Page 3 The City of Dyer Board of Mayor and Alderpersons met in regular session, Monday,January 10, 2022 at 7:02 PM. Those present were Mayor Ray Carroll, Alderpersons Jennifer Hughey, Craig Blackburn, Tom Mikkelsen, and Bett Jewell. The City Attorney was present. Motion made by Craig Blackburn, seconded by Jennifer Hughey to approve the minutes of the December 13, 2021 regular meeting. Motion carried with all ayes. Visitors Brent Croom addressed the board concerning the alley at the end of West College St. Mayor Carroll said that would be taken up by resolution in new business. Mayor's Report Mayor Carroll thanked Sowell Boys Paving for their work on the basketball courts. Mayor Carroll thanked the public works department for their work preparing for the winter weather. Pre-treating the streets seemed to make a big difference. Department Reports Assistant Fire Chief Ryan Shanklin asked the board to re-appoint Nick Taylor to the fire department; Taylor's work situation has changed and he can once again serve. Motion made by Craig Blackburn, seconded by Jennifer Hughey to hire and appoint Nick Taylor as a firefighter. Motion carried with all ayes. The City Recorder reminded those present about the tax relief program. He also provided a brief update on ARPA funding. Committee Reports Mayor Carroll noted that budget season is quickly approaching. New Business The City solicited proposals from three engineering firms to assist with ongoing engineering work including projects undertaken using ARPA funds. There was only one response from A2H. Motion made by Tom Mikkelsen, seconded by Jennifer Hughey to select A2H Engineer and Architects for ongoing engineering work including projects undertaken with ARPA funds. Motion carried with all ayes. Motion made by Tom Mikkelsen, seconded by Bett Jewell to adopt Resolution 2022-320, A Resolution Authorizing the Transfer of Real Property (alley at intersection of West College and Elm Streets). Jason White is purchasing property on both sides of the putative alley and would like to combine the parcels; the presence of the alley is preventing combining the parcels. The City Attorney has made a diligent search of real estate records and has found no specific dedications to the City, but the deeds on both adjacent parcels reference the existence of an alley or a street going back to at least 1919. The City Attorney found no easements or other complications which would prevent the City from transferring any interest it might have in the property. Alderpersons Hughey and Blackburn expressed concerns about transferring something the City might not own; the City Attorney explained that the deed would transfer only whatever interest the City might have in the putative alley. Motion made by Craig Blackburn, seconded by Jennifer Hughey to refer the resolution to committee for further study. The motion to refer failed with Hughey and Blackburn voting aye; Mikkelsen and Jewell voted no; a tie resulting, the Mayor voted no.  Page 4 The main motion (to adopt the resolution, authorizing the transfer) carried with Mikkeisen and Jewell voting aye; Hughey and Blackburn voted no; a tie resulting, Mayor Carroll voted aye. Motion made by Jennifer Hughey, seconded by Craig Blackburn to pay the accounts. Motion carried with all ayes. Motion made by Jennifer Hughey, seconded by Tom Mikkeisen to adjourn.
