March 16, 2016 The regular meeting of the Everett City Council was called to order at 6: 30 p. m., March 16, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, Council President Murphy presiding. Upon roll call, it was found that Mayor Stephanson and Council Members Roberts, Moore, Murphy, Franklin, and Tuohy were present. Council Member Stonecipher was excused. Council Member Bader was expected to be a few minutes late. Council Member Moore led the Pledge of Allegiance. The minutes of the March 9, 2016, City Council meeting were approved as printed. Council Members Roberts and Murphy abstained from the vote. MAYOR OATH — POLICE OFFICER Moved by Council Member Roberts, seconded by Council Member Tuohy, to concur with the appointment of Alex Olson as a new police officer. Roll was called with all council members voting yes. Motion carried. The Deputy City Clerk administered the oath of office and Mayor Stephanson presented the officer with his badge. COUNCIL Council Member Franklin provided a liaison report on her attendance at the Community Streets Initiative Advisory Committee meeting. Council Member Roberts stated that this week is National Sunshine Week, which is a national initiative to promote a dialogue about the importance of open government and freedom of information. He also reported on his 86  March 16, 2016 attendance at the GLOBE Leadership Summit for Sustainable Business held in Vancouver, Canada. Council Member Roberts spoke about his participation at the National League of Cities conference last week in Washington, D. C. Council Member Tuohy provided a liaison report on her attendance at the Library Board meeting last evening. She also asked the Council Budget and Finance Subcommittee to work with City staff to develop a three-tier assessment for annual business license renewal fee structure as a way to promote small businesses. Council Members Franklin, Moore and Murphy supported Council Member Tuohy' s proposal. Council Member Moore stated that this topic will be included on the Budget and Finance Subcommittee meeting agenda on April 6, 2016, and asked City staff to provide a recap on current City of Everett' s practices and information about processes adopted by other cities. Council Member Murphy provided a recap of the Council Retreat held on January 23, 2016. He also reported on his attendance at the National League of Cities conference held last week in Washington, DC. Council Member Murphy stated that he was able to thank Senator Murray for her support in securing a significant portion of the funding for the Broadway Bridge project and invited her to attend a ribbon- cutting ceremony to be scheduled this spring. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. CITY ATTORNEY City Attorney Iles had no comments. 87  March 16, 2016 CITIZEN COMMENTS Jackie Minchew, Everett, spoke about climate change. COUNCIL BRIEFING AGENDA: COUNCIL BILL 1603- 12 FIRST READING: AN ORDINANCE approving the appropriations of the 2016 revised City of Everett Budget and amending Ordinance No. 3470- 15 Presented by Susy Haugen, Finance Council Member Bader entered the Council Chambers at 7: 12 p. m. Adopt Resolution setting a policy for travel and training expenditures for City Elected Officials, and repealing Resolution No. 4689. Presented by Council President Murphy Authorize the Mayor to sign the Interlocal Agreement with the Mukilteo School District regarding school impact fee collection. Presented by Allan Giffen, Planning Adopt Resolution declaring the City's intention to add a portion of the west side of the 2500 block of Wetmore Avenue to the Multiple Family Property Tax Exemption provisions of RCW Chapter 84. 14, and setting April 6, 2016 as the date for a public hearing. Presented by Allan Giffen, Planning Authorize the Mayor to sign Change Order No. 1 with Thomco Construction for the Shore Avenue Strom Water Outfall Project in the amount of$ 226, 831. 52, including Washington State sales tax. Presented by Dave Davis, Public Works 88  March 16, 2016 Council Member Murphy asked if any delays were expected beyond the number of allowable days in the contract. Dave Davis, Public Works, stated that he will provide Council with this information. Authorize the Mayor to sign Change Order No. 2 with lnterwest Construction for Sewer System Replacement and Capacity Improvements Sewer "M" in the amount of$ 1, 002, 259. 68 including Washington State sales tax. Presented by Dave Davis, Public Works Council Member Tuohy inquired about the anticipated completion date. Dave Davis, Public Works, stated that he will check with the working crews and report back to the Council. PUBLIC HEARING — COUNCIL BILL 1602- 11: President Murphy opened a public hearing regarding Council Bill No. 1602- 11, a proposed ordinance establishing a limit on the number of retail marijuana stores in the City of Everett, and amending Ordinance No. 3443- 15. Allan Giffen, Planning, provided a brief overview of the proposed ordinance. President Murphy stated that he received comments from Megan Dunn, of Everett, in opposition to the proposed ordinance. President Murphy invited public comment. Kent Peverly, Dennis Dodder, Mark Staab, Alan Poul, Mark Bigelow, Heidi Bigelow, Jessica Jordan, all of Everett; and Bob McGower, of Snohomish, spoke in support of the proposed ordinance. Jim MacRae, of Woodinville; Andronetta Douglass and Jamie Douglass, of Bellingham; Sean O' Sullivan, of Lake Stevens; Karen McCormick, of 89  March 16, 2016 Marysville; and Michael Perkins, of Bellevue, spoke in opposition to the proposed ordinance. COUNCIL BILL NO. 1602- 11 THIRD AND FINAL READING: AN ORDINANCE establishing a limit on the number of retail marijuana stores in the City of Everett, and amending Ordinance No. 3443- 15 Considerable discussion ensued. Moved by Council Member Bader, seconded by Council Member Moore, that this is declared to be the third and final reading of Council Bill No. 1602- 11, and the city clerk is directed to call the roll for the final disposition of the ordinance. STREET CLOSURE —HALF MARATHON AND 10K Authorize the closure of various streets on April 10, 2016, 8 a. m. to 1 p. m., for a half marathon and 10K sponsored by Snohomish Running Company. AGREEMENT AMENDED— ELECTRICAL ENGINEERING SERVICES Moved by Council Member Roberts, seconded by Council Member Bader, to authorize the Mayor to sign Amendment No. 1 to the Agreement for electrical engineering services in support of the Water Filtration Plant Asset Refurbishment Program with KDW Salas O' Brien LLC in the amount of$ 30, 905. 00. AGREEMENT AMENDED— SPONSORED RESEARCH AGREEMENT UTA15- 001169 Moved by Council Member Roberts, seconded by Council Member Tuohy, to authorize the Mayor to sign Amendment 001 to Sponsored Research Agreement UTA15- 001169 between The University of Texas at Austin and the City of Everett, for data analysis, extending the agreement through May 31, 2016, at no cost to the City.
