Page 51 The City of Dyer Board of Mayor and Alderpersons met in regular session, Monday, June 26, 2017 at 7:00 PM. Those present were Mayor Chris Younger, Alderpersons Ray Carroll, Richard Reed, Ryan Shanklin, Robert Johnson Michael Barron, Craig Blackburn, Tom Mikkelsen, and Jennifer Hughey. The City Attorney was present. Motion made by Ray Carroll, seconded by Jennifer Hughey, to approve the minutes of the June 12, 2017 regular meeting. Motion carried with all ayes. Mayor's Report Mayor Younger read aloud a letter of resignation from Kevin Hurley. Hurley has since reconsidered and wishes to remain employed with the city. Motion made by Ray Carroll, seconded by Jennifer Hughey to accept Hurley's resignation. Motion failed with Carroll, Reed, Shanklin, Johnson, Blackburn, Mikkelsen, and Hughey voting no; Michael Barron voted aye. Mayor Younger introduced County Mayor Tom Witherspoon who addressed the board concerning the EMS station at the Industrial Park which was recently flooded. Witherspoon said the county has concerns about the building's repeated flooding. In addition to the inconvenience, Witherspoon said employee's vehicles could be damaged if the water gets too high. Reluctantly, the county will reoccupy the building after the repairs are complete with the hope and assumption that the City will undertake steps to remediate the flooding risk. Mayor Younger said he would bring a list of potholes that need to be fixed to the next meeting. Department Reports Fire Chief Roger Worrell advised that Firefighter Don Corbin had turned in his gear on June 19 and had resigned. Motion made by Ryan Shanklin, seconded by Craig Blackburn to accept Corbin's resignation. Motion carried with all ayes. PublicWorks Supervisor William Caton asked the board to approve the purchase of a load of gravel for culvert repair. Motion made by Tom Mikkelsen, seconded by Richard Reed to authorize the purchase of a load of gravel for $400.00. Motion carried with all ayes. The City Recorder updated the board on the capitalization policythat was adopted in 2004. The board had proposed adopting a new policy; the City Recorder advised that the previously adopted policy would cover all funds, including the Water & Sewer Fund. The City Recorder also advised that financial reports for the month ended May 31 were at the members' seats. Wastewater Superintendent William Caton commended Tyler Landrum for his help in completing the DMR QAfor the wastewater plant. Committee Reports Motion made by Tom Mikkelsen, seconded by Richard Reed to hire Jackson Cantrell as a seasonal employee through the end of August. Motion carried with all ayes. Old Business Motion made by Michael Barron, seconded by Ryan Shanklin to pass on its second and final reading Ordinance 2017-242, an Ordinance to Levy Property Taxfor the Fiscal Year July 1, 2017 through June 30, 2018. Motion carried with all ayes. Motion made by Robert Johnson, seconded byJennifer Hughey to pass on its second and final reading Ordinance 2017-245, an Ordinance to Amend Title 18, Chapter 1 of the Dyer Municipal Code Concerning Water Rates. Motion carried with all ayes. Motion made by Michael Barron, seconded by Ray Carroll to pass on its second and final reading Ordinance 2017- Page 52 244, an Ordinance to Amend Title 18, Chapter 3 of the Dyer Municipal Code Concerning Sewer Rates. Motion carried with all ayes. Motion made by Michael Barron, seconded by Jennifer Hughey to pass on its second and final reading Ordinance 2017-243, an Ordinance to Adopt the 2017-2018 Annual Budget. Motion carried with all ayes. Motion made by Robert Johnson, seconded by Ryan Shanklin to pass on its second and final reading Ordinance 2017-246, an Ordinance to Adopt a Drought Management Plan. Motion carried with all ayes. Motion made by Richard Reed, seconded by Ryan Shanklin to pass on its second and final reading Ordinance 2017- 247, an Ordinance to Amend the 2016-2017 Annual Budget. Motion carried with all ayes New Business Motion made by Ryan Shanklin, seconded by Jennifer Hughey to write off the delinquent water accounts listed, totaling $9,019.56, effective June 30, 2017. Motion carried with all ayes. Motion made by Robert Johnson, seconded by Ray Carroll to adopt Resolution 2017-226, A Resolution to Adopt an Open Records Policy. Motion carried with all ayes. Motion made by Ryan Shanklin, seconded by Jennifer Hughey to cancel the annual garbage rate increase for 2017- 2018 pursuant to Ordinance 2015-223. Motion carried with all ayes. Motion made by Ray Carroll, seconded by Jennifer Hughey to appoint Ryan Shanklin as Fire Chief effective July 1, 2017. Motion carried with Reed, Johnson, Barron, Blackburn, Mikkelsen, and Hughey voting aye; Carroll and Shanklin abstained. Alderman Ryan Shanklin submitted a letter of resignation with immediate effect. Motion made by Ray Carroll, seconded by Tom Mikkelsen to accept Shanklin's resignation. Motion carried with all ayes. Motion made by Michael Barron, seconded by Craig Blackburn to declare Shanklin's seat on the Board of Aldermen vacant. Motion carried with all ayes. Motion made by Ray Carroll, seconded by Jennifer Hughey to pay the accounts. Motion carried with all ayes. Motion made by Michael Barron, seconded by Jennifer Hughey to adjourn.
