Roll Call: President Johnson called the meeting to order at 6:30 p.m. Present: President Johnson, Trustees John Alexander, Jim Holm, Mary Nugent, Fortune Renucci, Jason Smalley and Joe Wisnewski Others: Chief Swendrowski, WWTP Manager Pluess, Administrator Suhm, Clerk Alexander, Attorney Geary Citizen Participation Rose Ann Wall, 3073 Main St., spoke regarding a light at Jones Outlet that shines into her home. She requested direction for next steps. President Johnson will speak with staff and contact her. Kathy Kostock, Walworth County Register of Deeds, appointed earlier in 2024 and is introducing herself. Making aware of property fraud and they offer land notifications for free when property owners register through the reg of deeds office to receive a notice if anything is filed against their property. Took Staff Report #2 out of order at this time. Closed session Motion by resident Johnson, second by Trustee Renucci, to adjourn to closed session pursuant to Wis. Stats. 19.85(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or the conducting of other specified public business, whenever competitive or bargaining reasons require a closed session (Proforma Review and Associated Development Agreement Terms TID 5). Approval Minutes – 7/15/24 2. Consider approval of 2024 East Troy Bluegrass Festival, Melissa Sherman, Chairperson, Sept/ 14-15, 8 am – 6 pm, Village Square - contingent upon receiving copy of information  EAST TROY VILLAGE BOARD MINUTES August 5, 2024 Page 2 of 5 letter to be sent to businesses with date to be sent, receipt of fees and road closure approval contingent upon receipt of road closure approval from Walworth County. 3. Consider approval of East Troy Lions Car Show Special Event and Temporary Class B Beer License, Saturday, October 5, 2024, from 6 am to 3 pm at Rossmiller Park (Amusement Park area, Grandstand/Center Field and Playmore Park field) for car show, food sales, beer, and raffles and closing off Graydon Ave. from Bellview Avenue to West Street. 4. Consider approval of creating new fund for a possible Tax Incremental District 6 Motion by Trustee Smalley, second by Trustee Alexander, to approve the consent agenda. Motion carried. Miscellaneous Business 1. Discussion and possible direction to staff regarding TID 5 formation Direction to staff was to not create TID 5 at this time but bring back to the Board when numbers are firm. Staff will also cancel the scheduled Joint Board of Review meeting. 2. Consider request for funding from Booth Lake Memorial Park for $1,500 to support the Lake District in efforts to reduce Eurasian milfoil Don Vaccarello, Chairman of Booth Lake Management District, provided history of the work to control the Eurasian milfoil. The currently acceptable herbicide used to treat the milfoil is more expensive and required a heavier dose to be effective. Estimations are $40,000 to treat lake every 3 years. They are seeking assistance from the municipalities to help the Lake Management District (which is 90 homes) to treat the lake. The funding requested is based on the 3 acres (or 11%) of the lake that is the treated area from the boat launch through the beach area. Discussion included the impact of sodium and nitrates from run off, how this contributes to the issue, the frequency of water testing done and this will be an ongoing budget item that will increase with costs. Motion by President Johnson, second by Trustee Alexander, to accept the Park Board adding a line item for $1,500 in their 2025 budget and annual request in future budgets as appropriate as costs change based on information from the Lake Board to the Park Board. Motion carried. Item #4 was taken out of order at this time. 3. Consider status of agreement with tourism entity and direction to staff regarding room tax payments Administrator Suhm reviewed her memo and confirmed that no 2024 Room Tax payments had been made to the East Troy Area Chamber of Commerce as the Village tourism entity. The room tax funds for 1st Quarter have been collected and funds for 2nd Quarter will be finalized soon. She has received no feedback on last version of the MOU (Memo of Understanding) shared with the Chamber. Discussion included confirmation of the date the original agreement was provided to the Chamber and a review of the timeline of this project, the Board expressed disappointment and frustration with the lack of timely response from the Chamber, the interest in a financial audit for the Chamber, the option of creating a Tourism Commission to oversee spending of room tax funds, The Board reiterated that they appreciate the work and events the Chamber sponsored and  EAST TROY VILLAGE BOARD MINUTES August 5, 2024 Page 3 of 5 are provided by the Chamber and that these events are a great asset to the community, but expressed a desire for greater transparency and accountability financially. Motion by Trustee Alexander, second by Trustee Renucci, to pay the 1st Quarter 2024 room tax of $4,701.02 and hold any further payments until an agreement is reached for the Chamber to be the tourism entity for the Village. Motion amended by Trustee Smalley, second by Trustee Nugent, to request a response with a formalized agreement by the September 16 Village Board meeting. Amendment carried. Amended motion carried. 