Roll Call: President Seager called the meeting to order at 6:30 p.m. Present: President Scott Seager, Trustees John Alexander, Alan Boyes, Mary Nugent, Matt Johnson (via Zoom) and Forty Renucci Absent: Alexander Alger Others: Chief Swendrowski, DPW Director Equitz, Administrator Suhm, Attorney Pruitt, Clerk Alexander Citizen Participation Lori Puls, 3029 Clayton Ave., spoke on behalf of residents along the Clayton/Bellview street project and presented a petition asking that a revision to the sidewalk be considered, expressed concern with possible increased taxes without increased property values. She also requested a meeting to discuss the estimated costs to the impacted residents for the project. Lynn Anderson, W902 County Rd D representing 2948 Main St., questioned the progress on the property maintenance issues at 2954 Main St., the date of the property owner’s legal deadline for improvements and what will be done to force this issue. Val Aide, 3051 South St, discussed Ord. 289-3 regarding noxious weeds and expressed her concerns with the cattails in the impoundment area. She requested that the Village eradicate the cattails. Consent Agenda 1. Approval Minutes – 6/1/2020 2. Liquor Licenses - Consider approval of 2020-2021 Liquor Licenses for Road Ranger and Bay East Troy, LLC 3. List of New and Renewed Operator’s Licenses approved for 2020-2022 License Year Licenses - per attached list 4. Consider amending Temporary Class B License for East Troy Railroad (approved March 16, 2020) from Beer to Beer/Wine for the remainder of their specialty dinner trains for 2020. 5. Consider approval of Special Event and Class B Beer License from Knights of Columbus, Keith Witt, Event Chairperson, for Corn & Brat Fest July 24 (4pm – 8 pm), 25 and 26 (10 am – 8 pm), 2020, on the Square with initial set up on Thursday, July 23. Temporary Class B Beer License for the East Troy Chamber of Commerce First Fridays Food Truck Fest, July 10, 2020, 5 pm to 8 pm, Vanessa Lenz, Chamber Director, Event Chairperson. Operator’s to be Vanessa Lenz and Sarah Manke. 7. Consideration of request by Village Administrator to carry over up to four days of vacation 8. Consideration of Termination of Conditional Use for 2919 Main St. as requested by the property owner because the approved conditional use is no longer in business Motion by Trustee Alexander, second by Trustee Boyes, to approve the consent agenda. Motion carried. Miscellaneous Business 1. Consider approval of 2020-2021 Liquor License for LD’s BBQ with Premises Extensions Motion by Trustee Johnson, second by Trustee Nugent, to approve the 2020-2021 Liquor License for LD’s BBQ with Premises Extensions. Motion carried. 2. Consideration of route to move structure (garage) to 2128 Clark Street (Per Municipal Code Section 210-14(A)(3) issuance of permit by building inspector is conditioned upon approval of route by Village Board) Eric and Rich Huebner explained their plan to move and relocate a garage structure into the Village. Discussion included the proposed route, questioned if permits were required from Walworth County to traverse County Highway ES and the time of day the move would take place. Motion by Trustee Boyes, second by Trustee Johnson, to table request until further information on whether a Walworth County permit is required can be presented. Motion carried. 3. Consider sewer charges for seasonal pool meter As a result of a billing error related to the East Troy Electric Railroad, DPW Equitz explained there was a utility review of water-only accounts and it was discovered that a seasonal pool meter (water only) at 1985 Division Street includes a pool house with toilet and sink on a separate sewer connection from the home and it is not being charged for the sewer connection or usage. DPW Equitz reviewed the account with the homeowner and found there was no written documentation of any agreement for this although the homeowner related a verbal conversation from the past regarding the situation. The DPW Department performed a dye test to confirm the pool house was on a separate sewer connection from the home and notified the homeowner of the results. Discussion included how this situation could be corrected with several options such as capping the sewer service or connecting the sewer service for the pool house to the home’s sewer connection. DPW Equitz related the example of a two-meter solution,  EAST TROY VILLAGE BOARD MINUTES June 15, 2020 Page 3 of 5 similar to the Gazebo on the Village Square which has one meter that is charged for both water and sewer and a separate water-only meter for the sprinkler system alone. Motion by President Seager, second by Trustee Nugent, to require a meter be installed (for sewer charges) at the location with billing sewer going forward (no back-billing). Motion carried. Direction to DPW Equitz was to contact the homeowner with Board’s decision and provide options to correct the situation. DPW Equitz was requested to bring the timeline to address the issue back to the Board after discussing with the homeowner. 