EVANSTON CITY COUNCIL First Regular Meeting July 6th, 2021 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of July was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. The meeting was also streamed live. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tib Ottley, Evan Perkes, David Welling, Mike Sellers and Mikal Welling. Council member Tim Lynch was excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Treasurer, Trudy Lym; City Clerk, Diane Harris; Director of Engineering and Planning, Dean Barker; Public Works Director, Gordon Robinson; Police Lieutenant Ken Pearson; Police Lieutenant Rhett Groll; Community Development Director, Rocco O’Neill; Director of Parks and Recreation, Scott Ehlers and Police Chief Michael Vranish. Several Police Officers and a group of interested citizens were also present. Approve Agenda Council member Welling moved, Council member M. Welling seconded, to approve the agenda. Approve Minutes The official record of proceedings for the City Council Meeting held June 15th, Special City Council Meeting held June 22nd, Special City Council Meeting held June 29, 2021 and the City Council Work Session Meeting held June 22nd , 2021 were approved as presented. Welling. Council Comments Council member Welling thanked the Citizens of Evanston for using caution with fireworks on the 4th of July. He also thanked Porter’s for the great fireworks display. Council member Sellers also recognized Porter’s for the excellent job they did with fireworks. Council member M. Welling echoed the comments about Porter’s and also recognized Parks and Rec for the Fresh Air, Freedom and Fun Festival at Bear Meadows. Mayor Williams agreed with the Council’s comments. He mentioned that he thought it was a good holiday and was grateful there were no catastrophes. Appointment Council member Welling moved, Council member M. Welling seconded to appoint Michael Vranish as the Chief of Police for the City of Evanston. The motion passed unanimously with 6 yes votes: Williams, Ottley, Perkes, Welling, Sellers, M. Welling. Consent Agenda Council member Perkes moved, Council member Welling seconded, to approve the following Consent Agenda Items: Limited Malt Beverage Permit requested by the Uinta County Fair Board for the Uinta County Fair at the Uinta County Fairgrounds for the following dates and times: Wednesday, August 4th , 2021 5:00 pm to 11:00 pm Thursday, August 5th, 2021 5:00 pm to 11:00 pm Saturday, August 7th, 2021 5:00 pm to 11:00 pm Open Container/Street Closure Permit requested by Rachel Reifon for an After Brewfest Party on Saturday, July 17th, 2021 on Main Street from 9th Street to Harrison Drive, and 10th Street from Front Street to Main Street, from 5:00 pm to 12:00 am. Ordinance 21-04 Council member Ottley moved, Council member Sellers seconded, to pass Ordinance 21-04 on third and final reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING, ANNEXING THE REAL PROPERTY MORE PARTICULARLY DESCRIBED HEREIN AS REQUESTED IN THE PETITION TO ANNEX SUBMITTED BY CASEY L. HARTZELL AND JANA L. HARTZELL. WHEREAS, the governing body of the City of Evanston, Wyoming, did on the 4th day of May, 2021, pass a Resolution declaring the intention of the City to annex real property into the City of Evanston upon the Petition to Annex filed by Casey L. Hartzell and Jana L. Hartzell; and WHEREAS, an annexation report as specified in W.S. §15-1-402 has been prepared for the subject property; and WHEREAS, said Resolution set a hearing for the 1st day of June, 2021, at 5:30 p.m., at the City Council Chambers at City Hall of the City of Evanston, to receive comments from members of the public, to determine if the proposed annexation meets the conditions of W.S. 15-1-402 and if the required procedures have been met; and WHEREAS, notice of the hearing and the annexation report has been published and provided to all landowners and public utilities as required by W.S. 15-1-402 and W.S. 15-1-405; and WHEREAS, after considering the evidence presented at the hearing, the governing body for the City of Evanston finds the following: (i) An annexation of the area is for the protection of the health, safety and welfare of the persons residing in the area and in the city; (ii) The urban