W ednesday, July 03, 2013 A special meeting of the Ev erett City Council was called to order at 12:30 p.m., July 3, 2013 in the City Council Chambers of the Ev erett City Hall, President Moore presiding. Upon roll call it was f ound that May or Stephanson and Council Members Roberts, Moore, Murphy, Gipson, Bader, and Af f holter were present. Council Member Stonecipher was excused. Council Member Bader led the Pledge of Allegiance. The minutes of the June 26, 2013 City Council meeting were approv ed as printed. Council Member Roberts abstained f rom the v ote. MAY OR May or Stephanson expressed his disappointment that the legislativ e session closed without passing a transportation budget. He remarked on the success of v arious local projects, which the city had adv ocated f or. The May or wished ev ery one a happy 4th of July. COUNCIL Council Member Bader thanked the Parks Department f or their quick replacement of the damaged play structure at Garf ield Park. Council Member Murphy reported on his attendance at the Lowell neighborhood’s 150th birthday celebration and a historical presentation by Dav id Dilgard. Council Members Af f holter, Roberts and Moore expressed their disappointment that the transportation package was not successf ul in Oly mpia. Council Member Roberts reported on his attendance at the Association of Washington Cities’ annual meeting. He presented May or Stephanson with a Smart Growth Award, which he had accepted on behalf of the city f or the Ev ergreen Way Rev italization Plan. CITY ATTORNEY The City Attorney had no comments. CITIZEN COMMENTS No citizens wished to comment. COUNCIL BRIEFING AGENDA COUNCIL BILL NO. 1306-21 FIRST READING: AN ORDINANCE amending the expiration date f or preliminary subdiv isions and preliminary short subdiv isions, amending Section 5(C) of Chapter 5 of Ordinance No. 2530-01, as amended (EMC 15.20.210) Presented by Alan Gif f en, Planning CONSENT ITEMS: Mov ed by Council Member Gipson, seconded by Council Member Roberts, to approv e the f ollowing consent items: RESOLUTION - CLAIMS To adopt Resolution No. 6633 acknowledging the pay ment of audited and approv ed claims against the city of Ev erett in the amount of $3,246,127.75 f or the period of June 15, 2013 through June 21, 2013. RESOLUTION – PAY ROLL To adopt Resolution No. 6634 acknowledging the pay ment of audited and approv ed pay roll claims against the city of Ev erett in the amount of $3,521,186.10 f or the period ending June 15, 2013. RESOLUTION – ELECTRONIC TRANSFERS To adopt Resolution No. 6635 acknowledging the pay ment of audited and approv ed electronic transf er claims against the city of Ev erett in the amount of $5,786,876.34 f or the month of May 1, 2013 through May 31, 2013. Roll was called with all council members v oting y es except Council Member Stonecipher who was excused. Motion carried. ACTION ITEMS: COUNCIL BILL NO. 1306-20 THIRD AND FINAL READING: AN ORDINANCE relating to Chronic Nuisance Properties, amending Ordinance No. 3091-08 Mov ed by Council Member Roberts, seconded by Council Member Bader, that this is declared to be the third and f inal reading of Council Bill No. 1306-20 and the City Clerk is directed to call the roll f or the f inal disposition of the ordinance. AY ES: Roberts, Moore, Murphy, Gipson, Bader, Af f holter NAY S: None EXCUSED: Stonecipher Ordinance No. 3332-13 adopted. AGREEMENT AMENDED – WATER MAIN IMPROVEMENT “K”/SEWER MAIN REPLACEMENT Mov ed by Council Member Af f holter, seconded by Council Member Gipson, to authorize the May or to sign Change Order No. 2 with SRV Construction f or the Water Main Improv ement “K” and Sewer Main Replacement project f or a net increase of $126,602.07, not including Washington State sales tax to the total contract price. Roll was called with all council members v oting y es except Council Member Stonecipher who was excused. Motion carried. BID AWARD – POWDER MILL GULCH TRIBUTARY STABILIZATION Mov ed by Council Member Bader, seconded by Council Member Murphy, to award the bid f or the Powder Mill Gulch Tributary Stabilization project to Jansen, Inc. in the amount of $809,526.90, including Washington State sales tax. Roll was called with all council members v oting y es except Council Member Stonecipher who was excused. Motion carried. GRANT AMENDMENTS This item, authorizing the May or to sign grant amendments with Washington State Department of Ecology, was pulled f rom the agenda. AGREEMENT AMENDED – FIRE ADMINISTRATION COMPLEX – SEISMIC IMPROVEMENTS Mov ed by Council Member Gipson, seconded by Council Member Bader, to authorize the May or to sign Change Order No. 4 to the Fire Administration Complex – Seismic Improv ements project with Biwell Construction, Inc. f or additional seismic work in the amount of $62,619.89 plus Washington State sales tax. Roll was called with all council members v oting y es except Council Member Stonecipher who was excused. Motion carried.
