EAST TROY VILLAGE BOARD MINUTES January 16, 2023 Page 1 of 3 Call Meeting to Order; Pledge of Allegiance Clerk Alexander verified the meeting was posted according to law. Roll Call: President Seager called the meeting to order at 6:30 p.m. Present: President Scott Seager, Trustees John Alexander, Mary Nugent, Matt Johnson, Forty Renucci, and Joe Wisnewski Excused: Jason Smalley Others: Chief Swendrowski, DPW Director Equitz, Administrator Suhm, Attorney Geary, Clerk Alexander Citizen Participation Mary Nicoson, 2916 North Street, spoke of the Tri Troy Alliance and explained its purpose as a communication tool between the three municipalities and hopes that it continues. Consent Agenda 1. Approval Minutes – December 19, 2022 2. Consider approval of Three-lot certified survey map in Town of East Troy off of Swoboda Road (PET3100008) (within the Village's extraterritorial plat review jurisdiction); Justin and Mary Rohrer, applicant (application 2022-40) Motion by Trustee Alexander, second by Trustee Renucci, to approve the consent agenda. Motion carried. Miscellaneous Business 1. Consider Cyber Insurance Coverage for 2/1/2023-1/31/2024 Motion by Trustee Johnson, second by Trustee Alexander, to approve the cyber coverage with Tokio Marine for the policy period of 2/1/2023 to 1/31/2024. Motion carried. 2. Impoundment Update a. Endpoint Proposal for test wells Discussion included ground water flows, financial responsibility of the sampling, the cost of well abandonment which is not known because it is unsure when this would be done, notifying adjacent property owners and the need for obtaining a permit from Walworth County for work in their right-of-way. Motion by Trustee Alexander, second by Trustee Johnson, to approve the proposal from Endpoint Solutions for $20,500. Motion carried. 3. Consider TID 4 Change Order and Final Pay Request Tim Lynch, Lynch & Associates, explained this final pay request, that the final costs are slightly higher by $338,886.65 and this includes a change order. Several manholes that have settling will be corrected by the contractor. The final pay application is for $100,098.83 and about half of that is retainage. Motion by Trustee Johnson, second by Trustee Nugent, to approve the change order and the final pay application. Motion carried. 4. Consider Water System Evaluation Proposal Ben Wood, Strand & Associates, presented their proposal for the update evaluation of the water utility. This will be a more comprehensive study and consider growth, aging  EAST TROY VILLAGE BOARD MINUTES January 16, 2023 Page 2 of 3 infrastructure, PFAS, capacity, condition of facilities, and water quality to provide a comprehensive 5-year plus Capital Improvement Plan for the utility. The timeframe is to have the initial information available to DPW Equitz for the 2024 CIP planning in May. DPW Equitz explained that this study will include consideration of maintenance items and regulation needs such as tank cleaning/painting, meter replacements, well rehabilitation, etc. He mentioned that situations such as aging Well 8 and the availability of part for the aging equipment vs. replacement costs would also be included as well as looking at the demand vs supply for water storage. The 2020 water model that was done will also be used as a tool in this updated study. Motion by Trustee Johnson, second by Trustee Alexander, to approve the proposal from Strand & Associates for the Master Plan for the Water Utility. Motion carried. 5. Consider Mill Pond Pier Replacement Bid Award DPW Equitz explained the process of the bid opening and the documentation that was done to support the bid opening. Attorney Geary confirmed that appropriate steps were taken to ensure that required standards were met for a fair bid opening. The low bid does include a donation of about $5,000 and the Board can accept the bid with or without the donation. If the Board chooses to accept the bid without the donation the bidder can then offer the donation to the Village. Either way the low bidder is the same. Motion by Trustee Johnson, second by Trustee Alexander, to approve awarding the bid for the Mill Pond Pier Replacement to Complete Pier Service for $53,950.00 and thank them for the donation. Motion carried. 6. Consider LED Streetlight Update Project for 2023 DPW Equitz explained that WE Energies selects the sites for the lighting upgrades and the Village doesn’t have input. Motion by Trustee Johnson, second by Trustee Alexander, to approve Phase 2 of the LED Streetlight Upgrade Project. Motion carried. 7. Consider Approval of Proceeding with Veteran’s Memorial Project Consensus was that this project should move forward, and the Board expressed support to proceed. 8. Consider Approval of State Municipal Maintenance Agreement (SMMA) DPW Equitz explained that the Village will be responsible for the listed items whether we agree or not. Walworth County is responsible for the driving lanes, the Village is responsible for cub and gutter, storm sewer infrastructure, grass, sidewalk, and the State Right of Way. He confirmed that the Village is not compensated for this work. The crosswalks have always been the responsibility of the Village, the Village will do some snow removal at the intersection due to islands and any further crosswalks would need additional approvals from the State to install. President Seager is preparing a letter to the State regarding their request to move the Welcome Sign. Motion by Trustee Johnson, second by Trustee Alexander, to approve the State Municipal Maintenance Agreement. Motion carried. 9. Consider recommendation of Plan Commission to approve new telecommunication tower located at 2485/2491 STH 120 (RXUP 00230A), Village of East Troy, applicant (application 2022-38)  EAST TROY VILLAGE BOARD MINUTES January 16, 2023 Page 3 of 3 Motion by Trustee Johnson, second by Trustee Alexander, to approve the new telecommunications tower located at 2485/2491 State Highway 120.