development of the area sought to be annexed would constitute a natural, geographical, economical and social part of the annexing city or town;  (iii)The area sought to be annexed is a logical and feasible addition to the city and the extension of basic and other services customarily available to residents of the city shall, within reason, be available to the area to be annexed; (iv) The area sought to be annexed is contiguous with or adjacent to the city; (v) the existing utility franchises are able to serve the proposed annexed area; (vi) the terms and conditions of the Petition to Annex do exist; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, as follows: Section 1. The real property more particularly described below, is hereby annexed into the City of Evanston, Wyoming to-wit: A tract of land in the NE ¼ NE ¼ of Section 34, T15N, R120W, 6TH P.M., Uinta County, Wyoming, said tract being more particularly described as follows: COMMENCING at the Northeast corner of said Section 34, running thence S 89°22'22" W, 74.04 feet along the North line thereof; to the Easterly boundary of the Grass Valley Addition to the City of Evanston-Amended; thence S 24°35'02" E, 176.91 feet along said Easterly boundary; thence S 0°09'15" W, 107.98 feet along said Easterly boundary to the Southeast corner thereof; thence S 65°27'27" W, 305.51 feet along the Southerly boundary thereof to the POINT OF BEGINNING; thence S 24°32'33" E, 30.00 feet; thence S 65°27'27" W, 300.00 feet; thence N 24°32'33" W, 80.00 feet; thence N 65°27'27" E, 150.00 feet to the Westerly boundary of said Grass Valley Addition; thence S 24°32'33" E, 50.00 feet along said Westerly Boundary to the Southwest corner thereof; thence N 65°27'27" E, 150.00 feet along Southerly boundary to the POINT OF BEGINNING. Section 2. A certified copy of this annexation ordinance and an annexation map prepared pursuant to W.S. 15-1-402 shall be filed with the County Clerk of Uinta County, Wyoming. Welling moved, Council member Ottley seconded, to accept the apparent low bid for a 2021 Full Eject Automated Side Loader Refuse Compactor Truck and Cab Chassis to Peterbilt of Wyoming in Rock Springs, Wyoming. Council member Sellers moved, Council member Welling seconded, to adopt Resolution 21-46. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH DAVE NORRIS CONSTRUCTION, INC. FOR THE COMPLETION OF ALL WORK REQUIRED FOR THE 2021 STREET OVERLAY PROJECT. WHEREAS, the City of Evanston has a need to maintain its streets; and  WHEREAS, Dave Norris Construction, Inc. submitted the low bid for the 2021 Street Overlay Project; and WHEREAS, the City of Evanston and Dave Norris Construction, Inc are prepared to enter into an agreement whereby Dave Norris Construction, Inc will provide all materials and labor specified in the plans and specifications and the proposal documents for the 2021 Street Overlay Project in Evanston, Wyoming; and WHEREAS, the City of Evanston and Consolidated Paving & Concrete, Inc. have set their agreement in writing; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement between the City of Evanston, as Owner, and Dave Norris Construction, Inc, as Contractor, a copy of which is attached, for completion of all work necessary for the 2021 Street Overlay Project in Evanston, Wyoming. A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON APPROVING CHANGE ORDER NO. ONE FOR THE 2021 STREET OVERLAY PROJECT IN THE CITY OF EVANSTON. WHEREAS, the City of Evanston has previously approved the contract for the 2021 Street Overlay Project with Dave Norris Construction, Inc.; and WHEREAS, it is necessary to approve Change Order No. One for the reasons set forth therein; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming, as follows: Section 1. Change Order No. One for the 2021 Street Overlay Project, a copy of which is attached hereto, is approved. Section 2. The Mayor is authorized to approve Change Order No. One on behalf of the City. A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON AUTHORIZING THE ACCEPTANCE OF A QUOTE FROM DFA, LLC TO PROVIDE THE CITY AN ACTUARY REPORT TO ENABLE THE CITY TO MAKE REQUIRED GASB DISCLOSURES. WHEREAS, the City of Evanston is required by the Governmental Accounting Standards Board (GASB) to disclose the City’s liability of its post retirement health benefit programs; and WHEREAS, DFA, LLC will provide the City with an actuary report to enable the City to make required GASB disclosures; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming, as follows: Section 1. The City of Evanston accepts the attached Quote from DFA, LLC to provide the City an actuary report to enable the City to make required GASB disclosures. Section 2. