the Solid Waste Franchise Agreement. Waste Cmmections Lone Star District Manager John Hanis spoke regarding the item and discussed collection schedules and pricing related to recycling. City Council June 16, 2020 Regular Meeting Minutes Page 5 of 11  A motion was made by Mayor Pro Tern Manassian to approve an Ordinance granting to Waste Connections Lone Star, Inc., its successors and assigns, the right to operate and maintain trash and refuse collection routes within the City of Dripping Springs, extending an exclusive franchise for both residential and non-residential customers; and Authorization for the City Administrator to execute the Solid Waste Franchise Agreement. Council Member King seconded the motion which carried unanimously 5 to 0. Further action was taken regarding this item later in the meeting and for brevity is recorded here. A motion was made by Mayor Pro Tern Manassian to reconsider previous action to approve an Ordinance granting to Waste Connections Lone Star, Inc., its successors and assigns, the right to operate and maintain trash and refuse collection routes within the City of Dripping Springs, extending an exclusive franchise for both residential and non-residential customers; and Authorization for the City Administrator to execute the Solid Waste Franchise Agreement. Council Member Purcell seconded the motion which carried unanimously 5 to 0. Ginger Faught presented the staff report and requested postponement of consideration of this item to the Special City Council meeting so that rates for residential customers opting out of recycling can be negotiated. John Harris has agreed to those discussions. A motion was made by Council Member Purcell to rescind approval of an Ordinance granting to Waste Connections Lone Star, Inc., its successors and assigns, the right to operate and maintain trash and refuse collection routes within the City of Dripping Springs, extending an exclusive franchise for both residential and non-residential customers; and Authorization for the City Administrator to execute the Solid Waste Franchise Agreement and for the City Council to reconsider the item at the next City Council meeting. Mayor Pro Tern Manassian seconded the motion which carried unanimously 5 to 0. H. Discuss and consider approval of an Agreement between the City of Dripping Springs and P3Works regarding PID (Public Improvement District) Administration Services for the Heritage Public Improvement District. Laura Mueller presented the staff report which is on file. Staff recommends approval of the agreement. Discuss and consider approval of a Professional Services Agreement between the City of Dripping Springs and Buie & Company regarding Communication Services for the Tax Increment Reinvestment Zones. Discuss and consider the Appointment of four (4) individuals to the Historic Preservation Commission for terms expiring June 30, 2022. Andrea Cunningham presented the staff report which is on file. A motion was made by Mayor Pro Tern Manassian to appoint Tim Brown, Dean Erickson, Minnie Glosson-Needham, and Bruce Lewis to the Historic Preservation Commission for terms ending June 30, 2022. A motion was made by Mayor Pro Tern Manassian to adjourn into Executive Session under Texas Government Code Sections 551.071, Consultation with City Attorney, 551.074, Personnel Matters, and 551.072, Deliberation of Real Property and regarding Executive Session Agenda Items A, B, C, E and F. Council Member Harris-Allison seconded the motion which carried unanimously 5 to 0. Mayor Foulds announced that the Special Meeting Workshop will remain in recess in the event that the City Council has time to continue discussions. The length of the Executive Session will determine whether or not the City Council will return to the workshop. IX. EXECUTIVE SESSION The City Council for the City of Dripping Springs has the right to adjourn into executive session at any time during the course of this meeting to discuss any matter as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). The City Council for the City ofDripping Springs may act on any item listed in Executive Session in Open Session or move any item from Executive Session to Open Session for action. A. Deliberation of Real Property and Consultation with City Attorney regarding legal issues related to Real Property for the Tax Increment Reinvestment Zone including the Town Center Project and uses and real property in the Triangle and Veterans Memorial Park. Consultation with City Attorney, 551.071 City Council June 16, 2020 Regular Meeting Minutes Page 8 of ll  The City Council met in Executive Session from 7:56 p.m. - 9:20 p.m. No vote or action was taken during Executive Session. Mayor Foulds returned the meeting to Open Session at 9:20 p.m. OPEN SESSION Mayor Foulds announced that the City Council will not continue discussions under the Special Workshop and directed staff to schedule a Special City Council meeting in the next ten (10) days to continue discussions regarding the proposed budget. Mayor Foulds requested that the City Council revisit Business Agenda Item G regarding the Solid Waste Ordinance. Action taken regarding this item is recorded with the item on page six (6). A motion was made by Mayor Pro Tern Manassian to pull Executive Session Agenda Items A, Band C into Open Session for possible action. Council Member Crow seconded the motion which carried unanimously 5 to 0. A. Dripping Springs Ranch Park committee or board including duties and authority. Laura Mueller presented the staff report and outlined the duties and authority of members. Staff recommends appointing three members so that the DSRP rules can be reviewed and a recommendation provided to the City Council. This would also require a purchasing policy change. This should be done in the ten (10) days. A motion was made by Mayor Pro Tern Manassian to authorize staff to move forward with creating a Dripping Springs Ranch Park Board of Directors, modified to be a five (5) person body and appointing Council Member Purcell, Penny Reeves and Terry Polk to be the initial members of the body, and in the interim requesting the Board review the rules with stakeholders; and authorizing staff to move forward with changing the purchasing policy. Council Member Harris-Allison seconded the motion. Upon further discussion, Mayor Pro Tern Manassian amended her motion to include the appointment of Todd Purcell as the Chair of the body, and Council Member Harris-Allison seconded the amended motion. The motion as amended carried 4 to Oto 1, with Council Member Purcell abstaining. B. Appointment, employment, and duties of an employee Alicia Lundy Morse as Planning Assistant. A motion was made by Mayor Pro Tern Manassian to authorize the finalization of the Planning Assistant job description and to authorize the Mayor and Deputy City Administrator to hire for the position. Council Member Harris-Allison seconded the motion which carried unanimously 5 to 0. C. Real Property related to the Tax Increment Reinvestment Zone including the Town Center Project and uses and real property in the Triangle and Veterans Memorial Park. A motion was made by Mayor Pro Tern Manassian to direct staff to look at possible uses for the Triangle property including the possibility of a mobile food court and to take those City Council June 16, 2020 Regular Meeting Minutes Page 9 of 11  possibilities to the various boards and commissions that would provide recommendations on the approach to this property. Council Member Harris-Allison seconded the motion which carried unanimously 5 to 0. Mayor Pro Tern Manassian clarified for Mayor Foulds that this is not a consideration to move the Farmers Market or to open a mobile food court this month, and the idea is to explore options and visit with groups with interest in the property. The City Council held further discussions regarding Business Item G which are recorded with the item on page six (6). Mayor Foulds requested staff schedule a Special Meeting in the next ten (10) days to discuss the budget and consider action on the Solid Waste Ordinance and Agreement and DSRP Rules. X.
