Acting Chairperson Peter Kepler Julie Smith, Secretary Parks and Recreation Commission May 9, 2024 Page 4 of 15 Agenda Item #6.C 350 Monroe Street Dundee, Michigan 48131 734-529-3430 TO: Dundee Parks Commission FROM: Mike Hoffmeister, Village Manager RE: Viking Park Project Update Parks & Recreation Commission, Please use this memo as an update to the Viking Park Project. As you know, the project is grant funded through the Michigan Department of Natural Resources. It has been extended for a few years. We previously received permission from the Village Council to seek sealed bids, submitted the bids and specs to mDNR and had it ready to go. Since then, the Department of Environment, Great Lakes and Energy have stepped in due to the required soil remediation at the site. If you remember, this site was the previous location of a trail depot which housed trail fuel. The remediation is a part of the bids and specs, and the Village has a Due Care Plan for the site, as required by EGLE. During a recent call with mDNR and EGLE, the Village was informed that we now must complete a Response Activity Plan (ResAP) to undertake response actions to mitigate unacceptable exposures to the unsuitable soils. This plan is different from the Dune Care Plan which was previously created and submitted to EGLE. Now, Village engineers are working to create this plan and submit it to EGLE. Additionally, the time spent to create this plan will ultimately require the Village to extend the mDNR grant agreement at least another year. One positive of this extension of time is the possibility of partnering with EGLE for possible brownfield grant money which would help pay for the soil remediation portion of the project. As soon as the ResAP is completed, it must be reviewed and approved by EGLE, prior to publicly bidding the project. Should you have any questions, please let me know. In 2023, the Village Council approved a proposal from the Ecosystems Connections Institute at Manchester University to do a study of the River Raisin to see if a Fish Ladder would be proposed at the village’s dam. There was no cost to the Village for the study. The study was done, and their researchers were on site to conduct the surveys. They stated that they would return to the Parks Commission and the Village Council with a recommendation (or not). They have yet to send any information, the study results or a proposal for whether a fish ladder is recommended and any related costs. Should you have any questions, please let me know. We anticipate between 75-100 cyclists in total. The ride starts at 7:00 a.m. and all cyclists have to be off the road by 4:00 p.m. Cyclists have the option to ride on 4 different routes with staggered start times. The routes are on public roads and should not be a disruption to normal activities. I have attached the turn-by-turn map for the 100-mile route for your review. Several local businesses are sponsoring the ride. The website for the event includes additional details about the ride: www.mccornerstone100.org. The Monroe County Road Commission, the County Drain Commission and the County Sherriff’s Department have been notified. We request you to notify those in your organization who may have the responsibility for safety or those on an as needed basis. IN GENERAL ARTICLE I. IN GENERAL Sec. 58-1. General powers of village. The village shall: (1) Operate a system of public recreation and playgrounds. (2) Acquire, equip and maintain land, buildings and other recreational facilities. (3) Vote and expend funds for operation of the public recreation system. (Ord. No. 5-72, § 1(A)—(C), 5-25-72) Sec. 58-2. Acquisition of land and property; tax levy. (a) The village council is authorized to levy a tax for the purchase and acquisition of land and maintenance of property of a community recreation center upon a majority vote of the electors. Upon petition of ten percent of the voters, the council shall submit the question for a vote. The ordinance levying such tax shall take full force when adopted by a majority vote. (b) The village council is authorized to levy a tax not exceeding two mills for the purchase and/or maintenance of property for a community recreation center. The tax shall be levied and collected at the same time and in the same manner as other general taxes of the village. (Ord. No. 5-72, § 3, 5-25-72) Sec. 58-3. Use of recreational areas. (a) Use of recreational areas shall be free to the inhabitants of the community in which it is located, subject to the rules and regulations adopted by the board of directors and set out in article III of this chapter, except that where groups occupy such facilities a reasonable charge shall be made for such group occupancy, in connection with special costs in relation to janitorial services, lighting, cleaning up and use of any special equipment. (b) The board of directors may exclude from use of the community