4. Update from Victor Stanford on the 2954 Main Street Renovation Progress Taken out of order after item #2. Victor Stanford presented his progress report. He stated that he is basically done with interior demolition, a bit behind the original schedule due to closing a month later than scheduled and discovery once in the house. They are at a point when things will be happening quickly, financing is moving ahead and permits will be filed, there were some engineering changes, they were able to reuse electrical service, and the roof was good and only needs some tuck pointing. They will be adding on to the back and side of the home, digging out for foundation work and bricking for windows. The Board thanked Mr. Stanford for his update. 5. Consider possible emergency equipment replacement and funding options for East Troy Area Emergency Services District due to a fire engine transmission failure Joe Degaro, Fire Chief, presented the current situation with their engine transmission failure and the costs for a rebuilt transmission ($23,000) vs the value of the 26-year-old engine if it were in running order ($30,000). As a solution he has the option to purchase a mini pumper which would save funds and time as well as allow for greater access due to the pumper’s smaller size. He is seeking the funds to purchase the mini pumper and is proposing two options: Option 1 – the Village would pay $146,000 as their portion of the cost of the equipment and the other municipalities in the Fire District would pay their share. Option 2 – the Village would finance the purchase with the Town of East Troy and the Town of Spring Prairie repaying their share to the Village. Discussion included tax impact and considerations, concern with the Village issuing debt for the capital lease without an agreement in place with Town of East Troy and the Town of Spring Prairie, the time-sensitive nature of the need, cost sharing of attorney fees. The Board asked for two weeks to try to complete an agreement to provide funding. Direction to staff and the Village Attorney was to work with the towns and their attorneys to draft an agreement to move forward with Option 2 financing and repayment of debt incurred to purchase the mini pumper. The goal is to have agreement and approvals from  EAST TROY VILLAGE BOARD MINUTES August 5, 2024 Page 4 of 5 the municipalities within two weeks with communication between the Fire District representatives and Joe DeGaro, Fire Chief. 6. Direction to staff regarding any changes or additions to services for 2025 operations budget as well as budget assumptions Administrator Suhm summarized proposed changes for 2025 and stated she is seeking direction on proposed wage/insurance assumptions. Direction to staff was to proceed with the proposed assumptions. 7. Consider offer Amendment to offer to purchase from Briohn Land Development, LLC Motion by Trustee Alexander, second by Trustee Nugent, to approve OTP extension to 7/31/2025. Motion carried. 8. Consider and possible approval of final development plans for prior approved planned development districts (PDD) and provide policy direction to staff regarding PDD approval process Motion by Trustee Smalley, second by Trustee Alexander, to ratify the Plan Commission approvals of the Honey Creek Planned Development District (The Lofts), the Adaptive Reuse of 2931 Union Street, and Overlook Ridge and direct staff to draft an ordinance change to give the Plan Commission the authority to provide final approval of Final Development Plans. Motion carried. Ordinances & Resolutions 1. Ordnance 2024-10 Amending Chapter 44 Emergency Government Motion by Trustee Smally, second by Trustee Alexander, to approve Ord. 2024-10. Motion carried. Staff Reports 1. Fire Chief’s June Report 2. Airport Manager’s Quarterly Report- taken out of order, after Citizen Participation – Doug Gauger presented his report and stated that the RNC was a hinderance with flight restrictions, the EAA provided a steady flow of fuel sales, and he received positive comments on the airport and FBO improvements.