4. Update on cost sharing for replacement of card reader for fuel farm at the Airport DPW Equitz confirmed that the cost sharing for this project with the BOA would be with the Village. To participate in the grant the BOA would pay 80% of the cost and the Village would pay the remaining 20%, to be reimbursed by Aviation Services LLC, per their contract. DPW Equitz is waiting for information from the BOA on whether the cost of the installation can be included in the grant cost sharing. If that is not allowed the cost of the installation would be the responsibility of Aviation Services LLC, per contract. Motion by Trustee Alexander, second by Trustee Nugent, to pursue the Fuel Farm card reader replacement with the FBO (Aviation Services, LLC) reimbursing the Village for their portion of the cost. Motion carried. 5. Consider approval of annual renewal for Mobile Home Park Permit for Meadows Development Group LLC - Skyview Terrace, 2742/2786 Main St. and discussion regarding cross connection compliance issues DPW Equitz confirmed that it is still out of the Village’s control to shut off individual lots as this is private property. This may be done by the park owner but not the Village as the private system is not the Village’s infrastructure. He stated that there are currently four (4) residents that have not responded to requests for inspection, three (3) are waiting for reinspection (one scheduled for Tuesday and another working with him on the reinspection) which leaves five (5) in non-compliance. The new ordinance allows for fines to be issued to those in non-compliance and as this would be a violation of an ordinance, the individual would be also be in violation of their lease and the park owner could move forward with eviction. Discussion included possible next steps to obtain compliance with all residents and confirmed that DPW staff would be available to perform these inspections. Motion by Trustee Johnson, second by Trustee Boyes, to approve the annual Mobile Home Park Permit application for Meadows Development Group LLC and for the four (4) residents that have not contacted DPW for the cross-connection inspection be cited for this violation. Discussion regarding audio/visual equipment Motion by Trustee Renucci, second by Trustee Alexander, to approve Ordinance 2020-10. Motion carried. Discussion regarding the interest in pursuing audio/visual equipment and the type/scope of equipment included consideration of equipment that works with Zoom, web cameras and extent of coverage expected. Direction to staff was to consider web camera(s) and present quotes to the Board. Reports 1. CDA Minutes 4/27/2020 2. Library Board Minutes 5/19/2020 3. Revenue-Expense Report – May 4. Update regarding 2954 Main Street Property – Walworth County has foreclosed on this property. Discussion included working with the County on the property maintenance issues, the foreclosure process and timeframe. Chief Swendrowski confirmed that the former property owner would be responsible for the full citations issued if he does not meet the June 17 deadline for compliance. Direction to staff was to contact Walworth County staff to inform them of the extent of the issue, request access for the Village Building Inspector to inspect the interior of the property and work towards a solution with a stated timeframe and provide an update to the Board at the next meeting. President Seager offered to participate in the contact call with the County. The frustration with the situation was expressed by all. Closed Session Motion by Trustee Renucci, second by Trustee Alexander to go into CLOSED SESSION pursuant to Sec. 19.85(1)(e),Wis. Stat., deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session: specifically to discuss possible development, related, and engagement agreement with Ehlers, Inc. Motion by Trustee Alexander, second by Trustee Boyes, to approve the $7,500 engagement agreement with Ehlers, Inc. for further investigation of TID 5.
