November 23, 2016 The regular meeting of the Everett City Council was called to order at 12: 30 p. m., November 23, 2016, in the City Council Chambers of the William E. Moore Historic City Hall, President Murphy presiding. Upon roll call, it was found that Mayor Stephanson and Council Members Roberts, Moore, Murphy, Franklin, Bader, and Tuohy were present. Council Member Stonecipher was excused. Mayor Stephanson led the Pledge of Allegiance. The minutes of the November 16, 2016, City Council meeting were approved as printed. MAYOR Mayor Stephanson expressed his thankfulness for colleagues and staff members and wished everyone a happy Thanksgiving. The Mayor also made the following statement: In recent weeks, we have heard from residents who have concerns about their safety or the safety of others in the community. The City of Everett cares about all our residents and is committed to protecting the rights of community members of all backgrounds. We welcome all who choose to peacefully live here. We are committed to preserving values of inclusiveness and community safety, and we reject bullying, harassment and discrimination. Our neighborhoods, schools and workplaces should be safe places for dialogue, learning and listening. No one should feel unsafe in our community. If you are interested in learning more or participating in community efforts around these topics, I encourage you to contact one of our many local organizations that are engaged in these efforts." COUNCIL Council members echoed the Mayor' s comments and wished citizens, staff, and colleagues a happy Thanksgiving. 376 November 23, 2016 Council Member Moore provided a Public Facilities District liaison report. He also reported that he and President Murphy attended the Polygon development " Overlook at Riverfront" ribbon- cutting ceremony on November 19, 2016. Council Member Tuohy reported on her attendance at the National League of Cities conference held this month in Pittsburg, PA. Council Member Franklin provided a report on her attendance at the NLC conference. She thanked Mayor Stephanson for his comments regarding inclusion and safety of our residents. Council Member Franklin suggested the Council explore the adoption of a resolution that promotes community support and safety. Council Member Roberts reported on his attendance at the NLC convention. He stated that he met with the Governor on Monday, on behalf of the Association of Washington Cities, and urged the Governor to make sure document recording fees that provide revenue for homelessness and affordable housing services would be included in his budget. Council Member Roberts encouraged citizens to shop locally during this holiday season. President Murphy wished residents, City staff, and colleagues a happy Thanksgiving. He also thanked Council Members Tuohy, Franklin, and Roberts for their attendance at the NLC conference held in Pittsburg last week. ADMINISTRATION UPDATE ON PRIOR BUSINESS Debra Bryant, Administration, had no report. CITY ATTORNEY The City Attorney had no comments. 377 November 23, 2016 CITIZEN COMMENTS There were no citizens who wished to speak. COUNCIL BRIEFING AGENDA: Adopt Resolution establishing Human Needs Priorities for 2017 Grant funding. Presented by Rebecca McCrary, Planning Council Member Franklin stated that she is president of Cocoon House, which has historically been funded by human needs grants, and although not related to her salary or work, she' d like to recuse herself from any discussion relating to this item. Council Member Franklin left the council chambers and returned at 12: 46 p. m. following the briefing. PROPOSED ACTION ITEMS: COUNCIL BILL 1610- 45 SECOND READING: AN ORDINANCE establishing rates for Everett sewer service and surface water management, rates for water and filtration for inside and outside city customers, rates for wholesale master meters, and repealing Ordinance Nos. 3417- 14 ( EMC 14. 04. 020) and 3299- 12 EMC 14. 16. 710- 13) CONSENT ITEMS: Moved by Council Member Bader, seconded by Council Member Tuohy, to approve the following consent items: 378 November 23, 2016 RESOLUTION - CLAIMS To adopt Resolution No. 7051 acknowledging the payment of audited and approved claims against the City of Everett in the amount of 1, 320, 940. 60 for the period of November 5, 2016, through November 10, 2016. JOB COMPLETE —2016 HOT MIX ASPHALT OVERLAY PROJECT To accept the 2016 Hot Mix Asphalt Overlay Project as complete and authorize the Mayor to sign the Certificate of Completion with Granite Construction Company. JOB COMPLETE —2016 BIOSOLIDS DISPOSAL PROJECT To accept the 2016 Biosolids Disposal Project as complete and authorize the Mayor to sign the Certificate of Completion with Karl Needham Enterprises, Inc. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. ACTION ITEMS: COUNCIL BILL 1611- 47 THIRD AND FINAL READING: AN ORDINANCE Relating to Municipal Court Judge Positions, amending Ordinance No. 1259- 86 as amended by Ordinance No. 2228- 97 ( Chapter 2. 108 EMC) Mayor Stephanson thanked Council for their support of the ordinance amendment, which will allow the City to consider County residents in a 379 November 23, 2016 pool of candidates to serve as interim municipal court judge to fill Judge Tim Odell' s vacant position until the 2017 municipal election. The Mayor stated he would be bringing his recommendation to Council to appoint Judge Thomas Wynne on an interim basis commencing in January. The Mayor stated he would be formally bringing this forward when the ordinance becomes effective about the middle of December. Moved by Council Member Franklin, seconded by Council Member Roberts, that this is declared to be the third and final reading of Council Bill No. 1611- 47, and the city clerk is directed to call the roll for the final disposition of the ordinance. AYES: Roberts, Moore, Murphy, Franklin, Bader, Tuohy NAYS: None EXCUSED: Stonecipher Ordinance No. 3521- 16 adopted. AGREEMENT — UTILIZE MALL PROPERTY FOR POLICE / ROLE- PLAYING TRAINING Moved by Council Member Tuohy, seconded by Council Member Bader, to authorize the Mayor to sign the agreement between the City of Everett and Steadfast Everett Mall, LLC to utilize Mall property for police/ role- playing training at no cost to the City. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. RFP AWARD — NEC TELEPHONE NETWORK MAINTENANCE Moved by Council Member Bader, seconded by Council Member Franklin, to award Request for Proposal 2016- 057 for NEC Telephone Network Maintenance to Black Box Network Services in the amount of $ 247, 519. 27 including Washington State sales tax. 380 November 23, 2016 Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. PURCHASE —VACTOR 2110 J6 HXX SUCTION BODY Moved by Council Member Roberts, seconded by Council Member Bader, to authorize the purchase of a Vactor 2110 J6 HXX suction body from Owen Equipment Company under Washington State Contract #01912 in the amount of $394, 241. 20, including Washington State sales tax. Roll was called with all council members voting yes, except Council Member Stonecipher who was excused. Motion carried. The City Council meeting adjourned at 12: 50 p. m.