buildings or grounds all persons or groups who willfully violate the regulations set out in article III of this chapter. (Ord. (a) The village council shall appoint a board of directors to be known as the parks & recreation board. (b) The number of members on the parks & recreation board shall be not less than five or more than nine persons appointed by the village president, subject to the approval of the village council. A member shall hold office until the member's successor is appointed and qualified. Thereafter, each member shall serve for a term of three years. An appointment to fill a vacancy shall be for the unexpired term only. Members of the parks & recreation board must reside in or be employed within the geographic boundaries of the Village of Dundee. No. 01-2022, § 1, 2-1- 22) Sec. 58-27. Election of officers. (a) President. The parks & recreation board shall elect one of its members as president. The president shall have no voting privilege in the event of a tie. (b) Other officers. The parks & recreation board shall elect other officers as deemed necessary. (Ord. No. 5-72, § 1(K), (L), 5-25-72; Ord. of 7-5-72) Sec. 58-28. Oath of office. The members of the parks & recreation board shall take an oath of office, to be administered by the village clerk. (Ord. No. 5-72, § 1(I), 5-25-72) Sec. 58-29. Meetings. The parks & recreation board shall meet once a month. (Ord. No. 5-72, § 1(J), 5-25-72) Sec. 58-30. Powers and duties. The parks & recreation board shall: (1) Act in an advisory capacity to the Village Council, Director and Village Manager in all matters pertaining to public recreation and municipal parks. (2) Make and adopt bylaws, rules and regulations as may be expedient for: a. Their own guidance. b. Their government of the recreational areas. (3) Provide advice about the care and custody of the grounds and buildings. The parks & recreation board is empowered to provide advice regading of the recreational system and is authorized to conduct its activities relating to: (1) Property under its custody and management. (a) The purpose of this article is to protect human health and safety and public property by regulating public access to public parks, the memorial bandstand, the dam, and related structures and areas. (b) The parks in the village are known as Wolverine Park, East Ford Park, West Ford Park, Reggie's Park, Riverside Park, Memorial Park, Westside Park, and Waterworks Park. There additionally are two green spaces to be known as Village Hub North and South. The location of these parks is shown on a map maintained at the village offices. (c) Persons on the dam and the dam structures risk their own health and safety, and persons in public parks and areas during the night risk their own health and safety and damage to public property. (d) By adopting the regulations set out in this article, the village council intends to empower law enforcement agencies to make arrests of persons who engage in prohibited conduct. (Ord. (a) No person shall loiter so as to hinder or impede the passage of pedestrians or vehicles in public parks or areas. (b) No person shall occupy, trespass, walk, stand, sit, or lie in a public park which is posted after dusk or before 8:00 a.m. without a letter of approval from the village manager or the village president; provided, that persons may walk upon sidewalks adjacent to public streets, in Memorial Park, or the Village Hub green spaces at any time. (c) No person shall trespass, walk, stand, sit or lie, or in any way be on the public dam or other related structures that are on or about the river. (d) No person shall interfere with any other person's use of public parks or grounds. (e) No person shall willfully destroy, take, damage, alter, or in any manner deface any property not his own within any park or public area within the village. (f) No person shall occupy, trespass, walk, stand, sit or lie in the memorial bandstand without a letter of approval from the village manager or the village president. (Ord. Use No parade, procession, exercise, special event, or activity of a recreational or nonrecreational nature calculated to attract or which does in fact attract more than 20 persons shall be permitted within any Village park unless sponsored by or scheduled by the parks and recreation director or unless a permit has been issued in writing by the Village following the advice of the parks and recreation board. Any person who shall sponsor, engage in, participate in, or attend any such parade, procession, exercise, special event or activity of a nonrecreational nature shall be deemed to be in violation of this chapter. Sec. 58-54. Posting of signs. Signs stating "Park closed from dusk to 8:00 a.m.," "permit required to use memorial bandstand" and "No trespassing on dam structure" or similar words shall be posted as determined by the village manager in consultation with the village engineer.