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR ADDITIONAL SERVICES WITH J-U-B ENGINEERS, INC. TO COMPLETE GIS MAPPING OF THE CEMETERY. WHEREAS, Gateway Mapping, Inc. has been preparing a GIS mapping system for the Evanston Cemetery; and WHEREAS, it is necessary for the City to enter in the attached Agreement for Additional Services with J-U-B Engineers, Inc. to complete the project; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement for Additional Services between the City of Evanston and J-U-B Engineers, Inc., a copy of which is attached hereto, to complete the GIS mapping system of the Evanston Cemetery. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH HACH COMPANY TO PROVIDE THE ANNUAL CALIBRATION SERVICES NEEDED FOR THE WATER TREATMENT PLANT. WHEREAS, the City of Evanston and Hach Company have reached an agreement whereby Hach Company will provide the annual calibration services needed for the City’s water treatment plant; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreement between the City of Evanston and Hach Company, a copy of which is attached hereto, to provide the annual calibration services needed for the City’s water treatment plant. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A WATER AGREEMENT WITH THE WYOMING DEPARTMENT OF TRANSPORTATION TO PROVIDE WATER FOR THE STATE HIGHWAY 150 REPAIR PROJECT. WHEREAS, the City of Evanston and the Wyoming Department of Transportation have negotiated an agreement whereby the City will provide water to the Wyoming Department of Transportation as set forth in the attached agreement for the State Highway 150 Repair Project; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Water Agreement between the City of Evanston and the Wyoming Department of Transportation, a copy of which is attached hereto. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE WYOMING ASSOCIATION OF SHERIFFS AND CHIEFS OF POLICE TO PROVIDE COMPLIANCE INSPECTIONS ON ALCOHOL RETAILERS TO ENFORCE LAWS PROHIBITING THE SALE OF ALCOHOLIC BEVERAGES TO PERSONS UNDER AGE 21. WHEREAS, the City of Evanston, through its Police Department may obtain funds from the Wyoming Association of Sheriffs and Chiefs of Police to be used for providing compliance inspections on alcohol retailers to enforce laws prohibiting the sale of alcoholic beverages to persons under age 21; and WHEREAS, the governing body has determined that it is in the public’s interest for the Police Department to provide this service; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The City of Evanston is authorized to enter into an Agreement with the Wyoming Association of Sheriffs and Chiefs of Police to obtain funds to be used for providing compliance inspections on alcohol retailers to enforce laws prohibiting the sale of the sale of alcoholic beverages to persons under age 21 Section 2. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE WYOMING ASSOCIATION OF SHERIFFS AND CHIEFS OF POLICE TO PROVIDE COMPLIANCE INSPECTIONS ON RETAIL TOBACCO OUTLETS TO ENFORCE LAWS PROHIBITING THE SALE OF TOBACCO TO MINORS. WHEREAS, the City of Evanston, through its Police Department may obtain funds from the Wyoming Association of Sheriffs and Chiefs of Police to be used for providing compliance inspections on retail tobacco outlets to enforce laws prohibiting the sale of tobacco to minors; and WHEREAS, the governing body has determined that it is in the public’s interest for the Police Department to provide this service. NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The City of Evanston is authorized to enter into an Agreement with the Wyoming Association of Sheriffs and Chiefs of Police to obtain funds to be used for providing compliance inspections on retail tobacco outlets to enforce laws prohibiting the sale of tobacco to minors.
