January 6, 2016 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., January 6, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Bader presiding. OATH OF OFFICE Superior Court Judge Joseph P. Wilson administered the oath of office to Council Members Tuohy, Bader and newly elected Council Member Cassie Franklin. Upon roll call, it was found that Mayor Stephanson and Council Members Roberts, Moore, Murphy, Franklin, Bader, and Tuohy were present. Council Member Stonecipher was excused. Council Member Moore led the Pledge of Allegiance. The minutes of the December 30, 2015, City Council meeting were approved as printed. MAYOR Mayor Stephanson congratulated Council Members Franklin, Bader, Stonecipher and Tuohy on their elections and welcomed new Council Member Franklin. The Mayor proclaimed January 6, 2016, as " Tom Gaffney Appreciation Day" and presented the proclamation to Thomas J. Gaffney, former treasurer and board member at the Everett Public Facilities District Board of Directors. Tom Gaffney thanked the Mayor and the City Council. COUNCIL Council members congratulated their colleagues on their elections and welcomed Cassie Franklin. They also expressed their appreciation to Tom 1  January 6, 2016 Gaffney for his service and dedication to the PFD Board. Council members wished citizens and colleagues a happy New Year. Council Member Franklin stated it is an honor to be a part of the Everett City Council and thanked everyone for a warm welcome. She indicated that she is looking forward working with the community. Council Member Murphy provided a liaison report regarding the Snohomish Health District Board. He invited the public to attend an annual City Council Retreat scheduled for January 23, 2016, from 8: 00 a. m. to 12: 00 p. m. at the Carl Gipson Senior Center. Council Member Roberts spoke about the General Government Subcommittee meeting, which took place earlier today. He stated that the subcommittee will bring forward recommendations to support the Streets Initiative soon. Council Member Roberts thanked the Mayor for his leadership with Sound Transit 3 ( ST3) alignment. Council Member Tuohy reminded the public that the Public Safety Subcommittee meeting is scheduled for next Wednesday, January 13, 2016, before the regular City Council meeting. Council President Bader thanked his colleagues for the opportunity to serve as a Council President. He thanked the Mayor and the City staff for their support and expertise during his time of service as Council President. Council President Bader opened nominations for the Council President position for 2016. Moved by Council Member Tuohy, seconded by Council Member Franklin, to nominate Council Member Murphy for the Council President position for 2016. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. 2  January 6, 2016 Council Member Murphy assumed the position of new Council President. Council Murphy thanked his colleagues for the support. On President behalf of the Everett City Council and others, he expressed appreciation to past Council President Bader for his service and presented him with a plaque in recognition of his service as City Council President. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. CITY ATTORNEY City Attorney Iles requested an executive session, anticipated to last no longer than 10 minutes, concerning a litigation matter pursuant to RCW 42. 30. 110( 1)( i)( a) with no announcement to follow. CITIZEN COMMENTS There were no citizens who wished to speak. COUNCIL BRIEFING AGENDA: 2016 State Legislative Priorities Agenda. Presented by Pat McClain, Administration Charter Review Process Discussion. Council President Murphy opened a discussion regarding the Charter review process. Considerable discussion ensued regarding an application process, a timeline, a broader pool of applicants, and possible ways to encourage citizens to apply. 3  January 6, 2016 Moved by Council Member Bader, seconded by Council Member Roberts, to adopt a three- step process where the first seven members shall be designated by the Mayor from the pool of applicants, secondly each council member shall designate one person to make up the total of seven members nominated by the City Council from the pool of applicants, and thirdly, these 14 members shall elect one additional member for a total of 15. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. President Murphy asked the Mayor to come forward with his list of nominated individuals by January 20, 2016, and no later than January 27, 2016. Mayor Stephanson stated he will do his best to present his list of members by January 20, 2016, but no later than January 27, 2016. President Murphy asked the City administration to prepare one more press release or e- mail distribution to announce that the City is still accepting applications. Debra Bryant, Administration, stated that the City is using various methods to advertise the application process and will send more announcements this week. Jackie Minchew, Everett, commented on application process and recommended reaching out to neighborhood groups. Award contract for the construction of the Water Main Replacement P" Project to Allied Construction Associates, Inc. in the amount of 954,839.80, including Washington State sales tax. Presented by Dave Davis, Public Works 4  January 6, 2016 PROPOSED ACTION ITEMS: COUNCIL BILL NO. 1512- 54 SECOND READING: AN ORDINANCE creating a special improvement project entitled Three Acre Park, Phase 1," Fund 308, Program 006, to accumulate all costs for the improvement CONSENT ITEMS: Moved by Council Member Roberts, seconded by Council Member Moore, to approve the following consent items: RESOLUTION - CLAIMS To adopt Resolution No. 6936 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 1, 083, 443. 77 for the period of December 19, 2015, through December 24, 2015. RESOLUTION - PAYROLL To adopt Resolution No. 6937 acknowledging payment of audited and approved payroll claims against the City of Everett in the amount of $3, 539, 650. 94 for the period ending December 12, 2015. Motion carried. 5  January 6, 2016 ACTION ITEMS: AGREEMENT — ENERGY MAP, CARBON WEDGE ANALYSIS AND CARBON REDUCTION STRATEGIES Moved by Council Member Bader, seconded by Council Member Moore, to authorize the Mayor to sign the Professional Services Agreement with New Energy Cities to prepare an Energy Map, Carbon Wedge Analysis and Carbon Reduction Strategies in an amount not to exceed $ 30, 000. Council Member Roberts provided a briefing. Jackie Minchew, Everett, thanked Council Member Roberts for his work and suggested allowing citizen involvement. Charlene Rawson, Everett, thanked Council Member Roberts for his leadership in this area. Victor Harris, Everett, spoke about the mass transit share of gas emission. RFP AWARD — ELEVATOR MAINTENANCE & MONITORING SERVICES Moved by Council Member Bader, seconded by Council Member Franklin, to award RFP 2015- 110 for Elevator Maintenance & Monitoring Services to Thysenkrupp Elevator Americas in the amount of $ 219, 000 including Washington State sales tax. Council Member Tuohy asked if the same vendor was used in the past. AGREEMENT —NEIGHBORHOOD STABILIZATION PROGRAM Moved by Council Member Tuohy, seconded by Council Member Roberts, to authorize the Mayor to sign Amendment No. 2 to the Neighborhood Stabilization Program Agreement between the City and the Everett Housing Authority. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. AGREEMENT —NEIGHBORHOOD STABILIZATION PROGRAM Moved by Council Member Franklin, seconded by Council Member Bader, to authorize the Mayor to sign the Closeout Agreement for the Neighborhood Stabilization Program 1 Agreement between the City and the Washington State Department of Commerce to address impacts of foreclosed upon homes and properties. Debra Bryant, Administration, announced that Jan Meston, Planning Department, will retire on January 22, 2016, after 26 years with the City.
